I have reviewed the complaint for Ms [redacted] *** and have found a few inaccuracies/omissionsMs [redacted] did come in to our office on the evening of 11/2/and did leave a deposit on a Hyundai SonataAt the time that I took the deposit from Ms***, she had asked if she could take the vehicle to her mechanic to be looked atWe have done this many many times, I have never once, in my plus years of experience had an issue with thisI asked Ms [redacted] which shop she dealt with, she was not sure, and my reply verbatim was "Its not an issue, so long as they are a registered repair facility in New York State"This seems like a fairly simple prerequisite, and as I previously mentioned this has never once been an issueIt is also worth noting that On Trac Auto Sales does not require a deposit to "run your credit" as Ms [redacted] StatesWe take deposits on vehicles as a good faith gesture by the customer, which puts the vehicle on hold for said customer as the sale process is completedWe require deposits to hold vehicles for customers, regardless if it a cash sale or financing is involvedI called Ms [redacted] the following afternoon, and informed her that all the financing was set up, and that we could move forward, and at that time I had also asked the name and address of her repair shop, as I knew Ms [redacted] had wanted to have the vehicle looked at before finalizing the dealAt that time Ms [redacted] informed me that her "repair shop" was called [redacted] automotive, and they were located at [redacted] ***Ms [redacted] was going to call me back with a specific time to take the vehicle to [redacted] to have it looked atPrior to Ms [redacted] calling me back, I had been in the area where [redacted] Automotive is supposedly is locatedOne of my employees and I were picking up at vehicle on [redacted] from another repair facilityI drove passed the address at [redacted] *** It didn't appear to be a commercial repair facility in the typical sense, which is not nearly important as the fact that it was missing the appropriate signage that is supposed to be affixed conspicuously to any registered motor vehicle repair facility or dealership in New York StateUpon returning to my office, I called Ms [redacted] and informed her of my concernsI also had offered to have the vehicle put on the lift at our shop in the rear of our building, and have my staff leave her mechanic to look the vehicle overWe had scheduled an appointment for 9:30am on 11/The following morning, I had the vehicle pulled into our facility, and put onto the lift in anticipation of the arrival of Ms [redacted] and her mechanicI saw neither of them at any point that entire dayIn fact Ms***, nor her Mechanic had the common courtesy to phone me and inform me that they couldn't make it for whatever reasonI had my staff leave the vehicle inside for over an hour, which set our entire day backThis was on the morning of 11/8, I heard nothing from Ms [redacted] until that following Saturday 11/11, at which time she requested her deposit back, because I supposedly wouldn't let her mechanic look at the vehicleI had again informed Ms [redacted] that this was not the case, reminded her that we were prepared for her arrival earlier in the week, and that she didn't show or call me to cancelAt the conclusion of this phone conversation Ms [redacted] and myself agreed that the car would be taken to [redacted] to be looked at, so long as [redacted] could provide some evidence that they are a registered repair facility in New York StateThe following Monday 11/13, Ms [redacted] once again called My office, this time demanding the return of her deposit again supposedly because I would not let her mechanic inspect the vehicleI once again reminded Ms [redacted] of our conversation on the previous Saturday, and our earlier arrangements to have the vehicle looked at inside of our facilityMs [redacted] was adamant that the facility at [redacted] was "zoned for mixed use", and was a commercial propertyI have never disputed this fact, It very well may beI reiterated to Ms [redacted] that our concern is not the zoning of the facility, but the fact that it is not registered with New York State as a repair facilityThis is a crucial point, that for some reason escapes Ms***If a shop is not registered in New York State, they are not regulated by New York State, and therefore may not have the proper insurancesIt was at this point that Ms [redacted] stated that she hoped that I wasn't refusing to take the vehicle to this "facility" because I was a racistIt was at this time that I kindly stated to Ms [redacted] that I was ending that conversation right there, and yes I hung the telephone up on the receiverI have been in this business quite a long time, I have sold literally thousands of vehicles to customers from all walks of lifeI always try to treat everyone with the same respectI had treated Ms [redacted] with nothing but the utmost respect, even after she had leveled such serious allegations at me frivolouslyI have not one clue why Ms [redacted] would make such a statement to meThere was absolutely no factual basis what so ever for Ms [redacted] to base such a statement off ofIt was at this time that I turned any further interactions with Ms [redacted] over to My bossI was in the room for both subsequent phone calls between Ms [redacted] and the Owner, at which time the situation was again re-explained to Ms [redacted] very respectfully, and at no time was Ms [redacted] dis-respected in any wayMs [redacted] was offered opportunities to have an actual registered repair facility inspect the vehicle, or to have the vehicle examined by her Mechanic at our facility on numerous occasions, she declinedIt is also worth noting that attached to this response is a list from New York State DMV web site(https://process.dmv.ny.gov/FacilityLookup/vsiqEnterFacInfo.cfm) that lists every single registered facility in the zip code, where Herbert Stis located, you will find [redacted] Automotive no where on that list In conclusion, in reviewing this complaint, there is nothing further that On Trac Auto Sales can or will do to help Ms***Ms [redacted] left a deposit on a vehicle with the stated intention of purchasing the vehicleMs [redacted] Also asked On Trac Auto Sales to obtain financing on said vehicle for herOn Trac Auto Sales exceeded the financing terms set forth by Ms***, and made every reasonable attempt to accommodate Ms [redacted] in her quest to purchase a vehicle, to no availI echo Ms***s sentiment exactly, no one should have to go through what I did to try to sell a vehicle

Initially Mr [redacted] claimed that we were nothing but legalized loan sharks (lending money at a high interest rate), when in fact we charged no interest, and this was not a loan but a debt owed by Mr [redacted] As our paperwork proves Mr [redacted] is simply trying to get out of paying what he owesOur initial position has not changedFurthermore, as to his new complaint we could not charge his credit card because it had been cancelled by Mr [redacted] We have contacted Mr [redacted] several times and still refuses to pay what he owesWe are more then happy to accommodate Mr [redacted] as to the original terms of the promissory note that he signed, all he would need to do is to call our office with a valid credit cardThank you for your time, King Stahlman Bail Bonds, Inc

Hi [redacted] , Thank you for taking the time to look into this dispute furtherSo I read King Stahlman Bail Bonds rebuttal and it seems that they did not even address my complaintAs I stated in my original complaint filing my dispute with this business is the fact that the business agreed to a payment schedule (see their attachment "Promissory Note") starting on 02/15/The business had my banking information for automatic payment and it seems they had a clerical error on their end or they have too many cases to manageSo I never had any deductions from my bank account nor any contact from the business until late June This is my rebuttal is that King Stahlman Bail Bonds failed to fulfill their responsibility in the payment contract.Thank you for your time and efforts[redacted]

Auto Sales respond I am not in agreement as to the facts of this matter stated.. First of all I was
in a serious auto accident where my car literally was hit and went airborne
into a utility pole. Only by the grace of God that I wasn't seriously
injuredWith being traumatized and having follow up with doctors for minor
injuries this situation my days made not be actual. But I do remember
who I work with initially for the purchase of vehicle and the salesman name was
Mike U***. Interesting enough all the facts aren't being stated
correctly with their responds. First all I came there on November 2,
look at this car Hyundai Sonata and did put down a depositUpon doing
this I explain that my mechanic needed to see the car before purchase, and I
hadn't test drive the car myself because of the hour of the nightSo, the
following day I came back to test drive the car and wasn't able because I was
told they didn't have license plates available.Doing this time, I did
state that my mechanic would try and come on a certain day, but it wasn't
definite. But do to his busy schedule he couldn’t come, and I did call
the following day and told Mike his situation. So, I ask Mike if
someone could bring the car to him to look at and he assured me that this could
happenI am thinking we all set for the car to be taken to my mechanic. I
called Mike and ask has this happen yet and was told the area was unsafe and it
wasn't a commercial address. We when back and forth with this for couple
days. I even told Mike my mechanic drove a BMW, because he stated
that car wouldn't be safe in this area where the mechanic shop is. Now
after going back and forth with this I decided to call the zoning department to
find out about the zoning. And was told the property is mix use both
residential and commercial. Once II got this information I called Mike
back and stated to him my findings and now he saying the mechanic
doesn’t have signs stating that his register. Now in the meantime I
haven't test drive the car yet myself, and I driving now a borrowed car.
Keep in mind I am going to doctor appointments and insurance
company. Finally, I ended
up speaking to manager of this location by name of Pete and he again stated
that he had driven by my mechanic location and didn't see a sign of him being
register. After going back and forth with this I realize I didn't want to
do business with them It doesn't take this much to buy a car. I ask for
my deposit and was denied it. Now Pete is stating to me that if I can
prove that my mechanic is register for which he is they could take the vehicle
there. To be honest by now I am tired and frustrated with this whole
thing. What I was
promised to me in the beginning didn't materialized and I was given a difficult
time in my interaction with On Trac Auto Sales. After being in a serious
car accident for which I can prove having my police report and doctor
too. In my years of trying to purchase a car I haven't experience
such difficulty in my life. My prayer is that they will be honest and
give me back my deposit. Taking in consideration that I am a senior and a
woman of the cloth and don't deserved such behavior *** *** ***

Basically, Mr*** is trying to avoid paying what he owesWhile Mr*** was in custody it was agreed upon that $4,would be the amount he would need to pay to be released from jailWe agreed to take $1,down and monthly payments of $per month, until the balance of
$3,was paid offMr*** was fully aware that the remaining balance was owed, regardless of guilt or innocence, and regardless if the D.A's office decided to pick up the caseMr*** is just trying to get out of paying what he owesPlease see the attached documents as proof

Response taken by phone: The customer signed the contract acknowledging that the deposit was non refundable. The deposit was used to secure financing under certain terms and also to hold the car. We held the vehicle for weeks
