In response to complaint with assigned ID of ***: This is my rebuttal on actions that took place at my business, Just Pawn It 11C, on July 21, On April 21, he had pawned the *** with the serial number ***, ***, *** *** *** with one controller in the box
When he had pawned the *** for $200, pawn Interest payments are due in day incrementsHe had only made two $interest payments on the ***, not three, as he had statedYou are always paying for the previous month when you are pawning an itemSo technically, when he paid in May that paid for the period of April 21-May 21, & then the payment he made in June, paid for the period of May 21-June He never made a payment for the period of June 20-July He had called the shop on July 17, to see when he was due; I never called him on that dateHe had two options, either make his payment on Saturday July 18, or I told him that he could make his payment by 11:AM on Tuesday July 21, Yes, I gave him a time because I was being generous, because I did not want to see him lose his *** even though the 21st was after his due dateHe called at 1:PM on July 21, & asked to speak to the owner & was told by the young lady that I was busy & that I would return his call when I was no longer busyThe *** was NEVER put on layawayHe never came back to the shop to make his monthly paymentsHe paid by phone with a credit card & he had no problem using that statement as his receiptAlso, on May 6, he had pawned items, which were a *** *** *** *** *** * *** *** *** binoculars, which I had loaned him $on those items & he got really agitated that I wouldn't loan him more than the $that I had loaned him on those ItemsThe first due date of the interest payment for those Items was June 5, & he made that payment, but the second interest payment which was due on July 5, he never paid it at allI gave him days to pay that & I contacted him several times to try & get him to payHe never mentioned that in his complaintI was more than fair with himHe was reminded that if he lost this pawn, the next one would be pulled & sold if it wasn't paid on time, Still, I gave him, as a courtesy, an hour into our business day, to payThe pawn ticket states; "In the event said Total of Payments is not paid on said Due Date, or my loan renewed by payment of the monthly charge, Lender shall become vested with all right, title and interest of myself and/or my assigns to such merchandise to hold and dispose of as its own property, without any notice to, or demands from me." I call him like I do everyone else as a courtesy at my pawn shop in which I am NOT required to doI also *** & mail pawn tickets if their phone numbers are disconnectedIf he was so interested in keeping his ***, he should have called that morning asking for more time, instead of waiting until 1:PM to finally call to argue with me because he had lost the *** by that timeHis excuse was that he was waiting for an item of his to sell on *** & the money being put into his *** accountHe had lost his job because of a DUI & that he is living off of his girlfriend, who is a hairdresserThose were his exact wordsHe also failed to mention the way he acted when he came into my shop, stating that I was running a dirty business & that I was dirtyHe caused a scene & was rude to me in front of customers & I then advised him to leaveI also have a recording on my voicemail on my business phone line of him stating that he caused a scene at my shopWe did not sell the item on his due date & we are NOT replacing any item for himI didn't threaten to call the police, a customer in the shop didThere was no discussion of revising his contract eitherHe went over days & defaulted on his contractI've also attached a GPS map where he has stated that it takes an hour and fifteen minutes to get to the pawn shop; clearly you can see it is only miles, which is minutes without traffic & minutes with trafficThis is a pawn shop, you pawn stuff & if you make your monthly interest payments on time you are able to keep your stuff hereHe did not pay on time, he lost his item, & we are not replacing itHe is not worried about his other items that he lostPlease see attached a copy of a blank pawn ticket to show any additional information concerning non-payment & defaultIf verbal agreements are not binding then he should have paid on a day that we were open before his due dateThank you for your time & hopefully you will see that we have proved a lot of his allegations are falsePlease call us if you have any questions.
