Complaint: [redacted] I am rejecting this response because:We suspected wind damage so we reached out to our insurance company to file a claimUpon inspection, our insurance company concluded the missing/loose shingles were not a result of wind damage but a result of faulty installationThe pictures I previously submitted clearly show "over nailing," in a particular section of the roof near the back of the houseOn their advice, we reached out to Rialto with the insurance company's findings in hopes of a suitable resolutionWe received no response backIt was then that we decided to file a complaint with the Revdex.com because Rialto clearly has no desire to correct their mistakeThe roofing company we used came to the same conclusionThey advised that a five year-old roof should not have so many missing shinglesUpon inspection, they also concluded that the damage was caused by faulty installation.My wife and I have owned houses in Amarillo, San Angelo and San AntonioWe've never had as many issues as we've had with our Rialto home and the price we paid ($430,000) is more than all three of our previous homes combinedYour company has serious quality issuesI'm asking again for reimbursement of $995.99, which is a drop in the bucket compared to the repairs to our "dream home," we've made on our own Regards, [redacted] ***

I am rejecting this response because:As you can see in the attachment provided by my insurance company, the damage was caused by the roofers incorrectly installing the shingles (over nailing) in one portion of the roof (photos 88-91)This damage was not caused as a result from wind, but rather as a result of faulty installation, which ultimately, you as the General Contractor, are responsible forI will appreciate reimbursement in the amount of $and will consider the matter closedIf not, I will contact an attorney to proceed with a lawsuit for reimbursementAs you pursue a reputation as a legitimate builder in San Antonio, you need to fix thisMy insurance company and the roofer I contracted to complete the repairs both advised that this is not something that should be happening to a five year old roofThis is the result of faulty installation

We are in receipt of your letter dated 8/22/16, in connection with a complain made against Rialto Homes (claim ID ***).Rialto is not aware of any presently open warranty claims associated with Mr***'s residence Mr*** purchased a home from Rialto in January Since
purchasing the property, Mr*** has filed claims with the company - all warrantable claims have been corrected and previously accepted by Mr*** The most recent repairs were completed during March of 2015, with a related subsequent exterior paint touperformed in November/December It is important to note that Mr*** signed a full release in connection with last year's repairs, which would, among other conditions, forever discharge any related claims.Mr*** did submit a non-warrantable claim during May of this year, asserting that roof shingles had blown off during some recent storms, which led to one or more roof leaks While roof coverings are addressed within the limited new home warranty, the respective warranty period is expressly limited to year Moreover, it would not protect against natural events such as storms Mr*** was advised that the company does not warrant weather related damages and that the roof coverings on his home are well outside of the warranty period Traditionally, coverage for these types of claims would fall under a homeowner's insurance policy.A detailed overview of the new home warranty is presented to each prospective owner, with the same provided as a supplement to each of our purchase agreements.As is common in new construction, repair items do surface during the first years Rialto works diligently to correct warrantable issues We are presently working with other owners in the community, privately addressing their claims.If there is a claim to be presented by Mr*** specific to his property, we would certainly welcome and appreciate the opportunity to review.Please trust that we handle all claims in a serious manner Should you have any questions or if further discussion would be helpful, please don't hesitate to contact me I can be reached at *** (office) or *** (mobile).Respectfully,*** ***Rialto Homes

I am rejecting this response because:They are correct . I don't have an open request because [redacted] rejected it on an email. (I can send you aa copy) As of yesterday I have spent $1000 dollars fixing a paint problem that Rialto fixed last year. When I asked them to please come and fix they said no. My roof shingles blow off. [redacted] tells me no . They did fix my neighbors though that moved in before me? I can go to a different section of the site if so directed by the Revdex.com. I have several hundred pictures I would like to post just to make sure that everyone is aware that these guys are one if the worse in the business. I don't want anyone else to get ripped off. Thanks in advance. There will be several more complaints to follow.

Dear Mr. [redacted] - each new home is provided with an express, limited Workmanship/Materials & Systems Warranty.  Roof coverings are included in this warranty program and are covered for a period of 2 years following completion of the home.  Over 5 years have passed since the original...

installation of this roof.  The 1st warranty request received by Rialto relative to the roof was made on 12/30/15, 4 years past its original installation.  During those initial years and beyond the warrantable period, it seems that the roof has performed as intended.  Please note that, particularly in the recent 1.5-2 years, the San Antonio area has been hit by significant weather patterns, including storms carrying high winds and tornadoes.  In our review, it appears to us that these weather patterns have been the primary cause of shingle sections being pulled from your home's roof.  Please also note that other homes constructed by others in the Sonoma Verde neighborhood and surrounding neighborhood experienced similar damage during these storms.  As you likely know, the Rialto's new home warranty does not cover damages caused by such events.Respectfully,Rialto Homes
