To whom this may concern
My name is [redacted] I am the Service Manager at [redacted] Hyundai in Highland Park Il. This is in reguards to Revdex.com case# XXXXXXXX. Mr [redacted] claims this dealership should be held liable for tires on his...

2012 Hyundai Azera.
Mr [redacted] purchased this vehicle from our dealership on 5/2/12 with 10,020 miles. It was sold to him as a pre-owned vehicle. In the middle of April 2014 Mr [redacted] contacted myself via phone saying his tires were too noisy and 7 years old and that we are responsible for the noisy tires. When I attempted to explain that Hyundai does not warranty tires nor does a selling dealership he became aggressive. I tried to explain that it would be best if he brought the car here so we can see what was going on with the tires, he was very adamant on not driving all the way back here as he lives in [redacted] (roughly 25 miles). He then hung up on me. A few days later he contacted the owner of [redacted] Hyundai ([redacted]). Mr [redacted] tried to have him bring the car in so we can inspect the tires to see if there was somekind of goodwill or proration for tires because he had purchased the vehicle from us. That was the last we heard from Mr [redacted] until this past friday (6/20/2014).
On friday I read a forwarded email from Mr[redacted] about Mr [redacted]'s Revdex.com complaint. After reading it I did not recall having anyone call myself about Mr [redacted]'s tire concern. I then contacted a [redacted] a Manager at Michelin's customer service department and was told that he is [redacted]" supervisor. He looked at [redacted]'s notes and found that she did call me on May 8th. I did verify that Hyundai did use Michelin as one of the tires that were offered on that type of vehicle. Nothing was mentioned about Mr [redacted]'s situation. [redacted] did go on to say that Michelin did offer Mr [redacted] a 60% discount on 2 tires and 38% discount on the remaining two tires. He was unaware of him accepting the offer they gave at that point last friday. There was also NO notes in his file stating we changed the tires.
I have had a meeting with my District Parts and Service Manager from Hyundai about this situation. He says that if the customer is looking for payment, or reimbursement he should contact Hyundai Consumer Affairs. The dealership has no liability on tires that are equipped from the factory. Also, we have reviewd our used car inspection form and the tires on the vehicle were in very good shape.
We believe that we offered to attempt to help Mr [redacted] by telling him we wanted to inspect his tires. We believe that Michelin offered a proper proration. If there is anything else I can do, please contact myself or Mr [redacted].

Initial Consumer Rebuttal /* (3000, 10, 2014/07/11) */
(The consumer indicated he/she DID NOT accept the response from the business.)
This is my reply to [redacted](who was probably the person who told me "what do you want me to do about it" - see my original letter). When I purchased the car it was not pre-owned but untitled per Mr. [redacted](I believe he said his son had driven it up the time we bought it). Therefore, the only two entities that could have put on the old tires were the manufacturer(which I doubt), or [redacted] Hyundai (which is more likely).
I was not aggressive with [redacted] but slightly angry about his initial comment. Both he and Mr. [redacted] made a strong point about the fact that I had NOT used them for servicing the vehicle - in other words, had spent more money on them. My point was that it is almost an hour drive there when I have two Hyundai dealership's about 20 minutes away. I did NOT hang up on him but told him to transfer me to Mr. [redacted].
Obviously [redacted] did not read my complaint thoroughly or he would have noticed that I said I was not happy with Mr. [redacted]'s offer of "maybe" a 20% credit if I brought the car in. Does [redacted] really believe the factory put three year old tires on a new car?
I also have no reason to believe that [redacted] (from Michelin) would make up the story about [redacted] admitting they switched tires. Just from talking with both on the phone, I believe [redacted] to be more honest than [redacted]. She has nothing to gain from telling a lie. I can't say the same for [redacted] (isn't against the law to switch tires)? Maybe they should add some new procedures to their "used car inspection form" to check for age of the tires.
The real problem here is that I caught [redacted] doing something they shouldn't be doing. Of course they won't admit it. I just wonder how many other people have they done this to?
I still believe they should reimburse me $622. for the tires. And that amount doesn't cover the number or hours spent and trips made to get this corrected.

This is in regards to [redacted]. We have looked further into this matter and have determined that [redacted] Hyundai is not responsible for Mr [redacted]'s claim. I have been in communication with the tire manufacturer about Mr [redacted] claim of phone calls. The manager there stated to me that Mr [redacted] claim that Michelin had been in contact with myself is half truth.
[redacted] Hyundai stands firm that we are in no way obligated to Mr [redacted] due to the fact that we did not install tires on the vehicle he purchased as a used vehicle. Another contributing factor on this decision is that the vehicle was purchased April X XXXX. Mr [redacted] had no comminucation with us until we heard about the tire concern, almoust a year and a half later. Hyundai Motor America has informed me that this is not a dealership concern. If he would like to contact HMA about this matter, he is more than welcome to at XXX-XXX-XXXX.
Thank you

I have one last comment for Gregory Hyundai. The manufacturer DID NOT install three year old tires on the car when it came down the assembly line. The simple fact is, Greg Mauro's son enjoyed driving the car for a year that dad gave him. Dad probably moved him up to a new car. Gregory had these old tires sitting around and decided that it was time to pawn them off on the person who bought the car - me. They will never admit that they made the switch because it is illegal and they could be in serious trouble. I could pursue this with the Attorney General's office and I probably should. However, I have wasted too much of my valuable already on these crooks, so I will end this now: or will I - stay tuned Gregory for bad things are coming your way!!!

I will never buy from Gregory Hyundai again. I was sold a 2007 Azera with only 40,000 miles on it. Sounds like a good deal right? The previous owner had issues with the O2 sensor and this car was eventually bought back (and supposedly fixed) by Hyundai Corporate. As this car had service issues, I negotiated a 3 year 30,000 mile warranty into the sale. In less than a month, the car has been in the shop twice (once for the O2 sensor!). This time, they will not cover the door handle that wont shut all the way or the window that grinds. Evidently, I did not get the bumper to bumper warranty that I wanted but rather something less. I was lied to about the condition of the car and I was lied to about the warranty. Buyer beware!

According to the Bill of sale and the Finance contract that Ms [redacted] signed it shows she was to give us a $1000.00...

deposit. We do not show ever receiving any money from her. If she can give us a copy of her receipt we will be able to clear up this matter. Thank You

Yes I did sign a Bill of Sale, as well as your finance person. I do not know how else to explain that I left $1000 cash in an envelope on the desk at the time of signing papers. I was never given a receipt for the deposit. I was not aware that a separate receipt was supposed to be given to me for cash deposit. I was in your dealership for a while after signing paperwork, to transfer to the new car. If I did not made a payment why didn't you stop me then and verify again?
Final Business Response /* (4000, 9, 2014/07/16) */
We have carefully reviewed the cash receipts of the dealership, including days prior and after the date of sale. Our investigation with the employees handling this transaction has signed an affidavit that no "cash" exchanged hands in this transaction. Our position is that Ms. [redacted] owes the $1000.00 which was not collected at time of delivery. Should Ms. [redacted] find a separate cash receipt (which is issued for all transactions, cash or check) or should she be able to provide proof she whithdrew $1000.00 from her bank on the day of delivery, we will be happy to further audit our records. It is our position that Ms. [redacted] owes the $1000.00 and we will take necessary action to collect until such time as Ms.[redacted] provides proof of payment.[redacted], President
