Guardian mortgage refuse to post receive payments to my account prior to intent to foreclose.
Garden made me unaware that they were not posting payments on to my account since August 2019. Late October I received an intent of foreclosure letter. During this time I should have been through four November and December's payment. I begin to send in the to past-due payment before the 30-day requirement but all previous payments were returned to me.leaving me unable to post the full amount due until return funds were received and the amount totaling over $8,000.guardian mortgage has also sent me a cease-and-desist notice preventing me from properly servicing my account or being a made aware of any options available to me given the fact that I have became unemployed in the month of October. No assistance was offered to me.this made it impossible to request and receive information in a timely manner to prevent my phone from going into to any type of foreclosure.

Desired Outcome

I would like guardian mortgage to acetal past due payments minus fees. I would also like guardian mortgage to backdate the payments and credit reporting to match the date payments were received via certif mail by their company.if payments are applied to the original date received no foreclosure would have taken place on the property and no attorney fees should be applied I'm requesting that these fees be waived and the account reinstated. There's also a error in the reinstatement I received totaling over $18,000.$10,000 of that is fees that were improperly applied to the account due to improper posting of payments received

The response is incorrect due to the fact that I sent payments and certified mail that were received by guardian and we're never posted to the account not even in the my contract states that any partial payments or payments less than the full amount due will be held in suspense I was never given this opportunity. Guardian has prevented me from paying off my loans by charging me an extreme amount of fees including a year in advance and escrow. They have also charged me for future fees in my reinstatement in November they charge me the full amount of my insurance that was not paid until this year in January. I'm still able to post all past due payments with late charges. I'm asking for equal opportunity to pay off my debt and for guardian to uphold their side of the contract by accepting my payments. I will attach proof that payments were received by guardian via certified mail.

Just another predatory loan company offering you lies. Do not do business with these people. If you buy a house be ready for a ton of mail from them. Would you rather have the 4.2 APR you took out with another bank, or switch to these guys for a 6.4% APR. The fact that they have a A+ rating is just shameful of the part of the Revdex.com.

Mortgage transferred to new company; incapable of applying payments as before, despite written assurances. We accommodated this, now in collections.
My wife's any my home mortgage had been managed by Sunflower Bank for several years, with ACH payments made on the 1st and 15th of every month. We never had a late payment and were pleased. Servicing was transferred to Guardian Mortgage without our consent, and we were informed in writing that no changes in payment were needed in a letter dated 8/31/17. On 9/28/17, my wife received a phone call stating we were behind on our mortgage payment. Yet, review of our bank statement showed we had indeed paid on time. After spending about an hour on the phone and three separate phone calls on 9/29/17, my concerns were not adequately addressed by customer service employees, so I asked to speak with a supervisor. I was disconnected and had to call back to reach John ***, customer service supervisor. He told me Guardian can not accept semimonthly payments due to software limitations and that "partial payments" are held in a "suspense fund" until the total is paid for the month. Once the full payment for the month had been received, it would be applied to the mortgage. This does not allow immediate application of payments toward the outstanding principle balance. Mr. had only received notification from Sunflower Bank (now the parent company of Guardian) THAT VERY DAY indicating we had, in fact, made our 9/1 and 9/15 payments as previously agreed. He assured me that the funds would be cleared over the weekend and applied to the account, bringing our account up to date for 10/1/17. He also told me the only way to return to biweekly payments was to set up "Bill Pay" through our financial institution; despite some 50 years in the mortgage business their system could not perform twice monthly ACH payments like Sunflower did. I established "Bill Pay" the same day, feeling I had no other choice than to refinance with another lender; time was not on our side due to Guardian's negligence. As 10/1/17 was a Sunday, the first scheduled payment was sent to Guardian on 10/2/17. It has cleared our financial institution. This should have been the first half of our monthly payment for October, with the remaining half to be paid on 10/16/17 (10/15/17 is a Sunday). We received a letter on 10/6/17 from Joffre *** of the Collections Department. This letter indicates we have a "Total Outstanding Amount Due" of $1327.61 (a full month's mortgage). I have left a voicemail for Mr. and have not heard back from him. I will not lower myself to calling a collections department, as we are not, and never have been, in arrears. This is a mess of Guardian's and Sunflower's making; I feel it is up to them to resolve it. I have already committed unnecessary time and suffered unnecessary stress due to these poor business practices and lack of communication. I am appalled that Guardian has maintained a Revdex.com A+ rating with "service" like this.

Desired Outcome

1. Restoration of previously agreed-to semimonthly payments, paid on the 1st and 15th of every month, and IMMEDIATELY applied to account balance when each "partial" payment is received. These funds should not be held in any account until the remaining portion of the monthly payment is made...to do so negates the financial benefit of making semimonthly payments (no interest accrues on the paid principle for the intervening two weeks, decreasing overall costs and life of the loan). 2. No further contact from the collection department for an account that is up to date with an excellent payment history. 3. Follow-through on written assurances that "This change will not affect the terms or conditions of your loan, other than a change in your loan account number and where you submit your payment." and "If your monthly payment is automatically drafted or deducted from your bank account by Sunflower Bank - no action is required!". 4. Reasonable customer service, including prompt call backs and the ability to quickly resolve disputes such as ours. Alternatively, the mortgage may be transferred back to Sunflower for servicing and resumption of previously agreed upon repayment terms. If these are not found to be possible, we would like for Sunflower/Guardian to pay all closing costs associated with refinancing our mortgage through a lender of our choosing that accepts semimonthly payments and applies them immediately to the outstanding balance.

The servicing of the referenced mortgage loan was transferred from Sunflower Bank, N.A. to Guardian Mortgage effective 9/15/17. Guardian provides customers with six optional dates within the month to draft via ACH: 1st, 3rd, 6th, 9th, 12th & 15th. Guardian's ACH process allows for a single ACH to draft the full monthly payment scheduled for the month; therefore, Guardian is unable to perform multiple ACH drafts throughout the month. Guardian has provided the Customer as an alternative with the six optional ACH draft dates referenced above. In addition, Guardian has informed the Customer that partial payments are accepted in one of the two following payment methods: personal check and bill pay. Partial payments are placed into a Suspense account until the full scheduled monthly payment is received resulting in the application of the payment. The Customer's statement that by applying the partial payment reduces the costs and life of loan is inaccurate as the payments being provided are semi-monthly and do not contain additional funds to be applied to principal. Pursuant to the terms and conditions of the Note Section 3A & 6(A)(B) and Deed of Trust (Paragraphs 1 & 2), the payment is applied in priority order: interest, principal, escrow, and any remaining amounts due and owing and then to principal, if applicable. Additionally, Guardian has the right to return any payment or partial payment insufficient to bring the Loan current. As explained to the Customer, if the intent is to reduce the loan, Guardian suggested making principal only curtailments as making a scheduled monthly payment by remitting two payments does not reduce the cost or life of the loan. Guardian promptly addressed the Customer three separate times during the timeframe of 9/28/17 -9/29/17 concerning this issue with explanations of the 1x ACH draft as well as providing the Customer with alternative payment options. Respectively, Guardian will not transfer the loan back to the previous servicer nor will Guardian agree to paying closing costs for the Customer to refinance their mortgage.
