My deposit on the property I rented from this company was wrongfully used. I was charged for printer ink and 11.5 hour of research + typing. My deposit, according to the lease, was for cleaning and reconditioning activities done to unit with dollar amounts. In section 23 of the lease it is stated I could possibly be charged with 2 months of rent for early move out fees. No where in this lease does it say that my deposit would be held, it specifically states I would be charged separately IF these fees were chargeable. In this case I gave a 2 months notice, found new tenants for the home, showed the house myself and left it in better condition from when I moved in. There was no ground in either parts of the lease to charge me so it was taken from my deposit. In the last year, 2 other tenants have left the property but have not been charged.

Work had just begun work on a complete remodel of the unit when Tenant expressed that she wanted the unit but had nowhere to stay in the interim between her current lease ending and when we would have the unit finished. To accommodate Tenant, we had the remodel up to habitability standards by the time her current lease was up, moved her in at a discounted weekly rate, and paid for the utilities. When the remodel was finished Tenant signed a year lease. Four months later Tenant requested to be let out of her lease six months early. The request was declined but though it was not in our lease at the time we agreed to an assignment with the understanding that finding a tenant, showing the unit, and cleaning was Tenant’s responsibility. About seven weeks later Tenant was called because a potential tenant was found for her. She stated she was moving out that weekend. Tenant never gave written notice that she was moving which is a requirement of Section 23. Tenant had to be reminded several times that cleaning, finding a tenant, and the removal of her trash from the outside of the property was her responsibility. In an effort to assist Tenant with her lease assignment, showings, background checks, verifications of income, and preparation of the assignment was done by GreenSky Rentals. In all about 17 hours of work was done for the assignment but many of those hours were not charged for as a courtesy, which was expressed to Tenant in the invoice. Yes, Tenant was charged for the printing of the documents that were needed for her assignment, as they were her expenses.

Section 23 Early Move-Out, of our Lease states that the two months’ rent that would be charged if Tenant gives appropriate notice. That the money would be used for “Landlord’s potential expenses in finding and processing a replacement. These expenses can include but are not exclusive to paperwork, office overhead, advertising, locator source, broker fees, unit-showing, and utility expenses for showing the unit,” as expenses of an early move-out. Tenant was not charged two months’ rent and was only charged for a portion of the work done on her assignment.

Two other tenants have moved from the property. One had a month to month lease and efforts to collect from the second tenant have been made but have been temporarily put on hold due to the National Health Crisis.

GreenSky Rentals takes great pleasure in advocating our tenant’s happiness and prosperity and tries to support that in providing comfortable homes and personal service. Because we are a small business, we feel this gives us the fixability to provide a more individual rental experience for our tenants when we are able to. It saddens us that the Tenant does not feel like we went above and beyond for her.

We do feel it was appropriate to charge for a portion of the work we did for her assignment, the expenses in printing her documents for the assignment, and that this was clearly expressed in her lease.
