On January 14, *** from Grossinger Chevy's customer care team spoke with *** *** at 1:03pm and set an appointment to visit
Grossinger Chevrolet at 4:30pm that dayThe pricing offered to Mr*** was $under dealer invoice as permitted by the USAA buying programWe did meet the pricing offered by the competing Chevy dealer even though it was less than the USAA buying program priceThere was nothing done in this case that was unscroupolos, rather we were attempting to satisfy a potential customer
Grossinger Chevrolet collected the appropriate taxes and state fee's as stated by ATC (our 3rd party out of state licensing service) and sent out via *** on January 21, On January 27, Mr*** sent an email stating his concern of the taxes being paid and we discussed taxes had been sent out timely
*** *** then called the Secretary of State in *** and told them to hold our tax check and mail back to ATC and he would pay the tax and state fee out of him pocketThis is the reason we have tax and state fees to reimburse to *** ***
On March 4, 2014, Grossinger Chevrolet received the tax reimbursement check from *** to pay back in the amount of $In another effort to satisfy this client we are reimbursing him his out of pocket expense of $1,Even though Mr*** elected to pay a second time on his own
The additional $factory incentive that he is referring to is not compatible the XXXXX zip code the car is titled atGeneral Motors offers rebates based on the titled zip code of the vehicle
Initial Consumer Rebuttal /* (3000, 8, 2014/03/13) */
(The consumer indicated he/she DID NOT accept the response from the business.)
I will not consider this complaint resolved until I receive the money the dealership agreed to reimburse me, and I receive either the factory incentive or have a policy in writing that shows why I am not eligibleHere are my replies to each of the General Manager's statements:
*** "On January 14, Daina from Grossinger Chevy's customer care team spoke with *** *** at 1:03pm and set an appointment to visit Grossinger Chevrolet at 4:30pm that day."
Reply: I spoke with *** twice before the 1:PM call on January 14thIt was during those conversations that I told her very specifically to not to take a car from another dealershipThe phone call at 1:PM is when she told me that she had just procured the car that I was about to purchase from *** ChevroletWe then set up the appointment because Grossinger now had the vehicle I wanted
*** "The pricing offered to Mr*** was $under dealer invoice as permitted by the *** buying programWe did meet the pricing offered by the competing Chevy dealer even though it was less than the *** buying program price."
Reply: After approximately two hours of delays, they did meet *** Chevy's quoted price for the exact same car
*** "There was nothing done in this case that was unscroupolos, rather we were attempting to satisfy a potential customer."
Reply: In my opinion, poaching a vehicle sale away from a sister dealership is unscrupulousAs the victim, I think *** Chevrolet would agree
*** "Grossinger Chevrolet collected the appropriate taxes and state fee's as stated by *** (our 3rd party out of state licensing service) and sent out via *** on January 21, 2014."
Reply: *** Chevrolet collected $more than was required for taxes, and $more than ** State needed for feesThe sales manager applied some aggressive pressuring techniques to try and collect thousands more "for taxes", but because I had those exemptions clearly in writing, he eventually backed off
*** "On January 27, Mr*** sent an email stating his concern of the taxes being paid and we discussed taxes had been sent out timely."
Reply: I did not receive any response to my email, and there absolutely was no discussionEffective communication by Grossinger's employees and manager may have curtailed this complaintPer ***'s previous statement, the registration application took a full week to mailI would not consider that "timely"
*** "*** *** then called the Secretary of State in *** and told them to hold our tax check and mail back to ATC and he would pay the tax and state fee out of him pocketThis is the reason we have tax and state fees to reimburse to *** ***On March 4, 2014, Grossinger Chevrolet received the tax reimbursement check from *** to pay back in the amount of $1086.65."
Reply: I asked Mr*** to extend my temporary registration and was satisfied with his rationale as to why he couldn'tWithout a valid registration, I cannot take my vehicle onto any military installation and therefore cannot drive myself to workI was not prepared to wait several more weeks for Grossinger to hopefully redo the registration correctlyThis is why I chose to call the ** Department of Licensing (not Secretary of State) to expedite the process myselfEven with this attention, there was still a period of days that the vehicle was not legally registered because of Grossinger's errors and delaysAny amount not reimbursed to Grossinger by their subcontractor, *** needs to be resolved between those two parties and should not involve me
*** "In another effort to satisfy this client we are reimbursing him his out of pocket expense of $1,Even though Mr*** elected to pay a second time on his own."
Reply: I asked the dealership to reimburse my money on February 26thOn March 6th, Mr*** told me that he would mail my reimbursement for $that dayAt this time I have not received anything from themThe reason I submitted this complaint is in large part because of these continued delays
*** "The additional $factory incentive that he is referring to is not compatible the XXXXX zip code the car is titled atGeneral Motors offers rebates based on the titled zip code of the vehicle."
Reply: I asked Mr*** to send me Grossinger Chevrolet's and/or GM's policy on establishing residency for factory incentives, but he has notThe Chevrolet Marketing Team told me that in my situation eligibility would be based off the location the vehicle is registeredThe vehicle is registered in *** *** not XXXXXIn a subsequent phone conversation with the lien-holder, *** they told me that the address on the title is the same as on the registration
Final Business Response /* (4000, 21, 2014/04/15) */

(The consumer indicated he/she DID NOT accept the response from the business.)
I would like Mr*** to upload documentation to support his positionHe should be able to provide Grossinger Chevrolet's and/or GM's policy outlining eligibility criteria, and his supporting records applicable to our transactionAssuming there is a policy in writing that can prove that I am not eligible for GM's Factory Incentive and it was not a result of neglect by Grossinger's employees, I will concede this point and consider the matter with them "resolved"
Business Response /* (4000, 34, 2014/05/06) */
We received notice that this case is unresolved and this should not be the caseWe responded to Mr***'s last correspondance and in addition we provided a copy of the incentive verification form that we are required to use from General Motor's dealer communication portalThe attachment is included as an attachment in this complaintIt clearly shows that Mr*** was not due any additional incentive dollarsIt is important to understand that each factory incentive has clear cut guidelines that determines customer eligibilityIn this case, Mr*** did not qualify for the additional rebate
Sincerely,
*** ***

Attached are the program guidelines and the *** incentive look up from the General Motor's incentive portal that pertain to Mr***'s transaction and his eligibilityThe program guidelines state that the incentive program is only eligible to customers who register their vehicle in certain geographic areasThe copy of the *** incentive look up from GM's portal again shows that the zip code used for registration is not eligible for this incentiveIn addition, our GM, *** *** called Gm directly and they also stated that the customer was not eligibleIt is in no way up to the dealer to give or take away incentive dollars away from a customerPlease contact us if you need any further information

Grossinger Chevrolet's employees utilized fraudulent practices during the sale of the vehicleTheir management has been given ample opportunity to correct the actions of their people post-sale, but has chosen not toThis dialogue is no longer productive as they are now talking in circlesAs a result, I feel that this dispute will require legal action to be satisfactorily resolvedI will be retaining legal representation and filing for forced arbitration in accordance with the terms of our contract
Consumer Response /* (4254, 42, 2014/05/09) */
I am willing to move forward and use the Revdex.com to administer the arbitration hearingsGrossinger's forced arbitration contract does not specify a particular arbitrator and only stipulates that it governed by the Federal Arbitration ActThank you

Grossinger Chevrolet

I made the mistake of going here to buy a new truck after many warnings not to. My sales person was extremely pushy and did not want to give me my keys back on my trade until he had the deal done. I had things to do that day and told them to do the paperwork and give me a call when it was a done deal. They insisted that I take the truck and come back later to sign the papers. After going back 3 times I finally signed the papers and thought it was a done deal. 27 days later (yes 27) I received a call from the finance company on my trade stating it was in default!! They never paid off my car! Took me 3 days to reach [redacted] the finance guy just to tell me the financing fell through and could I bring him $5000.00 down!! No one called me, even just to say "hey we haven't paid off your car" I had no clue until a the other finance company called me! Now they have created a ding on my credit score and think it is just no big deal. I have now had my truck for 34 days because they want me to swap them out without issuing me a check for my deposit that they cashed. I refuse! I want my trade in and my deposit at the same time. They are making me chase them down just to get my security deposit back. This dealership is HORRIBLE. I have now dealt with 4 different people with still no results. I would definitely go somewhere else!

As the General Manager of [redacted] Chevrolet, I have dealt with this customer personally. I have researched her claim and have come...

to find out that our dealership did pay the referral fee to this customer. The check was made out to Ms. [redacted] and mailed to the address we have on file for her. We follow this procedure on all referral checks throughout our company. The check was cashed or deposited and is endorsed by her on the back. I do not know how the dealership could be responsible in this case.
Initial Consumer Rebuttal /* (3000, 7, 2014/04/01) */
(The consumer indicated he/she DID NOT accept the response from the business.)
I never received the check! I followed up with Grossinger in January and was told someone would look into what happened with the check. I never found out it was sent in January until 3/31/14. If they had followed up with me in January and told me the check was sent we could've avoided this situation and had the check voided and another issued since the check wasn't cashed until the middle of February. Due to no one properly following up as requested on numerous accounts there's a bigger issue at hand. So now I have to follow up with a third party due to a lack of professionalism and communication.
Business Response /* (4000, 17, 2014/05/05) */
Grossinger Chevrolet has done exactly what it was agreed to between our company and this customer. We sent a $50 referral check to this customer at her address. Apparently the check was cashed by someone else but this cannot be our dealership's responsibility. I am sure that everyone would agree that our company was not at fault in this case.
Consumer Response /* (4200, 19, 2014/05/05) */
(The consumer indicated he/she DID NOT accept the response from the business.)
There is no resolution. Regardless if the check being cashed by someone else was in fact the dealership's fault, being customer oriented means doing what ever you are allowed to assist YOUR customer with any issue. I am sure everyone would agree about that this is what good customer service is. In addition, I was asked to return to the dealership to sign a statement for their bank so they could possibly get the money returned and once again after that day which was a few weeks ago, I have heard nothing. No one's called or emailed me with an update. Communication is horrible with this company. First, with sending the check instead of calling me once it was written as I requested, second with not being able to tell me what happened with the check until after I followed up multiple times and a whole month later and now with not even bothering to update me with what's going on with the refund and the next step in the process. Like I said previously, communication between this dealership and its customers is horrible.
