SNL Fencing and Dirtwork LLC has tried to contact Mr*** several times with no response in returnIt was our intentions to completed our contracted obligations but recently Mr.and MrsRundell has avoided all attempts of communication and
is holding machinery on their property that belongs to SNL Fencing and Dirtwork LLCIt is our belief that the clients have become somewhat hostile in the form of carrying fire arm s and not returning our attempts to contact and fulfill our contract agreement

Let's be clear, SNL Fencing and Dirtwork LLCs attempt to contact us was week AFTER we placed the complaint with the Revdex.comOn April 25, someone claiming to be the new foreman for S and L left a message on my phoneI then attempted to contact *** *** to confirm this gentleman was his new foreman, however, *** did not answer his phone or contact meI even had two different phone numbers for *** *** and XXX-XXX-XXXX) and left messages at both, to no availI then started to receive phone calls from a *** whom three weeks prior said she was fired and not to contact her anymore regarding the business dealings of SNL Fencing and Dirtwork, so I did not acknowledge her phone callsAnd yes, this "new" foreman continued to call, but I will not talk to people I don't know about business dealings that is not their businessAnd ALL THE VOICE MESSAGE LEFT, WHERE TO PICK UP TRACTOR TO REPAIR BRAKES, NOT TO FINISH JOB!!!!!
Now, let's turn to the subject of AVOIDING ALL ATTEMPTS OF COMMUNICATION, as far as phone calls go, I think it goes without saying that there were many, many attempts to get in touch with SNL, but there were phone call that went unansweredUnfortunately, phone records are not kept past days, so they cannot be detailed out like text messages (we do have the last days, should they be needed)To properly explain the AVOIDING COMMUNICATIONS let's go back to the beginning of the work and all the text messages:

Monday, March 14, - to give you an idea of the contractor we are dealing with, my wife receive a phone call from *** to please send him a copy of Exhibit a from the contract he cannot locate his right now, so my wife sends him a copy of the map I provided thinking that was what he wantedBut she was wrong, He Texted back "Needing the back page of the contractExhibit a" Exhibit a is a listing of all the materials that he is to supply for the job

J I will be down there in the morning midday to drop off pipe and wire I'm actually searching for my piece to fit my pipe driver now then the rest of the guys I'll be back down there Monday to hopefully finish the whole job up I will send enough guys

J I can't get ahold of my foreman that was down there mike
I count three (3) NO RESPONSES and there was no contact initiated by *** at SNL in between these dates
I did have some text contact with SNL foreman by the name of Mike who was on our job site, and he was also good about not returning calls and not returning textsIf necessary I can also recite themIt basically boils down to poor business ethics, poor business communication, poor business customer service, and poor business work principles
This "new" foreman appeared at my gate with truck and trailer expecting to get on the property on Monday, April 25, I will not let people randomly on my property whom I do not knowI will not release equipment of a third party to someone I do not know and be held responsible of giving it to a wrong person
As far as the carrying of weapons, we do as a daily practice carry weapons, whether open carry or concealed (my wife and myself have our concealed carry permits)There was never any hostility toward the employees of this contractor
The only frustration is/was that as of Mid-April the job was not anywhere NEAR finished from contract signed date of January 2016, when the owner promised verbally it would be completed two (2) weeks when they stepped on property
Yes, there is a tractor and a post driver of SNL on our propertyWe have made ourselves available this past Friday and Saturday (April and April 30) for *** Luttrell to come and pick up his equipmentHe has not made any attempt to come and pick up the tractor on either of those datesWe will not allow any other representatives of SNL on our propertyThe equipment will be released to *** Luttrell only, as we know who he is and do not want to be held liable of releasing equipment in to the wrong hands
As far as the fencing and unfinished work, I will reiterate, I do not want SNL to finish any work on our propertyI have now finished hanging five (5) gates and stringing over feet of fencing with the help of my familyI will continue to do the work myselfSNL Fencing and Dirtwork LLC is not welcome on my property as a contractor

The consumer *** is incorrect in the matter of *** contacting him and saying I was fired, I at no point in time have been fired and am still currently involved *** response was inaccurate and I have tried to reach him numerous timesIt is our belief that Mr*** has breached his part of the contract and using his actions to justify a matter than should have been cleared up and the job would have been completed by now has he not stolen SNL S EQUIPTMENT and used hostile methods when employees were there to workHis hostile intentions were made clear when his wife and himself confronted our employees with a hand gun on their personWe have made every attempt to sole this matter with zero co operation from the client our next step with be to file a mein on *** property unless he wishes to settle the matter as far the equipment theft and the breached contractSincerely *** still currently with SNL Fencing and Dirtwork LLC

So if the SNL Fencing and Dirtwork LLC feels it necessary, by all means, please file a Lien against my property for the return of your tractor that your employee left on my propertyOn April 13, 2016, your employee *** took the trailer with the assumption *** Luttrell was buying the rest of the pipe for this jobAt that, no one ever showed back up on the job and the tractor has been here since and no pipe for the rest of the job was deliveredSo we are out $of materials that were never delivered for the job, but we paid for in the deposit check
According to the McDonald County Sheriff's Office, I as a landowner have every right to decide who is allowed on my propertyThere has been way too many different employees of SNL on my property and I will tolerate no moreThe company owner, *** Luttrell may come and pick up his tractor on the weekends when I am home from workHe has my contact numbers and I will answer the phone or text
*** has contacted me today, May 3, 2016, through my personal email and I will only continue to communicate through the Revdex.com as there are great discrepancies in stories*** has asked what kind of documentation would be needed to allow one of ***'s employees to pick up the tractor since *** is unable to do so himself
AS FOR THE CREDITS OWED: THERE IS THE MATTER OF $IN MATERIALS THAT HAS NEVER SHOWED UP ON OUR JOB SITESO THAT IS A TOTAL OF $CASH OR MONEY ORDER THAT NEEDS TO COME ALONG WITH YOUR EMPLOYEE WHEN HE/SHE PICKS UP THE TRACTOR
*** Luttrell of SNL Fencing and Dirtwork LLC would have to provide *** and *** *** with a LETTER OF INDEMNIFICATION releasing *** and Susan *** from any and all issues and/or concerns of tractor arriving at proper company, any and all damages or repairs prior, during, and after transport, giving tractor to wrong person, FOR *** AND *** *** of ** *** *** ***, MO XXXXX to release the tractor as it was left on this property by his employee *** into the hands of its employees, INSERT NAME OF EMPLOYEES HEREThis letter would have to have *** and ***'s prior approval
