I have looked closely at the grass and you are correct it is*** - I apologize I was wrong. It isnot what I was expecting but it is *** As far as planting in the winter I questioned you about this on more than one occasion and you indicated it would not be a problem and youwould gladly come back and replace if they diedThis is where the whole complaint stems from. When we did the "walk through"there were a number of plants that looked like they would not make it. I warned my wife not to pay you until they were replaced At that time she even mentioned her displeasure with the Arborvitae trees, but she was sick and tired of dealing with you so she paid you You gave your word that if those sickly looking plants died they would be replacedYou also said that you were going to order a planter, we would pay for the planter and you would stock with plants - that never happened either In the month of May my wife called you and I called you twice, no response. I talked to your sister in law ***, evenshe was shocked that you would leave such a mess of dead plants. We left and were gone for the month ofJune, when we returned I took some pictures of the dead plants and sent them to you - again no response. You finally came out to replace some plants, however I have attached a couple of pictures AFTER you came out to replace plants. Starting with a hole in the ground where you pulled a plant and did not replace, dead decorativegrass, and two plants that even though there is still a few green leaves on them there is no new growth so they will be dead shortly. Do you actually consider that good customer service?

*** *** * *** ***I am writing to address your concerns in reference to the complaint filed on 7/14. In response to your complaint I do feel I have fulfilled our agreement. Per your contract, dated January 17, 2015, I was to construct a retaining wall, install a paver patio,
install stone steps, low voltage LED landscape lighting and plant material. Other smaller items were to be completed as well including installing a drip irrigation system, reshaping your driveway, etc., all of which were included in the contract and completed. In reference to installing the plant material in winter, per our conversation it was my understanding you were aware the plant material was going to be installed during winter months as you wanted this project completed as soon as possible. It is not uncommon to install plant material in the winter, however there is some risk assumed that certain plants may or may not survive. I was contacted on May 8th via text message and informed of some plant material that had not survived; for I which I replaced at no charge per the contract agreement of a one time replacement warranty. I understand you are also concerned as to whether or not *** sod was installed. I did in fact install *** sod and this have been verified by the sod farm where the sod was purchased. Also, please note there is no mention of re-purposing landscape timbers in the contract and the agreement to install sod was a verbal agreement. I feel I honored this verbal agreement and installed *** sod at your request. Finally, I recall meeting with you both on April 25th and conducting a "walk-through." During this final walk through I remember receiving your approval of the work done including the Arborvitae trees that were planted. As of 7/15, I have replaced all remaining shrubs in question and believe I have fulfilled my contractual obligations. I take customer satisfaction very seriously and wish to resolve this matter as soon as possible

Review: Proprietor [redacted] refuses to live up to contractual obligations. He has been contacted three times by my wife, and three times by myself and he refuses to even give the courtesy of a return call.

Specific complaints include but are not limited to him planting bushes in the middle of winter and them immediately dieing - he refuses to replace them.

After being told NUMEROUS times the only sod grass that I wanted was [redacted] he planted fescue anyway.

Our contract specifically states that he was to re-purpose land scape timbers that he removed, into a retaining wall for the side of the hill. After he claimed that would cost him a lot of time, I agreed to let him put in [redacted] instead. He put in the Fescue anyway.

He also did not listen to my wives request for "weepy" ever green trees and planted green arboretums instead.Desired Settlement: I would like to see him come out and replace his dead plants and dig up the Fescue and re-sod with our agreed upon [redacted].

I would also like to see him replace the four evergreen trees to something my wife would approve of - instead of the what he had on hand.
