Ladies and GentlemanLet's me provide some background on this matter, so we avoid any manipulations or hals truth about this matter.First of all, how can an Expert like [redacted] make an estimate of a value of an item, in this case a very rare RobertoClemente bat,  very simple it is based on results os recent auctions.Exhibit 1[redacted]My personal estimate on the value of the bat was around $ 15,000, based on this comparable piece. [redacted]who is an expert in this matter, estimated the value on $ 16,000- to $25,000. I have seen other Clemente PSA9 batsgo as high as $ 18,000. So when we make those analogies, his estimate makes sense,  This are the facts in this case.Exhibit 2Eventhough [redacted] and I, agree to start the bidding at $5,000, he took it upon him to changeit to $2,500,  " because they felt it would do better". Your predictions where wrong, and you did not honorour agreement of a $5,000 opening bid. Please see email on 11/**/14[redacted] [redacted]11/**/14to me[redacted]

3 Exhibit: The Email Blast:[redacted] <[redacted]>12/**/14to [redacted]Hey [redacted]Hope you are doing well, I have not seen the Clemente E Blast on my email, the auction end in only two days. Could you please do so today ?Thanks in advance for your time.[redacted] <[redacted]>12/**/14to me[redacted].    - ** I a receive all Grey Flannel Auction emails, I did not get the Roberto Clemente blast email, it was untilI reminded [redacted] to do his job, he replied on 12/**/2014, 2 days before the auction. You got it.Based on this facts, I feel that Grey Flannel mishandled mis consignment, which allow  some oneto swoop in and pick up this very rare item, for less than 1/2 its price. If it is relisted again, and marketedcorrectly, it will sell at its current market value of $ 16,000- $ 25,000.I want my consignment back.Best Regards

[Unfortunately, [redacted] is trying to play around with words. We agreed to start the bidding at $5,000, that does no translate into asking for a $5,000 final price, shame on you,you should know better than that. The bat was suppose to start at $5,000, and the final price according to your own words was $16,000 to $25,000. Due to your negligence andbreach of our agreement, the bat misteriously went for half. I have lost all my trust in Grey Flannel, very unfortunate.Your Answer Here]

Review: Last year we contacted [redacted] about the posible consigment of my Roberto Clemente, 1969 PSA graded 9 Game used bat. The first think I asked, what

was he vale estimate, [redacted] assesed the vale at $16,000- $ 25,000, which is very consistent with similiar pieces that have been sold this year. We agreed on two things,

we would start the bidding at $5,000 and Grey Flannel would send an E Blast to promote the item. Unilateraly [redacted]'s team decided to start the bidding at only $ 2,500, this

was done without my authorization, or consultation. Three days, prior to the auction , Grey Flannel has NOT sent the Eblast to promote the item, it was not until

I contactet [redacted], regarding this matter, and he proceeded with the Eblast ( 3 weeks Late). Both actions, by mistake, neglicence or with premeditation,

lead to a final bid of only $7,139, less than half its estimated value. I have contacted [redacted] Twice, and told him that Grey Flannels inability to fulfill our agreement,

would be grounds to consider it Null and Void, and I requested my consigment back or I even gave them an opportunity to re-list the item, and abide by the terms of our agreement.

[redacted] and Grey Flannel, has failed to answer my request. The auction was held on december [redacted], 2014. It is in this in mind, that I urge your agency's help.Desired Settlement: 1- Return of my Consigment or compensation for fair value of item, which based on [redacted]'s expert assesment , would be on the $16,000 - $ 25,000. I would be satisfy with and even lower valuation of $ 15,000 less comissions.

I am aware of your history in this hobby which is why I am so surprised. Your demands are out of line. You entered into a contact which was executed in full. Yes, you and I discussed the market for your Clemente. You and I had a somewhat informal, impromptu phone conversation. It is my best recollection that you told me you had a "great" Clemente GU 9 bat. During our talk, I quickly jumped around to different online resources to pull up comparables. We discussed the sales price of other bats that have entered the market and you choose to send it in. Some of the comps were not on par as they had different grades, different years of issue as well as variances in condition, provenance, autographs, sell dates etc... All estimates are provisional and subject to revision on personal examination by our specialist. They are just a best guess. No one knows were an item will fall on auction night. Some times you win and sometimes you lose. Your bat was featured multiple times on our Home Page, Social Media Platforms, eBlasta and Blog Postings. More than was asked for and certainly more than was required. Here are just a few links confirming such: · [redacted] · [redacted] · [redacted] In the end, you bat sold for above the $5,000 level which you had originally requested as a reserve price and you received your money with in a timely fashion. Additionally it was featured multiple times... While I agree that the bat did not do fantastic it sold for more than an acceptable level. I told you on the phone, I feared you overvalued it... The sale must go through to the winning bidder as he has entered into a contract (same as you) by placing his bid and honoring his invoice. I am sorry but that is the way it has to be. You are not a not new to this hobby and you very much understand the auction process. If your bat sold for more than you had expected we would not be having this conversation. Please know that if you choose to air this grievance is public be careful of what you say. We take our reputation very seriously any may be forced to take legal action. Thank you. - [redacted]sent from my mobile so please pardon any typos. [redacted] | Grey Flannel Auctions | ###-###-#### [redacted]

Response:

This email is in response to the Revdex.com Complaint #[redacted] complaint which was filled in regards to the consignment of a 1969 Roberto Clemente Pittsburgh Pirates Game-Used Bat. We take these issues very seriously and within reason will do what is necessary to rectify the situation. In our 15+ year history of doing business we have never had a complaint filled against us with the Revdex.com and and it is my hope that this can be mitigated without further pursuance. In the end, the subject bat sold for above the $5,000 level which was originally requested as a reserve price and money (in full) was received by client in a timely fashion. Client was forewarned ahead of time that we feared that he overvalued it... The sale must go through to the winning bidder as he has entered into a contract (same as the consignor) by placing his bid and honoring his invoice. The sale is final. Consignors requests/demands are are unwarranted. To recap: You are a returning customer (consignor) who reached out to us with a Roberto Clemente bat which we started discussions on or about Nov. [redacted], 2014.A Consignors agreement contract was eSigned by yourself on 11/**/2014. Please note that before entering into this agreement you were well aware that this lot was being added to the sale as a "late addition" and that it would only appear online (not in our printed catalog). It should also be noted that you were offered a discounted consignment rate as well as the use of our [redacted] account to ship the item to us free of charge. The Terms and Conditions of Consignment of this agreement are as fallows: 2 – Terms of Auction. Once items on Schedule A are consigned, Consignor may not withdraw any of the items listed from auction. Consignor agrees that all items listed on the Schedule A will be sold at auction to the highest bidder.... GFA has the right and absolute discretion to: a) Consult any expert regarding authenticity; b) Research the provenance of the property; c) Catalog or group property into lots; d) Determine the date and the manner of the auction; e) Set the reserve price on lot(s). Reserves are intended as a starting point for prospective bidders. GFA makes no representations or warranties of the anticipated selling price of any property and no reserves given by GFA of the selling price of any property may be relied upon as a prediction of the actual selling price. With regards to your complaint on the reserve price which was set; We had an email string on 11/**/2014 with the subject: "Reserve pricing". You: [redacted]. GFA: Hi [redacted], We discussed it in the office and felt that it would ultimately end up doing better if it started at $2,500. One of our major keys to success is our low starting price points. This is the "hook" that sets the bidders up for an aggressive and spirited auction day. It will not sell for less that $5,000 don't worry.... Let me know if you have any questions or if you would like to discuss further. Thanks. ?------------ ? ? You: [redacted] GFA: Thank you.--------------------With regards to your complaint on featuring your bat in our online eBlast; We had an email string on **/**/2014 with the subject: "Clemente E Blast". You: [redacted] GFA: You got it. ------------------------ Me: See below. Thanks. It is my belief that you have an affinity towards Clemente and your judgment on market value may be somewhat clouded by your opinion of him as a player. Please get back to me asap. Thank you.
