Review: I spoke with [redacted] on the phone regarding the purchase of one of his new Hybrid Batteries and he informed in the conversation that he was offering a special in the month of April for a 3 year, which was normally only a two year, unlimited miles warranty on the purchase of a new hybrid battery. The purchase was made on April **, 2013 in the amount of 2505.00 There was a delay in receiving the batter so I contacted the vendor [redacted] to inquire about the warranty and he informed me that it would arrive with the battery. The battery arrived the week of May the ** 2013 and I picked up the battery on Thursday ** of May . I attempted to install the batter with my friend [redacted] on Sunday the [redacted] and in the process of removing the old battery there was no Warranty in the new battery. I called the vendor and was not able to get in contact with [redacted]. I waited over two hours and called again and was not able to get in contact with the vendor so rather than install the new battery under no warranty I contacted the vendor and returned the vendor his new battery uninstalled and unused due to no warranty since he did not fulfill his end of the agreement. I filed a dispute on the with my credit card company was informed on July [redacted] that vendor has not returning me a credit due . The vendor has his Battery returned as the tracking number Via Fedex [redacted] indicated it was returned on 5/**/13 at 2:14 pm to Stanton Island as on the return label indicated. I am in the process of redisputing the charges and will not stop this dispute until the vendor refunds me the amount of 2505.00 as I do not have the product. Its the responsibility of the merchant to fulfill what he offered at the time of purchase and since no warranty was present and he has his product unused returned I request a full refund. I am in the process starting a legal dispute and will not stop until this is resolved.Desired Settlement: I find it inappropriate that something as important as a warranty on such an expensive piece of equipment no be present and would think that no one would install something as expensive an item without it. I request a refund be issued. The vendor has his product returned unused.

Response:
My name is [redacted]r, and I am writing to you to dispute the complaint put forth by [redacted]. Here are the facts of the transaction.
• This client purchased the battery and I shipped it to him as I do for all of my clients.
• It was signed for and delivered to him directly. We met all of our obligations.
• The client disputed the transaction as not being as advertised. The battery was shipped with all paperwork and fully assembled as is fully described.
• The paperwork was also e-mailed to him directly.
• The battery was returned used and broken - as per my warranty and return policy (stated clearly on the website and included as an attachment) it has not been accepted. If he decided he just didn’t want the battery I would have accepted back but according to the terms in my return policy which he would cover all shipping costs and a restocking fee.
• The battery is clearly used and I feel the client is fraudulently claiming he didn’t receive his battery. I have all supporting documents.
• The credit card company has denied his claim and even his re-dispute was turned down.
• I have two documents that show two different stories from the client. In the e-mail to me a few weeks ago he states he sent the battery back to me in May. In the credit card dispute document he states to visa that he is willing to send back the merchandise if I send him back a pre paid label. The date on the form is in July months after he stated he sent it back to me. He states he sent it back in one and then in the other he states he will send it back if I pay for it.
I have met all of the obligations to this client to the point that the cc companies have honored my charge and dismissed his complaint. I do not want this impacting my company as this is a frivolous complaint. I can send over the atachments and pictures if you would like.

Response:
I have reviewed the response made by the business in reference to complaint ID# [redacted], and have determined that my complaint has NOT been resolved because:
[Your Answer Here]
The dates I
stated initially were incorrect, I acknowledge this error on my part.
All this is documented through the credit card company in the
following.
The date of purchase was April [redacted]
2013.
Attempted installation was on May [redacted]
There was no paper work of any type
that came with the battery with regards to a warranty
ONLY after I sent him his battery back
did I get any type of paper work indicated the battery was covered
under warranty, I have proof of the date it was sent. I have proof
it was returned.
WHY wasn't the warrenty sent on April [redacted] via email at the time of purchase.
ALL of this would have been avoided had
the paper been sent either E-mail or with the battery.
I have a witness that was present,
[redacted], at the time opening and unpacking who will verify there
was NO paper work present, that the battery was never installed and
therefore cannot be used.
The battery was not used or damaged
when it was returned to FEDEX.
I will be filing another re dispute
with my credit card company.
I have filed a complaint with the
Attorney Generals office of Stanton Island requesting investigation
on this matter and will continue to dispute this issue until it is
resolved to my satisfaction.
The promised warranty and paper was not
provided and therefore I felt uncomfortable attempting to install the
battery. Again I question the integrity and intentions of [redacted]'s for not sending me this paper work at
the time of purchase. I have since purchased another battery
with a different vendor and at the time of purchase all
documents were provided the day of purchase including the
warranty via email.
I request a refund and this issue be dropped.
Sincerely,
In order for the Revdex.com to appropriately process your response, you MUST answer the question above.

Review: I purchased a refurbished hybrid battery for my vehicle from this company. The agreement was that when I returned my old battery to this company, I was to receive a $350 credit for the core battery. They also have agreed to provide me with a computer of the battery since the installation of the battery did not remove the error messages on the vehicle. This has been going on for over 6 months and I have not received the credit that is owed to me nor the computer that was promised.Desired Settlement: I want the company to follow through and pay me the money that was owed and fufill the promises they made.
