I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below.
The proposal states if APS finds something in the sub base or ground that is causing the issue, I must pay to fix it. However, if nothing is found, there is nothing offered by the business in return for the inconvenience of digging up the driveway again, looking for water, and then patching the driveway. I have spoken to the owner about this proposal and when completed, I will now have a new driveway with two hard seams that over time will present other issues. It is clear that the business owner and I will not be able to agree on a resolution. He states the driveway is good and that "they happen to be in the wrong place at the wrong time" when it comes to the issue in the complaint. Also, "it isn't happening" when it comes to getting money back. When you invest $4K in a new driveway you expect it to perform in any weather condition, not have any visible seams, and last for 4-6 years. There is no confidence in this driveway will meet these expectations. We would like to have a 3rd party involved via ArbiClaim to help resolve this dispute before any more work is performed. Please let us know if you initiate that process or do I. It also maybe time to speak to the local news media per your option on the complaint to let other Delaware Consumers know what they may run into when dealing with this business. Mr. [redacted], We are sorry to see that there is frustration and un-satisfaction of your driveway. While Mother Nature is a huge dictator in our business we were unable to complete the paving portion of your driveway immediately after the removal of the old asphalt due to the continuous rain. This...

is all for the structure of your current sub-base. Once a driveway is exposed and the remaining exposed sub-base is rolled, we must make sure the is completely dry before laying new asphalt down. Once we had this completely dry we came back to install the new asphalt driveway. We are aware there was a delay in the asphalt delivery which caused the bump in which you referred to. As soon as this was brought to our attention we were able to send men out again to heat up that asphalt and tamper down that bump, making it all one elevation. At this point everyone was satisfied and payment was released. Again you had come to APS with concerns of water you were seeing. After the owner had met with you on site again looking into this issue, it was our concern that this could indeed be something larger then it appeared. We explained to you that we may need to dig up the portion of the driveway to expose the root of this problem. We are happy to honor our one year material and workmanship warranty if and when it is ever called for. However, as we explained this may be beyond that. We are possibly looking that a root below ground could be pushing moister and water up through your sub-base or something to this nature. Unfortunately, as all renovations go once something is opened up after many years problems that were unseen prior can now be exposed. However, our goal is to always make sure our customers are satisfied and we come up with a solution to fit your needs. As proposed to you, we would like to dig up this area to see what exactly is going. If we exposed that there was a material and/or workmanship error we will gladly fix this at no charge to you. On the other hand, if there is an issued that is beyond that we will work with you to come up with a solution and provide you with a proposal to fix this issue. We hope that we an come to a solution and make you part of our many satisfied customers.

We provided Mr. [redacted] with a solution to help resolve his concerns. We have gone out to the property to try and explain that with the area he is expressing concern for, the problem would more likely be from an object or issue coming up from under the sub base. The scope of work that was completed by Advanced Paving Services/Stripe-A-Lot, Inc. did not involve the original sub base. The idea that the water that is protruding in this specific area is from a bad mix of asphalt is not likely as you would see this in more then one space of the driveway. We are happy to dig up this specific area to see what exactly is going on. If it were to be found that the asphalt was bad for whatever reason we are prepared to  patch this area and complete an overlay of the driveway which would provide Mr. [redacted] a new seamless driveway. However, if the issue is to be found from another cause outside of our scope of work we would not be able to be liable and would need to be financially compensated for any repair or future work.  We are confident that we have completed the work per the scope of work agreed upon and would honor any warranty that would be proven to be needed. If Mr. [redacted] would like to work this out with us we are happy to do what we can to satisfy our customer.
