I am rejecting this response because:I have proof of watering and the third party witnesses to vouch for it ("instead of my employees") My water bill attests for itThe home inspector has reported in his report that the ground was not properly graded which caused the grass to die and it was shared with Green Sun But, Green Sun choose to ignore it The *** supervisor *** (the name quoted by James of Green Sun) has written and signed that the grading was Green Sun's problem I believe *** is right since Green Sun was the last to touch the lawn and didn't say anything about the grading being not proper If it was properly graded and levelled the water wouldn't have sit there Three contractors can't be wrong about the "sub standard" work done by Green Sun They didn't even know who did it and have no ulteriro motive to state that I hired Green Sun to provide me expert advise and do a job like an expert does Misrepresentation of fact and blaming the principal is not a good business paracticeThe fact remains that Green Sun did a substandard work and put sod that was not fresh and didn't do the right things that would have made my lawn survive

*** *** ***, Falls Church, Fairfax County, VA for $7,842.78, *** *** *** is a residential tear-down property, which the *** renovated with a new house and are currently trying to flipAs the contract and property records indicate, the *** live in Jacksonville, Florida and the newly developed property is currently on the marketWhile Green Sun contracted directly with the ***, there was a general contractor on the project that built the new homeThe name of the contractor is *** *** ***.Green Sun, Incperformed the work on the same date the contract was signed and processed the credit card for the full amount of $7,842.78.Ultimately, the *** did not water the newly installed sod and it diedThe watering instructions are listed in the contractSpecifically, the contract states: -Water new plants enough to keep soil moist to the touch, NOT MUDDY, over next 6-months, especially during dry periodsMonitor soil moisture by moving mulch back and inserting a finger as deep as possibleIf the soil adheres to your finger the moisture content is good, but if it flakes and crumbles, it is too dryIf you see water, the soil is too wet and you will need to stop watering until it is no longer visible.Further, the live plant warranty expressly disclaims any responsibility for an owner’s failure to water the sodSpecifically the contract states that “this policy does not cover damage beyond our control, such as, but not limited to: over or under watering....”I personally reminded *** *** verbally several times throughout the day that she was responsible for the wateringMy job site manager, Brian L***, also explained to her the importance of watering as well as some helpful hints regarding which size of hose and types of Sprinklers to purchaseInstead of listening to our advice, she told us that she was not comfortable with her knowledge of the streets in that area (as she lives in Jacksonville) and wanted to wait until the next day to go to the *** *** in Ashburn, Virginia as it was close to her daughter’s houseUltimately she asked to borrow a hose from us to hand water some of the sodI gave her a hose and explained to her that walking around trying to hand water nearly a third of an acre of sod was not going to be sufficient,Attached is an email string that show *** *** admitting that they were having watering problems far past hours from the time of installationThe builder, *** *** ***., can also confirm that the *** had not watered the sod by the following day when *** ***'s *** *** was on site, An email was sent to *** *** from *** ***s’ *** *** relaying the information from ***, at 4:55pm and *** *** responded at 9:45pm that evening stating that they were aware of “it” referring to the email from *** *** stating that “...it doesn’t look iike your sprinkler is watering the sod very well...”Through further investigation, I found that another employee of *** *** ***., *** ***, noticed that the *** were trying to run several sprinklers one time, thus resulting in insufficient water pressure for all of the stations as opposed to watering only a few at the same timeThis prompted a site visit by *** to investigate what was perceived to be a water pressure issueAs a result, the lawn was starved for water yet another day or so until they figured out that it was the Padhi's lack of common sense knowledge regarding water pressure.I have attached a picture of sod that was left over from the *** job that was installed at my employee’s (Brian Leach) home the next dayThis sod remained rolled up and was transported and installed the next dayHe watered it immediately upon installation and has had a nearly 100% survival rateThe key is the initial wateringThe *** did not get the initial watering done properly or in timeGreen Sun, Inc., not only fulfilled its contractual obligations, I went so far as to remind the customer several times, as well as give advice about which types of hoses, etcto purchaseGreen Sun is legally due the payment as per the written contract.Allegations that Green Sun did not perform are unfounded, undocumented, and patently false*** *** claims specifically that I did not level the lawnMy contract clearly states the “...Final grade to be completed by builder...” which it was and it passed inspection prior to the sod installationShe also claims that I did not put down lime and fertilizer, On the contrary, I did and can provide an affidavit from the employed that performed the work, as well as eye witness accounts from all of my employees who were on site that day, including myselfLastly, she claims that I did not water the lawn or give instructions regarding how to water itAgain, both the instructions and the fact that it is the customer's responsibility are listed in the warranty.Furthermore, the watering issue was addressed in more detail in the preceding paragraphs of this letterI personally found *** ***’s behavior troublingAs an act of kindness on my part, I agreed to *** ***’s verbal request on the day of the installation, at no extra charge, to remove additional weeds along one side of the property that consisted of vines which had grown into a chain link fence; this was very tedious hand workAs the day progressed, I found out that she had directed my employees to continue the same wine removal from the fence along the back side of the property without my consentI did not charge her anything extra for this, Lastly, during the werbal negotiations prior the contract being drawn up, *** *** attempted, on several occasions, to negotiate the price down by stating that they would have us back to install a patio and future landscaping once they moved in the houseHowever, as of last week I noticed that the house is for sale, So I believe that negotiating tactic was misleading all along and simply a method for her to maximize profit on a home that she always intended to flip.*** *** gratuitously claims that other contractors were surprised at the shoddy work we didWell, I can equally say that there was a contractor who drove by the site twice on the day on the installation and on his way home that day he stopped to tell me what a great job we had doneHe also stopped another day when I was out to check on the lack of water damage and told me specifically that he drives by this house every day and that this customer did not water the lawn and that this was not Green Sun’s faultUnfortunately, I do not know who he is, but I thought you should know this.I also have a video of the job site that I took on Friday August 28, I have NOT included it in this package, but can upload it to site of your choice, Please let me know.Green Sun, Incis a small business with only employeesA charge back such as this, nearly $8,is devastating to us, I have had to transfer money from my savings to cover this and may have to borrow additional money if this is not resolved in my favor soonUnfortunately, this situation is going to force me to change the way I accept or if I ever accept credit cards in the futureIt seems completely unfair and slanted against the businessIt is theftI will also remind the *** that the contract I am rejecting this response because:
I have proof of watering and the third party witnesses to vouch for it ("instead of my employees").  My water bill attests for it. The home inspector has reported in his report that the ground was not properly graded which caused the grass to die and it was shared with Green Sun.  But, Green Sun choose to ignore it.  The [redacted] supervisor [redacted] (the name quoted by James of Green Sun) has written and signed that the grading was Green Sun's problem.  I believe [redacted] is right since Green Sun was the last to touch the lawn and didn't say anything about the grading being not proper.  If it was properly graded and levelled the water wouldn't have sit there.  Three contractors can't be wrong about the "sub standard" work done by Green Sun.  They didn't even know who did it and have no ulteriro motive to state that.  I hired Green Sun to provide me expert advise and do a job like an expert does.  Misrepresentation of fact and blaming the principal is not a good business paractice. The fact remains that Green Sun did a substandard work and put sod that was not fresh and didn't do the right things that would have made my lawn survive.
