Revdex.com: I have reviewed the response made by the business in reference to complaint ID [redacted] , and have determined that this does not resolve my complaint For your reference, details of the offer I reviewed appear below.The business agrees that: We entered a purchase agreement for the home We had an inspection contingency in the contract Our inspection identified numerous defects We notified sellers of defects, the sellers refused to cure The contract was cancelled.What the business is not stating is that before we entered the contract to purchase the home another party had performed an inspection of the home and found defects The defects were known to the seller and the business but not included in the Property Condition Report The seller told us this face to face Based on the seller's admission, the business violated law and ethics to avoid disclosure of defects that may deter interest from potential buyers Had we been provided an accurate Property Condition Report we would have known about the defects and not spent our money on an inspection, ordered an appraisal, start the loan process and taken time off of work to travel to all of these appointments.Based on the amount of time that this home has spent on the market since built and the numerous large price reductions it has obviously been a struggle to sell, but taking advantage of consumers is unethical and illegal The business should apologize for not accurately, and legally, representing the property and reimburse me my expenses I would never have entered into a contract, hired an inspection, appraised or borrowed to buy this home had the Property Condition Report been properly and ethically represented As I stated in my original complaint, months after my inspection report notified the seller's and the business yet again of serious defects to the property, the Property Condition Report the business represents the home with bears signatures swearing that no defects exist.There are strong consumer protection laws and if the business will not reimburse me possibly the best course of action is to bring this to the attention of law enforcement to interview all parties - myself, sellers, the business and all of the other potential buyers that may add insight to how the home was represented Regards, [redacted] ***

The seller's email was entered into the system incorrectly by our office admin When we received the complaint from the Revdex.com on Friday 1-6-we immediately saw the error and changed the email The agent had been notified prior from the complainant, however he was concerned that it was some kind of scam and didn't go further with it In the future the agent will bring such concerns to his manager We apologize for any inconvenience this has caused the complainant and our client -- Lyle EA [redacted] Office Manager BurlingtonShorewest Realtors [redacted]

Office Managers response Hi ***, I spoke with [redacted] This buyer bumped a primary offer, after he was made primary an inspection was done Attached is the inspection report, CMAR and Notice of defects There was not a lot of equity to work with, seller was unwilling to reduce price and buyer's agent indicated they no longer wanted the property The buyer that had been bumped is back to being primary and the property is now a Short Sale.There was no knowledge of the defects and seller took issue with the notice but signed the cancellation to move onThanks ***

I told Mrs***, after the closing we,Shorewest, are no longer involvedIt is amatter between the seller and buyer.We cannot make the buyer give her thecurtains back

There are many fabrications and untruths in this statementIt appears, because I am a common home seller and have no power with this dishonest business transaction, I will have no honesty or integrity in resolving this issueIf there is a way to denote that I do not accept their accounts, I would like that knownI do not know what else to do. For complaint ID *** for *** *** *** MLS #Buyer *** *** had an accepted offer with a home sale contingency it was contingent on his home at *** *** *** selling/closing by 5/2/he did have a hour bump clause with first right of refusal…my office has a log book with
all offers written/accepted I put this home in the book with it to stay active in MLS and continue to show…MLS rules are you have to put active with offer or pending in the MLS with homes that have accepted offers except those with a home sale contingency Our office girl put in MLS as active with offer she was new and still being trained I caught it right away and had her put back to active *** *** signed an offer to purchase that states on lines 28-Seller may keep the property on the market and accept secondary offers after binding acceptance of this Offer. I spoke to his agent today *** *** from Help-U-Sell *** *** Realty that told me Mr*** didn’t want anyone else to be able to go through the house after his accepted offer. Update: I've received 9 more emails from this business since January 2nd.
