The Customer hired the Builder to build him a home on the site of an existing cottageThe Contract was signed on May 31, J This contract was for a fixed price and not a time and materials type arrangement.During the course of construction it was discovered that the Customer's neighbor's sewer line passed under the site of the Customer's new homeThe Customer wanted to delay the project to see if the local sanitary district would move the sewer line for himThe sanitary sewer district declined to do soThis caused the project to be delayed.Further there was an incident involving the painting of the interior doors and woodworkThe Customer was not happy with the quality of the woodwork and Builder had all of the woodwork repainted, and in fact credited the Customer for all material and labor involved with the initial paintingCustomer hoped to take occupancy at the end of This was not possible due to the above-mentioned issues.The Customer was allowed to take occupancy in early on January 16,It did not take a year tor this home to be completed as alleged by the Customer.Customer became unhappy when they determined that the builder was scheduled to make a higher profit that they thought the Builder would receiveThey are now requesting an accounting of the costs the Builder incurred despite the fact that they agreed to pay a fixed amount for the construction of this homeThe Builder has a signed contract and signed change orders reflecting the amount contractually dueEach allowance item was approved by the Customer.All painting, including the wooden porch ceiling and the exterior doors, would come under the contract as allowance item;As all of the paint allowance has been credited at this point, the painting of these items will be an additional chargeInstallation of steps was also specifically not included in the contract, since grade had not been established at the time of the bidTemporary steps were providedAir conditioning was recently installed by the HVAC contractorThis could not be done until the final excavating and grading was completed and the weather warmed upThe Builder has been advised that the Customer is trying to pay the HVAC contractor directly for the installation of the furnace and central air conditioning unit.Customer claims that they have a multipage report documenting warranty work and other issues that remain unresolvedCustomer has failed to provide Builder with a copy of this listBuilder remains ready, willing and able to address all warranty work covered under the terms of the contractCustomer has failed to pay the Builder all of the monies that are contractually due to the BuilderBuilder is requesting $11,from the Customer [redacted] Top Shelf Builders Inc

For your reference, details of the offer I reviewed appear below. Top shelf builders answers is one complete lie.I have a signed list [redacted] signed in Jan with about things he said he would fix ? No show. I had to call the sub to finish the Air in the house he did come and fix it. He said his quote is much lower than ***had on is list, The out side inspectors gave me a 20 page list and pictures of things that have to be fixed. I paid [redacted] $35,000 to be the GA, he did not over see anything for his money, He alsocharged another $36000 for labor. He than add on thousands more. Yet all I want is to be done finished and fix what is wrong, I have set a law firm to be a metieator picked by bill. [redacted] does not wantanyone else to see the facts because he knows he is wrong the title company said he has to pay for all mistakes. He now does not answer any e-mail or call. The local asso. will not help becausehis girlfriend is on the board and so is [redacted] and she worked ? on the home all done wrong.
