From: jake c*** Sent: Friday, April 21, 6:AMSubject: GreenTuitive Construction Response to ComplaintTo start I would would like to say that on December 1, we started our agreement together for me to repair crumbled edge of a concrete porch for $350.00, with no money upfront for
materialsMy client had high expectations of the porch being completed by Christmas, I was trying to meet her expectations, although during this time of the year the weather was being as it usually is cold but this time we could get snow, so I held off from doing porch until December 13, On this date I repaired the concrete porch and covered it from the weatherThe repair was almost complete just needed a skim coat over the top to blend the exsisting to the newAfter this the porch couldn't be skim coated due servere weather and snow, so I left it coveredFinally on December 22, I was able to skim coat the concrete patch due to weatherAt this time I left covered to protect from the weatherPorch complete other than a final sand and paintAt this time, I was the furthest I could go due to weatherOn January 4th, I completed the smooth sanding and uncovered the porch. I returned on January 5, to talk to my clients husband to do repairs on a carport shed because it was leakingI agreed to due the repair and use process of elimination to find the leakMy first thought was the screws because washers do go badThat was where I should startWe did paperwork and agreed to $to replace the screws, materials where included in this bidMy client decided to pay me for the porch and the carpot roof at the same timeBecause of it being a check, my company policy is to only cash checks at clients banks to avoid problems with my bank, so we agreed and I went straight to the bankCashing the first check to reimburse myself for the materials I put out on the porchCashing the second check to keep the money with the jobs it was aquired from for the materials needed to complete the carport shed roof.On January 11, 2017, I went to my clients house to replace the screws as per our agreement, which I purchased from the 2nd checkUpon climbing onto the roof I relized that pieces of roofing interlocked and screwed within each other with no screws penitrating the roofBut I did notice that on the ridge cap where the building conjoins was cracked and bent upSo I went to the hardware store and bought a new ridge cap piece and black jack tarI installed the ridge cap, tarred around the edges screwed into placeI then noticed there was a broken gutter piece on the side that it leaks, so I thought to replace that, mind you this building is a kit so I had to find it online and wait for it to be shipped to me then install. On January 31, the gutter part arrivedOn Febuary 1, I went to replace the piece to find out that the piece I got was shaped slightly different so it wouldnt fitI traced the design of the gutter to have it with me so this wouldnt happen againSo I began to searh for the right partOn Febuary 3, 2017, my client told me the shed was still leaking so I went over and put a piece of flashing up to hopefully divert the water from going into that section of the gutterOn Febuary 9, I recieved a text saying "Rain still coming into shed"I told my client I have options, option #wait for the gutter piece that I found and install once I got it or option#to fix the issue nowI could remove and then replace the foam paneling and find the leak that way so I could do an immediate repair at no additional charge even though by this time I have done way more work then the contract statedAnd explained how the screws weren't pentrating the roofOn Febuary 10th they declined me removing to fix immediatelyWe also discussed the painting of the deck could only be done when the weather was nice for days above degrees so that the paint would adhere correctly. On Febuary 20, 2017, my client contacted me about a new job of flashing because of rain coming into the master bathI told her I could do thisCome the next day I was running behind and let my client know that I would be there around 2pm and told her I was still waiting on gutter partIt was at this point that my client got upsetI decided that I would deny doing anymore work for her after all that I have doneBut still complete the projects at hand.Due to being frustrated, I blurted out that I would just refund her moneyOn March 8th, they requested a refundOn March 13, I sent a check out to them and left town to do work in Florence, OR They replied with no check yet, we will be filing a complaint with the CCBI told them I wasn't sure why they didn't recieve the check but I should be intown by March 21, They gave me until noon to be thereI couldn't make it there by then and knew what they where going to doSo I stated Lets let the CCB decideLater to relize the letter was returned to my address while I was outta town.In conclusion, after doing all the work that was done and still waiting for the weather to warm up and be more consistantI looked back at our contract and realized I did do my jobI replaced the screws and ridge cap as per our contractAnd started thinking back to how she "gloated" about her actions towards other contractors in the pastAnd feel that I should tell my side of the story so we can resolve this issueNeeding a 3rd party wasn't how I wanted it to go but sometimes it is necessaryI do relize I stated I would give my client a refund, BUT after looking over the amount of materials I have purchased and the work in which I have doneI don't feel I owe anything in returnI gave options to fix the problems, I looked dilegently for the parts that weren't in my contract to assist in repairing the shed roofShe also stated that I was a thief and slandering me online with reviews of how I am a thief and stole from her and how I needed the money badly and that was why I cashed the checks immediately, in my defense I wanted to be paid for what I have done so far and have the material money for the shed roof projectI don't see how I am a thief with everything I have done thus farAnd I communicated the issues and problems that arose with possible solutionsI believe I did my job to the best of my ability with the situations at hand and the conditions of the weatherI never stated I wouldn't do the work. From: [redacted]  Sent: Sunday, May 14, 2017 11:47 AM Subject: Complaint #[redacted]This email is a follow-up to my complaint against Jakob C[redacted], Contractor, Greentuitive Construction.I have left a voice mail at your office on Friday, May 12, 2017 to notify that The CCB found in my favor and compelled Mr. C[redacted] to refund $200.00 for contracted work on my home that was never completed. For some reason, the Revdex.com's messages to my email went into spam and I did not discover them until I did a search for everything related to this complaint in my email folders.I would like to finalize this complaint so that consumers are aware that Mr. C[redacted] was found at fault by the Oregon Construction Board, and deservedly so.  My case had strong merit. The Enforcement Officer, Nick, stated to me that due to Mr. C[redacted]'s evasion even with his agency that he advised Mr. C[redacted] that, and I quote, " if he did not bring a cashier's check to us immediately, that things would not go well for him". Apparently that was the only thing that worked with this contractor; the threat of license suspension and further penalties.  I doubt Mr. C[redacted] will be in business very much longer, as I cannot be the only consumer that has experienced his deceitful and/or fraudulent business ethics. Please advise as to how I can close the loop properly with the Revdex.com on this matter. Thank you,[redacted]
