Revdex.com: I have reviewed the response submitted by the business and have determined that the response does not satisfy or resolve my issues and/or concerns in reference to complaint # [redacted] Please add your rejection comments below Regards, [redacted] I have read the reply from the business Green Mountain Awning and there are statements that need to be reviewedYes, new siding was installed on the house and yes, the top brackets only were removed and reinstalled by the contractor and are level and square with the window When I stated that the brackets were not moved, I was talking about the hinged brackets to the employee who was here, because he saw holes in the trim from an old awning installation and he thought that they were from this work on the houseThis was done to install new aluminum trim at the top of the windowThere were two awnings replaced, one of which is covered by insurance, the other was in question, because there were two insurance claims for two separate storms causing hail damage within weeks of each otherEach awning was damaged in separates storms There were two claims to the insurance company of which I have the claim forms So GMA, in which my contractor received the awnings from, are wrong in their statement that both awnings were worn Not true One awning had a hole through the center which was caused by hail piercing it, the other was thrashed around by the wind and ripped it along the supporting barMy contractor has contacted GMA by email (see attached " [redacted] to GMA") stating that he would meet with them at my home if necessary to go over the repair, but did not receive a response from the companyGreen Mountain Awning has never contacted me after the awnings were first installed, I asked the employees of GMA to have the owner come and look at them If he did, he never let me know he came and made no attempt to contact me to discuss his findingsI was never asked for a 50% deposit so I never denied giving them one as stated in GMA's reply That is a down right lie I have purchased awnings over the years from this company without any deposit and have always been treated well by the former owner(father of owner now) with any problems that might arise I have had to have some awnings resewed before because they weren't sewed correctly by this company without any problem In fact, I mentioned that to the owner now, when he was here to pick up the awnings and he stated he knew why because of the employee who did the work on themI never rudely told them to pick up the two awnings as I stated I wanted them fixed to be square with the window, if they can't do that then yes, they can keep them and leave the frames with me As far as I know, there was only one invoice sent to the contractor on 7/7/not multiple invoices as stated in GMA's reply And that is why they sent an invoice to me with a finance charge, still unethical business practice I have emails to show that my contractor was going contact the owner of GMA and hopefully get it resolved back in July According to GMA, this was never done.As I have stated, this could have been avoided if the owner actually contacted me, schedule a time to meet, discussed the problem and remedied the situation This can still be done, but I am not going to pay any finance charge, since the billing was sent to my contractor and not me.They should contact my contractor and me and schedule a time to meet at my home and go over the problem Hopefully we can come to a compromise GMA states they do not believe this will happen Try communicating with your client!

To Whom It May Concern,First of all, the company under complaint is no longer existing. [redacted] was disbanded back in April 2015. The company, its trade name, assets and customer base were sold from father to son and put under a different company. Legally, this company is...

L.A.A.A.B. Land and Sea, Ltd. We do business as Green Mountain Awning as the trade name was purchase was important to our long standing customers. The president of the company is [redacted] Jr. and the vice-president is [redacted] (myself). Our mailing address is [redacted]. Our physical address is still [redacted] and phone number [redacted] On to the complaint by Mr. [redacted]) Jr and I do all of the sales calls personally as he has been in this business since it was purchased by his father in 1989. I noticed the Mr. [redacted] has stated this awning job was an insurance claim due to hail damage. Upon examination of the awnings it was immediately noticed that the damage was not due to hail, but rather from age. [redacted]) pointed that out both verbally and physically, much to the argument of the customer. The binding around the edge of the valance of the awning was coming off and the tears in the awning directly showed age, not any form of damage directly related to the hail. Upon an any insurance claim it is normal protocol for us to hear from said insurance company. We did not hear from any insurance company so we assumed this was not a claim based on our observations during the sales call visit. The installation was done by two employees of ours. One has been with the business almost as long as [redacted] Jr. and the other was [redacted] Jr's son who works for us during the summers. When they left Mr. [redacted]'s residence we were notified that the hardware/brackets for the awnings had been moved. The brackets are the metal pieces attached to the building structure in order to install the awnings. Normally window awning units are removed for the winter months and re-installed for the spring/summer. The brackets, however, stay up permanently. This stands true unless there is home repair done such as (but not limited to) siding removal/installation and window replacement. It is my understanding that the siding was replaced on Mr. [redacted]'s home by Mr. [redacted] this spring. Mr. [redacted] insisted to our employees that they were not moved and would not accept their offer to get a ladder better suited to move the brackets. Instead he wanted to have [redacted] Jr at his home immediately. Unfortunately we were at a job that had us out of town until after an appropriate time to do a site check. We did go and take a look at Mr [redacted]'s awnings. It was clear that the brackets had been moved at some point and the awnings were not sitting properly on the building due to that. There stood our conflict. He wanted the awnings made over because he said they were a "crap" job, when in reality that was not the case. He would not let anyone correct the bracket placement and we were not remaking awnings that were done correctly the first time. In the beginning we were told by Mr. [redacted] that we were to go through his contractor, [redacted], for any billing. Multiple months and invoices sent to Mr. [redacted] were not returned with any positive or negative feedback. That is when I decided to send Mr. [redacted] an invoice as the job was not paid for. We normally require a 50% deposit on all jobs to begin, which Mr. [redacted] refused to pay. Being a long standing customer, we did let that slide. Currently we have no payment for the awnings. We were rudely told to pick the two awnings up and basically "stick-it." We would like nothing more than to conclude this situation with some form of compromise, but I honestly do not see that happening. Thank you,[redacted]VP/Office ManagerGreen Mountain Awning

Regards,
[redacted]I have read the reply from the business Green Mountain Awning and there are statements that need to be reviewed.1. Yes, new siding was installed on the house and yes, the top brackets only were removed and reinstalled by the contractor and are level and square with the window.  When I stated that the brackets were not moved, I was talking about the hinged brackets to the employee who was here, because he saw holes in the trim from an old awning installation and he thought that they were from this work on the house. This was done to install new aluminum trim at the top of the window.2. There were two awnings replaced, one of which is covered by insurance, the other was in question, because there were two insurance claims for two separate storms causing hail damage within 3 weeks of each other. Each awning was damaged in separates storms.  There were two claims to the insurance company of which I have the claim forms.  So GMA, in which my contractor received the awnings from, are wrong in their statement that both awnings were worn.  Not true.  One awning had a hole through the center which was caused by hail piercing it, the other was thrashed around by the wind and ripped it along the supporting bar. 3. My contractor has contacted GMA by email (see attached "[redacted] to GMA") stating that he would meet with them at my home if necessary to go over the repair, but did not receive a response from the company.4. Green Mountain Awning has never contacted me after the awnings were first installed,  I asked the employees of GMA to have the owner come and look at them.  If he did, he never let me know he came and made no attempt to contact me to discuss his findings.5. I was never asked for a 50% deposit so I never denied giving them one as stated in GMA's reply.  That is a down right lie.  I have purchased awnings over the years  from this company without any deposit and have always been treated well by the former owner(father of owner now) with any problems that might arise.  I have had to have some awnings resewed before because they weren't sewed correctly by this company without any problem.  In fact, I mentioned that to the owner now, when he was here to pick up the awnings and he stated he knew why because of the employee who did the work on them.6. I never rudely told them to pick up the two awnings as I stated I wanted them fixed to be square with the window, if they can't do that then yes, they can keep them and leave the frames with me.  7. As far as I know, there was only one invoice sent to the contractor on 7/7/15 not multiple invoices as stated in GMA's reply.  And that is why they sent an invoice to me with a finance charge, still unethical business practice.  I have emails to show that my contractor was going contact the owner of GMA and hopefully get it resolved back in July.  According to GMA, this was never done.As I have stated, this could have been avoided if the owner actually contacted me, schedule a time to meet, discussed the problem and remedied the situation.  This can still be done, but I am not going to pay any finance charge, since the billing was sent to my contractor and not me.They should contact my contractor and me and schedule a time to meet at my home and go over the problem.  Hopefully we can come to a compromise.  GMA states they do not believe this will happen.  Try communicating with your client!
