We understand your concern as to the amount that was charged due to the window breakHowever, Green Genius Lawn Care is still not responsible for this amount since it was decided by the landlord to use the company they chose and did not allow the business to take care of it themselvesThe company stands firm in not paying the amount chargedThis should be taken up witht he landlord

Complaint: [redacted] I am rejecting this response because: Mr [redacted] 's response is a misrepresentation of the facts related to this complaint The facts are as follows: I leased a home from [redacted] , a Realtor with ReMax Associates in Boerne, Texas Mr [redacted] was my Landlord and represented the Property Owner The Property Owner sold the property, so I had to move out The window in question was broken on the evening before I was scheduled to move out I had a walk-through of the property with my Landlord scheduled for the following morning Mr [redacted] , after arriving several hours late, broke the window while working on my yard in the dark It was about 10:p.mwhen he informed me that he had broken the window Mr [redacted] told me immediaely after breaking the window that he had another customer who was in the glass business and wanted to have him replace the window I told Mr [redacted] that I had no preference on who replaced the window as long as it was okay with the Landlord, since the home did not belong to me Mr [redacted] was aware of the fact that I was moving out and that I had a walk-through scheduled the next morning with the Landlord Mr [redacted] said he would contact the Landlord to arrange for the window to be replaced My Landlord was also leasing a home to Mr [redacted] , so they already knew each other It is my understanding that Mr [redacted] had previously done some yard work for Mr [redacted] on properties he managed The following morning at 9:a.m., Mr [redacted] the Landlord arrived as scheduled for the walk-through When I showed him the broken window and asked him if Mr [redacted] had contacted him, the Mr [redacted] said he had not heard from Mr [redacted] I explained that Mr [redacted] wanted to have someone he knew fix the window Mr [redacted] said that his responsibility to the Property Owner meant that he had to deliver the home to the New Buyers in the same condition it had been in when they purchased it Mr [redacted] said that this meant he had to replace the window immediately with a window of the same quality as the window that had been there before He explained that the cost for replacing the window would be deducted from my security depositMr [redacted] said that I would receive a copy of the glass replacement invoice with the remainder of my deposit, and should then present that invoice to Mr [redacted] for reimbursement, which is exactly what I did The selection of Thad Ziegler Glass was made by the Landlord, [redacted] of ReMax Associates in Boerne, Texas Since I was obligated to surrender the property on the day after the window was broken, I was not consulted on vendor selection Mr [redacted] has a lot of experience handling multiple rental properties, and I have no reason to believe that he would spend more for a window than necessary I can also find no evidence to support Mr [redacted] ’s claim that Thad Ziegler Glass charged too much for the replacement window After reading Mr [redacted] ’s response to my initial Revdex.com complaint, I contacted Thad Ziegler Glass and Samuels Glass in San Antonio and learned from each of them that the window in question is more expensive than a standard window because it is a large double-paned picture window that is coated and tinted for energy efficiency I obtained a quote from Samuels Glass in the amount of $to replace a window of the same size and type, which is comparable to the price of $charged by Thad Ziegler Glass When I received the invoice copy and other paperwork from Mr [redacted] , I had my Realtor, [redacted] of ERA Troy Realtors contact Mr [redacted] on my behalf Mr [redacted] told Ms [redacted] that he would take care of paying for the invoice once he had contacted Thad Ziegler Glass to confirm the amount About a week after talking with Ms [redacted] , Mr [redacted] told me over the telephone that he had not paid me because he had been in the hospital He said that he was going to have to talk to his wife to see what type of installments they could afford to pay me and he promised to call me back and let me know by the next MondaySeveral weeks have passed, and Mr [redacted] never called me back Mr [redacted] does not answer my calls, and does not respond to voice mails, text messages or written correspondence that have been left by me or by my Realtor Ms [redacted] You may contact [redacted] of ERA Troy Realtors to confirm the information in this complaint I have included supporting documents in a PDF file, including the original invoice from Thad Ziegler Glass, a copy of the check used for payment, and the letter I received showing the invoice amount deducted from my security deposit Green Genius and Mr [redacted] have not fulfilled their responsibility in this matter My original complaint stands Regards, [redacted] ***

The customer was informed of the glass break by *** *** right after it happenedAfter that point, he told the customer that he would call the glass company and get the issue resolved and fix the window that was brokenThe customer then stated that she would not like him to do thisShe
informed him that she would have her landlord take it out of her deposit and fix it that wayShe never gave *** a chance to fix the issueThe cost of the replacement that was charged to the customer is far greater than it would have cost if she would have allowed him to fix it himself by going directly to the glass companyIn previous quotes he has gotten from other si***r windows that have replaced due to them being broken by equipment, they run around $Since she chose to have the landlord take it out of her deposit, and he charged such a large amount, it is not Green Genius Lawncare responsibilty to pay for the overcharge since she never let him take ownership in the first placeIt was the customer's choice to have this issue resolved and paid for this way

Mr*** has not offered any resolution to this complaint
Mr*** *** of Green Genius told me and Ms*** *** of ERA Troy Realtors that he would pay the invoiced amount to replace the window. Instead, Mr*** broke off communication and I was forced to file this complaint in order to get him to respond. You may contact Ms*** at ###-###-#### to confirm this and other facts concerning this complaint.
Mr*** has not offered a resolution to this complaint. Instead, he has chosen to call into question the professional ethics of a Realtor and a reputable business. Mr*** acted in keeping with his fiduciary responsibility to his client and the new buyer of the property by hiring a well-known firm to return the broken window to its original condition. Thad Ziegler Glass is the oldest family-owned glass company in the United States, having been in business for more than years. Mr*** has produced nothing to back up his claim that this matter was not handled appropriately by Mr***. Mr*** has produced no proof that the amount charged for the window by Thad Ziegler Glass was unreasonable
It is unfortunate that the window that Mr*** broke was large and made of high-quality glass with energy efficient properties. The fact that the window was of a higher quality, and therefore more expensive to replace than other windows Mr*** has broken in the past has no bearing on this complaint

When I received the invoice copy and other paperwork from Mr. [redacted], I had my Realtor, [redacted] of ERA Troy Realtors contact Mr. [redacted] on my behalf.  Mr. [redacted] told Ms. [redacted] that he would take care of paying for the invoice once he had contacted Thad Ziegler Glass to confirm the amount.  About a week after talking with Ms. [redacted], Mr. [redacted] told me over the telephone that he had not paid me because he had been in the hospital.  He said that he was going to have to talk to his wife to see what type of installments they could afford to pay me and he promised to call me back and let me know by the next Monday.
