Green Earth [redacted] [redacted] March Revdex.com Corporate Office [redacted] [redacted] *** [redacted] Re: Complaint [redacted] Our response: Green Earth has been operating in Rockport and the Coastal Bend area for about years We have been in business for years We have operated in Arkansas and Texas during this time Our company is very small and super customer friendly We have always treated our customers like family Conflict is never good nor is it productive These type issues detract from our production, peace of mind and profit It has always been our goal to make every customer totally happy and to give them a little more than they paid for That is why this complaint is so troubling to us Sometime last year we were contacted by a potential customer in Rockport about doing landscaping at their winter house in Rockport A real estate broker in town suggested that the folks call Green Earth Our reputation is strong in this community We receive referrals from builders, the Chamber of Commerce, the City of Rockport, Real estate brokers, nurseries, and numerous other sources I want to point out that in years of operations in states and thousands of happy customers; we have had only Revdex.com complaints in all that time We do a substantial amount of charity work in our community Green Earth continues to help widows and others in need We are a very small company but we do a lot of work in the Coastal Bend area We met with the couple who asked for a bid to landscape their property We discussed the scope of work and helped them develop a plan They had a difficult time visualizing what we wanted to do on their property The lady drew up a plan and sent it to us With her plants we developed a materials list and a budget We presented our bid to the couple and they told us they would get other bids We suggested that was a good plan Once they got the other bids we were asked to reduce our budget by over 4000.00, which we did They did not have the money to pay for all the work to be completed so we agreed to start the project and as they had money they would pay us The materials were ordered and paid for and the subcontractors arranged We really like these people and it is very distressing to us to be in a situation like this We take pride in doing a little more than our customers pay for This has been a very difficult situation from the start [redacted] We did all the preparation work on the project We sent numerous photos and e-mails detailing the work that we were doing The customer was kept up to date at all times as we worked on their project Our concrete man installed the patio that was part of the project The fill dirt was put in place, the railroad ties were delivered and we even planted palm trees ahead of schedule We apprised the customers on a weekly basis of what was going on They did not have the funds to continue for a while so we stopped working There was a time when there were so many renters in the house with small children that we ceased operations for safety reasons We informed the customer of this During the down times we mowed their property at no charge to keep it looking good We treated the property for weeds as well Finally they got enough money together to pay for the culverts to be installed on the [redacted] side We met with the city and arranged for the culverts to be put in place We purchased the culverts and had them delivered and the city installed them We did a finish grade on the new sand that was in place and told the customer Photos were sent every step of the way We told the customers that at our expense we would put sod in place at the ditches That was simply a good faith effort on our part to help them We were waiting for the work to be completed and then the sod was to go in place Finally we were able to have access to the property and the railroad ties were put in place Due to weather and lack of funds in the beginning and then a steady stream of renters the work moved along slowly When we start a project like this it normally takes about days to complete If the customer had paid for the work when they initially contracted with us the work would have been done in about a month They lacked funds at first and then weather delays came along not to mention the lack of access to the property due to renters Since we started their project we have started and completed about other projects We like to get in, get paid for materials, finish the job and get our final pay and move on The customers did not want a fence to be put in place when the job started We were told by the customer where to place the railroad ties and we installed them Months later the customer decided to put in a fence due to some theft of their personal property They had the property surveyed and the fence company prepared to install the fencing The customers asked us to move all our railroad ties because the fence was to be installed They decided to put the ties inside the fence line We met with the fence contractor and the customers and agreed to move the ties inside the fence line It was a great deal of work to install the ties and then uninstall them and move them inside the fence line After the fence was installed we put the ties back in place At some point later the customers determined that they did not want the ties after all We agreed to remove the ties The customers suddenly were in a hurry to have the ties removed and hauled away before some party they were having We removed and hauled away all the railroad ties The railroad ties became quite an expensive project for us First we bought them and had them delivered to the site Then we waited months to be able to install them Once we were able to put the ties in place we took pictures and let the customer know about the progress We met with the customers and walked the property and discussed the latest changes they had in mind They decided now they wanted to increase the planting beds by 400% We agree to do that at no additional cost to them Our agreement was that we would move forward and get together again in weeks to assess the progress We were so close to being finished We had our sprinkler contractor come to the site and he walked the property and met the customers and I showed him the new design the customers had in mind He agreed to create a new plan and would start as soon as he had the design ready The customers did not wait for the week period to elapse They did not meet with us again The next contact we had was a phone call from an attorney telling us not to return to the job site This is the same type behavior we have experienced from the customer during the entire time Let me summarize: • The customers contacted us to do the work • We were highly recommended to them by a Real Estate Broker • We did not need the work • We gave them a bid • Customers wanted to get other bids and we agreed they should • Customers asked for a substantial reduction in our price, which we gave • They could not afford to have all the work done at once • We agreed to do the work over a period of months in stages as they could • Work progressed • Customers changed their minds many times about various aspects of the job • Property was inaccessible due to renters for extended periods of time • There were weather delays • Customers did not mind the project taking months to complete • Once they got more money in hand they wanted things finished quickly • They changed the scope of the work • We offered to have the county commissioner mediate – they refused • We met with them and had an agreement – they broke the agreement • It seems they developed buyers remorse • Rather than finish the project they want money refunded • They asked for receipts for materials purchased – we do not do that • We do a turnkey project and never give refunds nor do we show customers our cost for anything • We make a reasonable profit on all aspects of a job • The legal costs and bother are more expensive to this customer than they money they have spent • All the customer had to do was allow us to complete this project • They have run around in circles since the start • Customer would call us and text us numerous times, telling us every time our crew would take a smoke break • We do not intend on giving a refund • We do not want to place a lien on their property • We do not want to fight against them or anyone • We bought & had the culverts installed as agreed • We had concrete patio installed as agreed • We prepared the yard and had fill dirt brought in and placed, as agreed • We bought railroad ties and installed them as agreed • We uninstalled the ties and moved them • We reinstalled the ties • We uninstalled the ties at the customers request • We moved the ties off their property at their request • We bought and installed the palm trees as agreed • We arranged for the sprinklers to be installed, as agree • We continued to do everything we agreed to do • We did not charge them for constant changes in plans • We did not pressure them when they did not have money • We sent pictures and text messages and emails constantly apprising them of the progress • The customers willingly hired us to do the job • We have worked with them in an amicable fashion • We have done everything possible to make these people happy • There is no way at this point to resolve this matter • We have no ill will toward these folks • We are willing to install a sprinkler system for the non-profit or church or a friends property that would equal the amount we would have spent on their sprinklers • We want the books to be balanced in this matter • Our goal is to have 100% satisfied customers

Complaint: [redacted] I am rejecting this response because: We can go back and forth til we turn blue in the face, but I believe the attached photos should say it all $16,and this is what we had to show for it In the mean time, we have had another landscaper come in and do our yard who charged us as work was done and it is looking beautiful! We also had the "same" irrigation company install the sprinkler system and everything Green Earth said about them having to change their design was false Plus, the sprinkler company has never received any of the $2,that I had paid in June of The railroad ties were "all" outside our property lines....this is why they were removed The fencing company would not put up a fence outside our property....which makes a lot of sense The railroad ties were Green Earth's idea, and we decided that with the fence, they did not serve any purpose We, as property owners, should be able to give our opinions BTW...all the fill dirt flowed under the ties and ended up in the ditches and ***ghbors' yard I think we have less dirt in the yard than before they started Which comes to one of my original concerns of being charged for loads of fill dirt and only having proof of loads We are now in the process of a law suit, therefore, any further responses will be done by our [redacted] in court BTW....we are not the only people who have complaints or have law suits against Green Earth Landscaping Regards, [redacted] ?

I have thought it over We are willing to make an offer to the ***'s in the interest of good will All the money they paid us was spent on labor and materials for their job We even paid the sprinkler contractor in Corpus the $in advance He has since gone out of business We have in the meantime established very good relations with two licensed, honest sprinkler companies in Rockport Since we have paid out all the money they gave us there is nothing left to refund We are willing to give them $a month for months to pay them back for the sprinklers that never got installed This is our best and final offer They will have to release all claims and make a full and final settlement with us They give up their rights to sue us if we do this If they did sue and if they won a judgment against us they would never collect a dimeWe really want to put this issue to rest It is a major distraction and needs to be buried thanks** green earth

If Green Earth paid out the full $16,300 it was not on our job site.  There was nothing to show for it after 8 months.  Once again.....we had 2 loads of fill dirt, 12 x 12 concrete slab (which we need to dig back out because it was installed poorly), 2 small queen palms with price tags of $119/each and a small palm bush.   We will see you in court!

Re:  complaint [redacted]

•         Please note that we have made previous responses to this complaint.
•         We collected a little money at a time from the customer and did work as the money was available.
•         We coordinated with the City of Rockport and made sure that our railroad ties placement was acceptable to the City.
•         We bought and paid for all the railroad ties, re-bar and other supplies and it was delivered to the site.
•         We bought the culverts which were also installed.
•         The concrete patio slab was installed per the agreement.
•         The entire lot was prepared and fill dirt put in place per the agreement.
•         We planted some Palm trees early because they were on sale and we were able to get 2 for the price of 1 that we quoted in the original agreement.
•         The customers decided to have a fence installed and requested that we move the railroad ties inside the area to be fenced.
•         At great labor expense we moved all 60 railroad ties back inside the property line and worked with the fence contractor to make his job easier.
•         Upon completion of the fence we reinstalled the ties.
•         The customers asked that the ties be removed, which we did.
•         They were in a hurry to have all the ties removed quickly due to a party they were having.
•         We successfully got all the ties off their property before the party.
•         The following day we moved the ties to a disposal site and there were no ties remaining on or near the customer's property.
•         We met with the customers so discuss the completion schedule.  They agreed that we would continue to work for 2 weeks and then we would meet again.
•         I took the sprinkler contractor on site and he measured and reconfigured his drip line system and had to redesign due to so many customer changes.
•         I told the customer that as soon as the new design was complete that the system would be installed.
•         We received a call from an [redacted] a few days later telling us that the customer was canceling our agreement.
•         All the monies paid to green earth have been spent in on extra labor and on the materials etc. used for the job.
•         There is no money remaining to refund.

Re:  Complaint [redacted]

Our response:

Green Earth has been operating in Rockport and the Coastal Bend area for about 4 years.  We have been in business for 10 years.  We have operated in Arkansas and Texas during this time.  Our company is very small and super customer friendly.  We have always treated our customers like family.

Conflict is never good nor is it productive.  These type issues detract from our production, peace of mind and profit.  It has always been our goal to make every customer totally happy and to give them a little more than they paid for.  That is why this complaint is so troubling to us.

Sometime last year we were contacted by a potential customer in Rockport about doing landscaping at their winter house in Rockport.  A real estate broker in town suggested that the folks call Green Earth.  Our reputation is strong in this community.  We receive referrals from builders, the Chamber of Commerce, the City of Rockport, Real estate brokers, nurseries, and numerous other sources.
I want to point out that in 10 years of operations in 2 states and thousands of happy customers; we have had only 2 Revdex.com complaints in all that time.

We do a substantial amount of charity work in our community.  Green Earth continues to help widows and others in need.  We are a very small company but we do a lot of work in the Coastal Bend area.

We met with the couple who asked for a bid to landscape their property.  We discussed the scope of work and helped them develop a plan.  They had a difficult time visualizing what we wanted to do on their property.  The lady drew up a plan and sent it to us.  With her plants we developed a materials list and a budget.

We presented our bid to the couple and they told us they would get 2 other bids.  We suggested that was a good plan.  Once they got the other bids we were asked to reduce our budget by over 4000.00, which we did.

They did not have the money to pay for all the work to be completed so we agreed to start the project and as they had money they would pay us.  The materials were ordered and paid for and the subcontractors arranged.

We really like these people and it is very distressing to us to be in a situation like this.  We take pride in doing a little more than our customers pay for.  This has been a very difficult situation from the start.  [redacted]

We did all the preparation work on the project.  We sent numerous photos and e-mails detailing the work that we were doing.  The customer was kept up to date at all times as we worked on their project.  Our concrete man installed the patio that was part of the project.  The fill dirt was put in place, the railroad ties were delivered and we even planted 3 palm trees ahead of schedule.

We apprised the customers on a weekly basis of what was going on.  They did not have the funds to continue for a while so we stopped working.  There was a time when there were so many renters in the house with small children that we ceased operations for safety reasons.  We informed the customer of this.

During the down times we mowed their property at no charge to keep it looking good.  We treated the property for weeds as well.  Finally they got enough money together to pay for the culverts to be installed on the [redacted] side.  We met with the city and arranged for the culverts to be put in place.  We purchased the culverts and had them delivered and the city installed them.  We did a finish grade on the new sand that was in place and told the customer.  Photos were sent every step of the way.

We told the customers that at our expense we would put sod in place at the 2 ditches.  That was simply a good faith effort on our part to help them.  We were waiting for the work to be completed and then the sod was to go in place.

Finally we were able to have access to the property and the railroad ties were put in place.  Due to weather and lack of funds in the beginning and then a steady stream of renters the work moved along slowly.

When we start a project like this it normally takes about 30 days to complete.  If the customer had paid for the work when they initially contracted with us the work would have been done in about a month.  They lacked funds at first and then weather delays came along not to mention the lack of access to the property due to renters.

I am rejecting this response because:

We also are in a family business which has been around since 1937 with 50+ employees, and we have "Excellent" credit rating so, getting a loan would not have been a problem.  My problem is paying $20,000 in advance before work is completed. I already kick myself for paying $16,300.

Once again.....here are my complaints and feedback from his responses.
Green Earth gave us a proposal of $24,751 with no design of what he intended to do.  He said it was all up in his head and for him to give us a drawing would require an extensive and expensive computer program.  I told him we needed to stay under $20,000 and gave him an "example" of how easy it is to draw a design with a simple piece of paper, pen and ruler.  I hired a professional because I wanted a professional's design.  I admit that I am not a landscaper and know nothing about Texas plants.  For $20,000 I wanted some idea of where my money was going.  So, as far as "ME" changing his plans....What plans?  There were no plans except for what "I" sent him.  Also, we did not get 2 other bids, though I really wish I had now.
We paid $3,000 down and he said he would bill us as work progressed, which he did.  Unfortunately, when we arrived in August, we found very little work done and we had paid him over $14,000.  We expressed how unhappy we were and he assured us that it would be completed by the end of December and yet requested even more money, which I had paid.  Now we are up to $16,300.  We arrived in November and still no progress!  He claims this project could have been completed in one month....we gave him 8 months! If he completed 20 jobs while doing ours, which he stated, that explains why our yard did not get done and where our money was spent.  I feel he used our money and supplies for these other projects, because it sure isn't in our yard.
We asked them to remove the railroad ties because they were all placed outside of the property lines.  He as a professional, should have figured this out before the work began.  I have attached photos of our yard after our fence was installed and the work that was done within an 8 month period and $16,300.  Need I say more?

Complaint: [redacted]
I am rejecting this response because:
We can go back and forth til we turn blue in the face, but I believe the attached photos should say it all.  $16,300 and this is what we had to show for it.
In the mean time, we have had another landscaper come in and do our yard who charged us as work was done and it is looking beautiful!  We also had the "same" irrigation company install the sprinkler system and everything Green Earth said about them having to change their design was false.  Plus, the sprinkler company has never received any of the $2,900 that I had paid in June of 2013.
The railroad ties were "all" outside our property lines....this is why they were removed.  The fencing company would not put up a fence outside our property....which makes a lot of sense.  The railroad ties were Green Earth's idea, and we decided that with the fence, they did not serve any purpose.   We, as property owners, should be able to give our opinions.  BTW...all the fill dirt flowed under the ties and ended up in the ditches and [redacted]ghbors' yard.  I think we have less dirt in the yard than before they started.  Which comes to one of my original concerns of being charged for 10 loads of fill dirt and only having proof of 2 loads.
We are now in the process of a law suit, therefore, any further responses will be done by our [redacted] in court.  BTW....we are not the only people who have complaints or have law suits against Green Earth Landscaping.
