damaged sod within the next 30days weather permitting. With all the rain the sod company has not been able to cut sod and are very backed up. I have also contacted the concrete company about replacing the sidewalks, they too are backed up from the rain that we have had. I will try and find out where they are at on the list. I am rejecting this response because:[redacted] was aware of all these issues, I sent him, & his workers (per his request) several text messages and they kept telling me that they would get it taken care of. I had the insurance adjuster out to look at my roof yesterday and they also told me that the damages to my roof are from poor workmanship, the roof was not installed correctly or professionally. The valleys are not cut in, there is no frost barrier, the nails were put in at an angel and are popping out all over the roof. I was told there is "Workmanship abuse" on my roof from tools. I was also informed that there is no way that roof should have passed inspection! If [redacted] actually does the repairs as he stated he would, and replaces the roof, I will accept the response, but not until then.

The water issue they are had was due to the 24" of rain that fell that month and the amount of ground water there was caused it to...

back up through their sewer lateral and ditch leading into their basement causing hydrostatic pressure and letting the water in any crack or crevice to enter through the basement floor. Which there should not be any water under the floor and is what I tried to explain to the homeowners and is why we are not responsible for the act of mother nature. That amount of rain caused basements to leak that had never leaked before all across the area of Jefferson County, MO and the St. Louis areas. However, we did go there during the rains we were having and dug the sewer lateral up where it enters the basement to relieve the pressure and showed the homeowner the amount of water that was trapped under the floor. I do have a video of this is needed. Now please keep in mind with all this being said I believe they have lived in their home approx. 10 months and never had a leak until we received 24" of rain in one month's time. But since then the homeowner has made a claim to his insurance company and I have made one to mine to resolve this. I feel that I have addressed this in the best way I possible can considering in was no fault of mine as the home builder that we had an abundance of rain causing this damage.

our homes with a 2-10 home buyers warranty at the closing of their home.  She needs to contact them for anything that is past the one year workmanship warranty.  But we will work with her to get the mentioned issues resolved and from here forward she is out of warranty with us and should utilize the 2-10 warranty we purchased for the home.  Attached is a copy of the contract and in the mean time we will contact the painters and drywall company to get these issues fixed.  Sincerely, [redacted]G'Sell Homes, LLC
