Initial Consumer Rebuttal /* (3000, 7, 2016/03/25) */
(The consumer indicated he/she DID NOT accept the response from the business.)
1) I was told I won when I showed my flyer to the receptionist and I had to meet with a salesman to claim my prizeThey made me sit through a sales pitch before claiming my prize=high pressure
2) No black line exists between prize box and winner boxIts a pull and peel lottery ticket with simple steps on a separate flyer which I followed
3) It was not free for me I took off work to claim my prize, and my time wastedYou cost me money
4) The reason your turnout was the largest to date is everyone came in to claim the money they won which turned out to be a sales trick to sell a carYou promise free money of course people came
5) I SAW NO PERSON THANK ANY SALESPERSONI watched angry people walk out *** they were lied to, I read a half dozen angry posts on social media, and even your own Facebook page has people shaming you for what you did
6)Good business's do not have to advertise or use games to earn businessThey earn business by word of mouth from other customers
7) You violated (A)(3)
ILCS 5/17-1) (from Ch38, par17-1)
Sec17-Deceptive practices
(A) General deception
A person commits a deceptive practice when, with intent to defraud, the person does any of the following:
(1) He or she knowingly causes another, deception
or threat, to execute a document disposing of property or a document by which a pecuniary obligation is incurred
2) Being an officer, manager or other person
participating in the direction of a financial institution, he or she knowingly receives or permits the receipt of a deposit or other investment, knowing that the institution is insolvent
(3) He or she knowingly makes a or deceptive statement addressed to the public for the purpose of promoting the sale of property or services
8) I am a former military veteran and former deputy sheriff who graduated summa cum laude from ISUI have seen this typical criminal behavior beforeYour trying to rationalize with what you did knowing you did the wrong thing, and whatever I say you will most likely say the oppositeTaking the credibility of a car salesperson over someone of my background and integrity is unacceptable

Initial Business Response /* (1000, 5, 2015/07/31) */
I have read the complaint and understand the concern brought by this customerThe customer states her A/C continues to become warm but no leaks are found in the systemThe reason for this is because she needs a new A/c compressorThe mechanic
who switched out the orvice tube simply put a band-aid on the situationThe orvice tube is basically a filterIt catches debris in the line as the A/C cools the airThe reason why this tube has had to be replaced twice is it continues to get fill with debris, blocking the flow of freonThe A/C compressor is throwing debris into the line clogging the tube, warming the airUsing the guidelines of GM, the corrective action is to replace the A/C compressor, which is causing the issueOur Techs followed the guidelines provided by GMMsWilliams had a low reading on her High Side and a high reading on her Low SideThe two options GM suggests are to recharge the system or replace the malfunctioning compressorThe system was full of freon , so the second option was suggestedWe have taken steps to make sure we have quoted the correct diagnosis to fix her problemThe non-certified tech she used to band aid the situation simply put "duct tape on a leaky pipe" and called it goodWe have had a long term relationship with MsWilliams and cherish her businessWe would not jeopardize her trust by either suggesting a haphazard alternative or something we could not prove to her by stating the GM guidelinesUnfortunately, she is going to find out we are correct and certainly not in the wrongI hope she is willing to write a letter about Green Chev being correct in the diagnosis when her A/C orvice tube clogs again. If she would like to complete the work we have suggested we will use the evac and recharge fee toward the billIf MsWilliams would like to come in we will go over, step by step, the guidelines of which we followed

Unfortunately, this is not the response that I should be receiving, and do not accept it; though it's very well expectedI did not inform anyone at Green Chevrolet about who fixed my car nor rather they were certified or notThe issue here is that I took my car to Green Chevrolet to be fixed and they were unable to fix it, which this is what is relevantI will accept a copy of the guidelines where it states that my car can be charged under a year Thank you

irst and foremost Green Chevrolet has zero desire to ever put ourselves in a situation which would make a potential customer angry. What we thought we were doing was simply mailing out a free chance to win some money. We did not realize people...

would read through the black line dividing the "winner" box from the "prize" box. If a customer made that mistake we are 100% apologetic to them. This contest was meant to fun, free, and a chance to walk away with a prize for doing nothing. It has turned out if a customer reads through the black dividing line then they might believe they have won money only to find out that they might not have. We understand under that vein a customer would be very disappointed. We felt that a free gift was better than what Dept. stores do on Black Friday, luring customer to wait for hours for a cheap product, which there are only a few of and then running out while hundreds of people go without. To win at this contest you've have to do absolutely nothing. We do not hassle anyone or pressure him or her into a sales pitch of any kind. We are a car dealership, so not surprising, we would want to earn your business on an automobile. It would be surprising to most people if a business didn't ask for a customer's patronage. If you went to an insurance office for a free gift they would ask if you had enough insurance. We are not "bait and switching" as you are not required to buy a single thing. We are not "scamming" any one, as again it is a free contest and you don't have to buy anything from us. If a person reads the flyer as it is written, and not as they want it to read it, then there is no issue. We have had one of the largest turnouts to date for a contest and have been thanked by hundreds of people for what we do. We are absolutely not trying to anger a single solitary person. We again apologize if you mistook our free game as misleading. Please understand we do not wish to anger people.

(The consumer indicated he/she DID NOT accept the response from the business.)
I read this flyer from front to back looking for the gimmick nothing there have no clue what this black line is I can't find on the card or flyer. They had more customers than usual because people thought they had won. As far as I am concerned it was a scam. So I drove all the way to Peoria for a sales pitch and no prize what so ever. Fraud or bait and switch is what it was. I am sure a lot of people fell for this scam.
Final Business Response /* (4000, 9, 2016/03/25) */
I want to personally apologize to this person. Our desired outcome of this mail piece was the exact opposite of his feelings. We are giving a vacation away to every single person who comes in. We are giving a TV a day away also. We had hoped two disclosures and the black line separating the the cars from the prizes would make it clear of winning one of the prizes. I can promise this customer we acted in good faith trying to make a free contest easy to read and win. I can only apologize profusely to this person and hope he can accept my apology that we , in no way, ever want to mislead or mistreat a customer. The prizes are insured and paid out through the Hole in One company.

(The consumer indicated he/she DID NOT accept the response from the business.)
That is a rediculous response. When we first received the winning card opening it to see the 3 silver cars in line with it showing we won $5000. But after talking with the representative from Green Chevy they asked if we were in the market to purchase a car...and we responded no, they immediately HUNG UP. I FULLY READ THE ENTIRE FLYER PROMOTION INCLUDING SMALL PRINT. when we took it into them, they confiscated the flyer saying we won a trip, which was the bate n switch factor. It is a trick promotion and clearly proves those not wanting to buy a car are unwanted by them hanging up on us.
Final Business Response /* (4000, 9, 2016/03/25) */
First, I want to sincerely apologize to this customer. In his desired resolution it is to avoid other people from negative issues. To help avoid negative issues we have given away a vacation to every person who has come into the dealership that doesn't win the money. We are also giving a TV a day way to anyone who simply registers for the drawing. Lastly, we will not be doing any more of these sales.
I truly hope this customer can accept my personal apology for any confusion. As a company we do not wish to alienate anyone from doing business with us.

This is nothing short of a classic bait-and-switch because a reasonable person would look next to the line with three silver cars (every game card had three silver cars in a row, according to several stories) and assume that they had won the corresponding prize of $5,000. I challenge you to find any person that would look at the flyer, even notice the black line in the first place, and deduce that they had NOT won $5,000, but one of the other prizes. The fact that your Facebook page has been flooded with negative reviews following this "promotion" is a testament that you were relying on the gullibility of the recipients just to get them in the door and try to sell a car to them. I've heard that others have also filed Revdex.com complaints against you, so obviously I'm not the only one that "read through the black line" and was deceived.
It doesn't matter that a person doesn't have to do anything for this contest. The fact that you intentionally deceived hundreds of people just to drum up some business is unethical at best and disgusting at worst. I'm not surprised that you've had "one of the largest turnouts" for this promotion; if hundreds of people thought they'd won $5,000, who in their right might wouldn't show up at your door? Tell me, how many of those people were actually interested in giving you business after finding out they'd been deceived? Almost none, I'd wager.
I can see that you don't find any problem with this promotion so it's useless to keep this dialog going. I hope you're enjoying the 1.3-star average rating on your Facebook page (47 out of 52 reviews are 1 star, which should tell you something). I have already told several people about this awful promotion and convinced them never to give you their business, and I will continue to do so.

First, let me apologize for the confusion of this flyer. What I thought was a fun game to play turned out to be a confusing flyer. I apologize to you if you feel mislead. My intention was to give away some prizes and increase our customer base....

It seems I have upset you instead. I would be glad to apologize in person or by phone if you would like. The mail piece was not purposed to anger you. I am sorry for wasting your time and energy to come down here.
