every call and letter where their concerns were handled in a professional and amicable manner.
Further, the tenant in question moved out in breach of covenant, thereby breaking their lease without lawful reason, leaving the property in disrepair.
California Civil Code 1950.5(b)(1)-(4) states that the landlord may deduct from a tenant's security deposit for (1) Default on payment of rent, (2) repair damages on premises exclusive of ordinary wear and tear, (3) cleaning of premises and (4) To remedy future defaults by the tenant in any obligation under the rental agreement to restore, replace, or return personal property or appurtenances.
Greenmark Property Management has determined that it is entitled to retain the deposit up to the full amount for rent damages and repair needs in accordance with state law.
All these communications have been explained to the tenant upon move-out whereby no pre-moveout inspection was requested by tenant.
Greenmark Property Management, Inc maintains that it has acted reasonably and responsibly within the parameters of signed covenants by tenant and state laws.

There response is well worded but wrong. I have records I'm my possession of maintenance requests that went unanswered and even signed off that were never completed as well as some that were requested more than once. This brings me to why we vacated. I put in for pest service twice with no answer and it getting signed off as complete. There were signs of pests during initial walk through that were recorded. Also the faulty and illegal electrical that ran from the main to the garage, along with inadequate plumping repairs by their employees is the reasons valid under CA state law to break a lease without penalty. Further more fed up with the lack of response we decided to vacate and when doing so went to put in our 30 day notice at their office location only to find that they were packing the office up and we're no longer going to have a location by which to do business, also illegal under CA state law. I was told to mail my notice to a PO Box. These red flags prompted me to not pay the next month's rent for fear of being scammed, at which point I tried to contact management to relay we would be out sooner than the 30 days. We didn't receive any word from them until that 3day pay or quit notice arrived and which their employee stated that even he had difficulty getting through and gave me the number of one of their on site managers to discuss the matter. Once in contact with her I explained that I would be out the 14th of august, the reasons for the vacate and that I needed that months rent prorated and takin from the initial deposit. She said she would talk with management and get back to me. After multiple attempt to contact management by phone and email I then did not hear back from anyone until Sept at which point the on site Manger was asking about the keys and when we planned to return the property. I informed her that we vacated the 14th of the month prior, she then said we were responsible up till the return of the property. I reminded her that she was supposed to contact me back about arrangements of the rent being prorated and takin out the deposit. Once I stated that they could go ahead and evict me and that I would take it al to court she seemed to recall the conversation. She said she would have to comfirm with management and get back to me. Once she called me back she stated that the deposit would be returned minus prorated rent and any other fees, prior to moving out my wife and I painted, cleaned and had been sure to patch nail and screw holes as to help in recovery of the deposit, I will admit that some garbage was left behind on accident but it all was bagged up and in tight order. I agreed and we met at the property to do a finale walk through in which she recalled some of the issues from the initial walk through. At this point, reluctantly, I returned to her the keys. I know now I should have had them take me to court where I could have fought my case and as being myself a previous property Manger and informed of CA laws governing that I would have won. After giving the keys over the on site manager began to have excuses and told me it wasn't her position to say anything, and to stop calling her. I proceeded to call main management where the first time I called was forwarded by the office assistant before I could say a single word. Several days and phone calls and messages later I still couldn't get ahold of anyone. After sending and email stating I would find their new office location and be by in the morning I promptly recieved a call from them stating they had no forwarding address, so I gave them one and received in the mail a BILL for over 5000.00. Everything in their response is a nicely worded fabrication of the events to help make them look like the ones that are right, wrong. I kept maticulous records of all my phone calls, emails, work requests, maintenance work I preformed on the property outside when is expected of a tenet due to their lack of response, I have photographs proving the condition of the property upon return, receipts for materials purchased. Names of all parties involved and addresses. They are in no way professional, they are slum lords and I have also put in complaints with the CA department of consumer affairs, department of real estate, ect. Any further inquiry you can contact me. I have personally seem other complaints made against them in which their response made it sound to be the other parties fault when it wasnt.
