To whom it may concern, The former seller of ** *** engaged me to make minor repairs on the home at ** ***There is NO agreement or contract with *** ***Over 90% of the repairs were completed within weeks of settlement as the former owner would not allow repairs prior to
settlement. This was agreed to in writing by all partiesDue to a knee injury, I was not able to go up on the roof to inspect the work completed by my employees. It is agreed that there is some very minor brick pointing and flashing repair still outstanding on the chimney. The employee stated that the work was completed on the chimneyAs soon as I learned it was not, the employee was terminated. Mr*** will NOT allow me to make the final repairs The siding is ASBESTOS and cannot be repaired as it is no longer manufacturedThis was explained to Mr*** and that metal flashing could be installed under the cracked sidingHe agreed to this but will NOT allow the minor repairs to be completed The window sash replacement was delayed due to incorrect ordering by the window distributorThe sashes have been replaced with new onesAll of the other repairs have been completed There will be no refund to Mr*** as he did not pay for the repairs I am ready and willing to make the final adjustment repairs if Mr*** will allow *** ***

Mr***'s details are not consistent with the events that have occurred.1) Mr*** asserts that he should not refund for repairs not performed due to the contract not being with me - I am not disputing thisMy original complaint notes that he has also not paid the *seller* of the home for repairs not performed - he did have a contract with herI confirmed this with Mr*** - his exact response to whether he should refund the *seller* was "why should I?" before storming offAs of this response, I will not consider this issue resolved until he has refunded the seller for work not performed.2) Mr*** asserts that 90% of the work has been completed per his contractI have attached his quote for referenceMr*** failed to perform the line items for "Install new wash to brick chimney, re-flash and paint at roof base" ($515), "Repair siding as noted on inspection report" ($240), "Exterior trim - repair trim areas noted on inspection report, repair loose hand rail" ($425)That accounts for 50% of the line items listed on the quoteSee attachments for example pictures of these areas for repair in their current state.3) Mr*** asserts that significant hardships and employee misconduct led to my concerns and that he would fix the matter if allowed on the property I challenge this assertion in ways:#- Mr*** at no point in the months leading up to my demand for refund of money (to me or the seller) made me aware of these alleged hardships.#- Mr*** asserts that one of his workers told him that jobs were done that were notAt the time many of those jobs were being performed, Mr*** was on siteFurther, most trim and siding repairs are in plain view from the groundHe could have reasonably checked several of the repairs against his quote without needing to access the roof - these jobs weren't performed AT ALL Yet, in his response to my earlier email on outstanding work, Mr*** fails to note that work that would be obvious from the ground (which he was present on site to check) was still outstandingAt this point, I was trusting that he was giving me an accurate report - it was only about month after this exchange that I realized significant numbers of repairs not listed in this email had never been performed (essentially when I learned the chimney report had been falsified, I started looking at other repair areas in more detail).#- Mr***'s track record of performance on this job suggests either willful misconduct or incompetence in performing said repairsMy stance is that his presence on my property to perform additional repairs will only result in additional sub-standard workAs a minor, but timely, exhibit demonstrating this, I have attached a picture of the window repair performed AFTER his alleged hardships / worker issuesMr*** performed this work personally yet failed to properly install appropriate matching hardware on the window leaving me with mismatched windowsI watched him perform the entire repair with an assistant and remember the assistant asking about window hardware to Mr*** who did not check my other window and just took the hardware away. As Mr*** promptly stormed off my property without allowing me a proper inspection, I only learned of this later in the day when I happened to look at the other windowMr*** will no doubt assert that he can "make this right"However, my concern has been his negligence, or willful misconduct, or incompetence up to this point - I do not trust this individual to have any further presence on my property, hence my demand for a refund of work not performed to the SELLER.[To assist us in bringing this matter to a close, we would like to know your view on the matter.]
