I spoke to *** back in June regarding his puppy that was six months old that was growing not as big as he expected it to be I indicated, at this time, that the the dog is still a puppy and had some more growing to do I also said to give it a few more months and contact me again if
the puppy was not growing to his satisfaction *** and I spoke again in August The puppy was now eight months old Larger breed dogs can grow up until months As *** stated, he purchased a mix breed puppyWhen purchasing mixed breed dogs, there are no guarantees on exact size The weights we give at the time of purchase are approximate estimates During this conversation, I attempted to satisfy *** regarding the size issue of the puppy I offered a monetary settlement to try to resolve the situation *** in turn declined my offer and said he was notifying the Revdex.com I feel that my settlement offer was reasonable and that there was no lying or deception at the time of purchase regarding the mixed breed puppy

I spoke to the customer by phone on March 20, 2018 regarding the puppy she purchased.  I was trying to address the issues she stated she was having with the puppy.  Due to the customer’s impairment, an interpreter was assisting us with our call.  After numerous attempts to try to...

talk about the issues, what options are available to the customer under the NYS Sale of Dogs and Cats Notice and what documentation was needed to be sent to me (signed certification form by the veterinarian and copy of medical bill(s), the customer hung up on me.  This left me on the call with only the interpreter.  Nothing could be further explained or resolved by hanging up on the call. Pursuant to Article 35-D of the NYS Sale of Dogs and Cats Notice, the consumer has the right to choose one of the following options: a) The right to return the animal and receive a refund of the purchase price including sales tax and reasonable veterinary costs directly related to the veterinarian’s certification that the animal is unfit for purchase pursuant to this section; or b) The right to return the animal and to receive an exchange animal of the consumer’s choice of equivalent value and reasonable veterinary costs directly related to the veterinarian’s certification that the animal in unfit for purchase pursuant to this section; or c) The right to retain the animal and to receive reimbursement from a pet dealer for veterinary services from a licensed veterinarian of the consumer’s choosing, for the purpose of curing or attempting to cure the animal.  The reasonable value of reimbursable services rendered to cure or attempting to cure the animal shall not exceed the purchase price of the animal.  The value of such services is reasonable if comparable to the value of similar services rendered by other licensed veterinarians in proximity to the treating veterinarian.  Such reimbursement shall not include the costs of initial veterinary examination fees and diagnostic fees not directly related to the veterinarian’s certification that the animal is unfit for purchase pursuant to this section. The law requires that any refund and/or reimbursement required shall be made by a pet dealer no later than 10 business days following receipt of a signed veterinary certificate as herein required.  Such certification shall be presented to the pet dealer not later than three business days following receipt thereof by the consumer. The customer stated she wanted to retain the puppy and requested a refund.  As I tried to state to the customer by phone and through several text messages back and forth, I am still waiting for the signed veterinary certification form and copy of medical bill(s).  A refund cannot just be given without documentation for what veterinary services were rendered.  It is needed as proof for my state records.  All documentation can be faxed to ###-###-####.  Please make sure all copies can be read clearly and shown in full (NOT partially covered up bills that customer previously text to me which are attached to this complaint).  Thank you.

[To assist us in bringing this matter to a close, we would like to know your view on the matter.My problem with this situation is, of you cannot guarantee the differenr breeds then it should have not been advertised as such. The breed in question was supposed to be a german shepard lab mix. The breed you sold me is most certainly not thay mix. German shepard is likely to be involved but most certaily not  gonna grow big enough to be that mix. Its a matter of error on your part. I will not accept the small monetary settlement that was offered. And if you prefer we can further discuss how we can arrange something else.
