GS Merritt Contracting was paid in full to install a gravel driveway for me. The job was not completed and the work that has been done is completely unacceptable.

Mr *** voided the contract by having another contractor do work at the site. we structure our contracts for protection of both parties so as the customer doesn't pay for items they don't receive. the contract clearly states the payment schedule and is to be signed off by both owners. this case went before the NYS Attorney General for review and was sent back with no case. it would appear Mr. tried to alter the original contract while sending it to the NYS AG office . per federal regulations concerning wet land protecting there was a requirement for erosion control to be put in place. the amount for the measures is $4000.00 which Mr. refused to pay. We are currently pursuing a lien on the property for failure to pay. please see the attached documents.

I have reviewed the response made by the GS Contracting in reference to complaint ID, and have determined that this does not resolve my complaint. For your reference, details of the offer I reviewed appear below. Mr. Jeffrey Loupin states that the contract was voided by having another contractor. First if you can show me where there is a stipulation for that in the contract I would like to see it and secondly I had a neighbor move the rock for me . Mr. Loupin's hired rental equipment could not move it he did not rent the correct equipment. I have photos of him and the equipment broken down. Thirdly, this all took place after Mr. Loupin refused to continue working until he received another $8000 for the removal of said rock. I have not received any items in the contract that were not paid for as Mr. Jeffrey Loupin claims. Any alterations to the original contract were done by Mr. Loupin. In fact I have NOT received items in the contract. The New York State Attorney General file number *** was not sent back as "no case" but as "company refuses to make any payment or adjustments." Mr. Loupin clearly states he did not do two of the four events that were paid for when in fact he did not do any correctly. Mr. Loupin omits several fax of the agreement. The fact that he left the worksite refusing to perform anymore work and also that he left taking of the permit and he left informing me that he will return with the permit and three more loads of crusher stone number three that I had already paid for and had on hand. This is plain and simple we had a contract for $30,950 I paid him $32,600 because he missed calculated the amount of crusher run needed which he himself admits. this is why I find it all hard to believe and understand. Why he refuses to accept my offer to have them deliver 12 loads of crusher run number three stone to the location and I will fix his mess myself.

I sent my response to the original complaint and stated truthfully and factually and explained in great detail every phase of the project. In response to the $8000.00 payment Mr. sent you . the $8000.00 payment was used for the extra stone product for the driveway that Mr *** new we were going to need ..Does that mean that all $8000.00 went into stone product..no it doesn't. the payment not only covered the stone product but also the labor, equipment and fuel costs to install said product. I have all the stone tickets from the quarry where I purchased from. as in my response to the New York State Attorney General. I was willing to go back and fix any portion of the work I did on the driveway . I have in text messages Mr. refusing my offer. if I'm not mistaken I have the legal right to return and fix my portion,if however the customer declines and refuses then I am left wondering what the issue is. he received all materials and labor that he paid for. . also Mr. hired another contractor to finish the project which is fine BUT in doing so voids any part of the contract Is it right for me to fix the work of others after the owner signs for a finished product? How am I to know that the other contractor didn't remove materials from the driveway I installed and move it to the portion they installed. I never refused to go back and fix my portion even after knowing another contractor possibly moved materials? I don't so Know any of what went on because Mr *** never called to have us come back to finish the project he just hired someone else and when they were done called me trying to get me to just give him an unheard of amount of stone product. I am once again wondering how am I to know what happened and why is the driveway not in the state I left it when Mr. signed off on it? Also the second payment on the contract indicates when a certain amount of work is complete and the owner is happy with the work the second payment is due.Mr. made the second payment and signed off on the work as you can see in the color photo copy of the original contract I sent you. I fulfilled all work requirements up to the second payment.the other contractor Mr. hired finished the project as I never received the final payment. the bottom line here is Mr *** received all the materials and labor he paid for. All the materials were delivered by the company making the product.I am a very reasonable am a very business as you can see from some of my other customers I am Honest trusworthy and give the an exceptional product that the are more than happy with. This is all lies, Mr. Loupin left the worksite with the driveway not only unfinished but without me agreeing to anything being satisfactory. The signatures are on the contract for the acknowledgment of the payments received. And that is the only reason ! We wouldn’t be at this point if anything was satisfactory. He knows this to be the truth ! He states he is honest, that is a joke. He left because he was demanding another $8,000 to finish the excavation of the the house. He couldn’t move a rock that a neighbor of mine moved at no charge. Once again no one was hired for any excavation besides Mr. Loupin. Mr. Loupin kept demanding more money to complete the job than what we agreed on. Once he and I were not in agreement he had requested the driveway permit and stated that I had three more loads on hand that had to be delivered and that he would in fact finish the job of the driveway. He said he was going to return. But in actuality, He never had any intentions of returning that is why he took the permit. He is a schema. He fails to mention many facts. And really, why on earth would I have stone taken away. Just think about what he is accusing me of. He states That he was willing to come back and fix the job. Yes he was willing to come back and sprinkle a few loads of rock down that is not going to fix anything. He knows that he dug the garage in the wrong spot he knows it was supposed to be well beyond the house but we agreed to move it closer so he would use less stone again because of his miscalculations.that is what he was willing to do and he knows it once again he is a liar. He is being dishonest. There are many things he was deceitful about with respect to his pre hiring. Things that he will be very unhappy about. But if he wants to go there I will !!!

Attached is a surveyed copy of a PDF that emailed on Wednesday, March 14, 2018 to Mr. Jeffrey Loupin. Depicting where the site of the garage was to be. Yes we did change the location of the garage closer, In order that Mr. Jeffrey Loupin would save money on the stone, but where he placed it was not where I wanted it to be. How much does he want and expect me to save him money on this job. He mentioned labor and fuel for installing that would be extra. That is not the case it was already paid for and you would have to have the equipment and fuel in use anyway. I have made many concessions on my behalf. He had promised to put in a culvert as well as making the driveway wider on the bottom. I have all this information in an email dated March 18, 2018. He also has received payment for an unexcavated electrical line & sand & conduit, as well as backfill of stone around the house and garage area. This is why he should just have the dozen requested of number three crusher rock delivered to the worksite. Where he gets it from is no concern of mine gravel is gravel the matter where you get it from. It would probably cost him more to finish the driveway in an acceptable manner where it is no longer flooded throughout and drains properly, then the delivery of the stone requested. My next step if this can't be solved here is to contact the New York State division of licensing and file a complaint.

is great to work with. We encountered many issues with ***'s project that were unforeseen and many potential hazzards. We communicated constantly with *** through out the project and completed on time. We look foreword to our next project with *** as she is one of our best customers.

This is the second time my company has utilized GS Merritt Contracting for work at our office. Mr. is a great repeat customer and excellent to work with. *** is patient and well informed with the process and the complications that can arise during construction projects which makes communicating very easy . We look foreword to working with Ron and his company in the future.

We are happy with the end result and it is what we were hoping for. Because of the weather there were hiccups along the way, but Jeff adapted and finished the job. His personable nature alleviated any of our concerns. We could tell he takes pride in his work and wants the homeowners to be happy throughout the process.
