He claims I have no supporting documents but I do have receipts, labor and materials to back them up*** continues to say we have a contractTotal Lie! he has never once given me the proposal or estimate that we so called gave himMr Dave M*** has never worked for our company nor to our knowledge has he ever had the authority to represented us! MrM*** simply told us he bid this job for footings and foundation @(2ft walls not 6ft ) for $21,and that included Excavation, footings and foundationThats it! No garage floor, or driveway was ever discussedAs for my bill to ***It is very much legitimateThis would have been the bid had we been clear on the scope of work and the promise of an onsite general contractor! not to mention no home owner on the job!!! I have proof in the Inspectors report that the plans were incomplete and he would not tolerate nor approve the walls without the full stamped set next time we pouredthis frustration was not only our burden but the Cities as well*** can point fingers and claim lies all day long but the proof is in the voice of the inspector who inspected our great work!!! *** is now trying to back charge us for the additional work that he has to pay someone else to complete the jobFunny! he is also trying to blame the cold weather on us as he said "we pulled off his job and left him hanging" the truth of the matter is it snowed the day we took our equipment off his propertyI have sent *** a settlement to resolve this matterAnd it states that *** pays all the material and labor costs and writes Revdex.com and other sites he has written bad reviews to take out revenge on us stating were were "dishonest and played him" we would walk from all profitsHe is now claiming that our labor costs are inflated and inaccurate!!! wow we just can't do anything right with this guy! I will say all those costs are backed up by our payroll and suppliersThis is ridiculous but does show that *** had no intentions of paying us from the beginningOur attorneys did find that *** is has 65% ownership and Brittany ( Tenants in common) has 34% ownershipand does show his character as far as trust goes! go figureThe bottom line is *** does not plan to pay us even after we try to settle with himI reject all of his statements he has made and hope he will come to his senses and settle

The Home Owner kept telling us they needed  an Estimate before they could start the refinance process, and they were finding it very hard to get a contractor to give them one. So the estimator who took the lead went up to meet with them in person. Most of his estimate come from that initial...

discussion. The scope of work had doubled by the time we received his half set of plans, and the extra work was promised to be compensated! we tried to meet him in person 2 times and he shined us both times at his residence, another 2 days was waisted. Here is a shallow timeline and events that took place….... We asked Home Owner to sign our proposal but he refused to sign anything with us. The approved set of plans were never sent to us so bidding the scope of the project was not an option. The Home Owner insured us that “he would take care of us " We started the project only to help the home owner  due to the winter month’s setting in.  The day we started the Home Owner was no where to be found! We called him time and time again but he ditched us after we hauled Forms and equipment to his residence and insured us that everything was ready to go! it took nearly 2 days for him to get back to us. This was unacceptable as we only have a few good days to work due to weather and other customers that our relying on us to meet their timelines..  The Home Owner insured us that he would have a General Contractor onsite to help with questions and changes needed to start the excavation, footings and foundation…. Never once in 2 weeks did this General Contractor show up on the job! . The morning we started to work, Debris (torn down deck & junk) was laying in the work area along with a trailer and hot tub that we had to be moved, we spent more than a half day removing his stuff in order to even start the project. . Home Owner and his so called General Contractor was supposed to have everything all layout for us so we could start digging for footings, but neither one took the time to do this  and never even called to say they were not ready for us to start! Very inconsiderate and unprofessional.. We told Home Owner we needed trees taken out before we could start. 4 large pine trees, and 1 small.  He asked if our crew could take them down and cut them up…. We told him we were concrete contractors and not tree guys, and again asked where is your General Contractor??? But in order to help him out we told him we would do it for a fee. This took another day to cut down and cut the trees into small pieces and set them aside.  Again something that should already have been taken care of before we started….. Home Owner eventually responded to our calls to inform us that a full set of plans were in the garage and he would have his wife open the garage for us to get them, but as we opened the plans they were not complete and did not even have the City Stamp of approval on them. so again we called and asked him if his General Contractor had a stamped set of plans and to have him or his General please show up on the job! again no response from either of them. So now we have a full crew waiting for him to get us the full set of stamped plans so we called the City (Parks City) and asked them if we could schedule an inspection without a full set of plans…… They gave us permission to start the project without the full set.  So we dug the footing and tied the steel to engineered specs and called for an inspection. When the inspector showed up he said “ I will not accept these plans because they are not stamped nor are they complete”  but he made an exception and allowed us to pour the footings without the set of plans, and told us that work was to cease until the Home Owner provided them with a set of aproved plans and to have them on site at all times!. Notes were taken by the city and inspector on all these events. . Needless to say at this point were very frusterated with the Home Owner….. Each time we confronted him with changes consistent to our estimate he would say “we will work it out, lets just get the concrete poured before the weather turns bad” so we decided to continue work based on trust!. Because the debris from the old deck  were in our way we asked the Home Owner to have them removed so we could finish the foundation….. He then told us to have “our guy's do it and he would reimburse us".  I called a partner from Salt Lake who came all the way to Park City and removed all the trash and trees along with the excess dirt (3 or 4 loads )? not sure exactly how many. The Home Owner told him of a place he could dump the dirt but when he tried to get to drive his dump truck it was over an hour away and impossible for a dump truck to get to the top of the mountain!!! Then home owner refused to pay for it! So now we have 2 of us that have not been paid. Still more to come.. At this point we have been on this project for over a week and still no General Contractor to be seen or talk too….. . As we express our intent to pull off the job, we are threatened by the Home Owner “that if we do not continue to finish his project he will sue us"…. We decided to avoid conflict so  we poured his foundation. This was inspected and later pumped and poured…. We demanded a meeting before anymore work continued on his project, and asked that partial payment be collected..  The Home owner calls a meeting with the Salesman and our Foreman too meet him at the airport at 7am in the morning before he leaves town for work, to talk out the additional work not in the estimate! the meeting went well we thought. We came to an agreement that he would pay us more than the original estimate indicated. . That next day I hauled the excavator up to the home to back fill the following Monday. When I arrived their to drop off the equipment His wife was very distraught and accusing me of things that we should have never done! and trying to start a confrontation. I figured she was under a lot of stress so I just walked away.. That Monday our crew returned to backfill the foundation and just as we were getting ready to backfill the "so called" the General Contractor showed up and told us that we needed a roller compactor on all his jobs!  and if we were not going to use one he would have his guys do it. I told him it would be better for his guys to do it his way… and we packed up left the job. He then went on every site he could and left as much feedback as he could to hurt our company and slander our names. To this day the Home Owner refuses to pay for the materials, laborers, pumps, etc…….. I have been in this line of work for over 25 years and I have never met someone who takes advantage of people and lies to them so they can get something for nothing! it’s very very sad!            Sincerely:  Curt G[redacted]                      Vice President: Guest Brothers Concrete Inc.

Complaint: [redacted]
I am rejecting this response because: All of my statements have been backed up with documentation supporting.  Something Mr. Curt G[redacted] has yet to do.  In response to his statements below: My response will follow each of Curt G[redacted]s statements in CAPS, we have had a conversation sense this was received and it is interesting as much of what he said verbally contradicts what is written below.I am tired of responding to this guys lies! He claims I have no supporting documents but I do have receipts, labor and materials to back them up. IF HE DOES HAVE RECEIPTS I HAVE YET TO SEE THEM, AND HE HAS HAD OVER TWO MONTHS TO PROVIDE THEM.  I HAVE PROVIDED DOCUMENTATION OF WHAT G[redacted] BROTHERS CONTRACTED THE JOB FOR AND WHAT THE SCOPE OF THE PROJECT WAS. [redacted] continues to say we have a contract. Total Lie! he has never once given me the proposal or estimate that we so called gave him.  NOT ONLY HAVE THE CONTRACT PRICE PROVIDED BY DAVID M[redacted] WHOWAS HIRED BY G[redacted] BROTHERS TO REPRESENT THEM BEEN PROVIDED DIRECTLY TO CURT G[redacted] BACK ON 11/16/2016 (SEE PREVIOUS ATTACHED DOCUMENTATION), IT HAS ALSO BEEN PREVIOUSLY ATTACHED TO THIS Revdex.com CASE INCLUDING ORIGINAL CORRESPONDENCE, BID AGREEMENT AND FULL SCOPE OF WORK Mr Dave M[redacted] has never worked for our company nor to our knowledge has he ever had the authority to represented us!  AGAIN NOT A TRUE STATEMENT, NOT ONLY DO I HAVE THE MESSAGES RECEIVED FROM CURT G[redacted] TO WORK THROUGH DAVID M[redacted] ON ALL ISSUES REGARDING MY PROJECT.  CURT G[redacted] SPOKE TO ME JUST OVER A WEEK AGO IN A CONVERSATION I RECOREDED AND EXPLAINED THAT THEY HIRED DAVID M[redacted] AS AN INDIPENDANT CONTRACTOR TO REPRESENT THE COMPANY ON THE BIDS AND ORGANIZING THE PROJECT.  AGAIN REFERR TO THE DOCUMENTS PROVIDED IN THIS CASE Mr. M[redacted] simply told us he bid this job for footings and foundation @(2ft walls not 6ft ) for $21,000.00. and that included Excavation, footings and foundation. Thats it! No garage floor, or driveway was ever discussed.   NOT TRUE PLANS FOR THE FOUNDATION/FOOTINGS/EXCAVATION HAVE NOT BEEN ALTERED SENSE THEY WERE COMPLETE IN JUNE OF 2016, ENGINEER AND ARCHITECT CAN BOTH VERRIFY THIS.  INITIAL BID WAS FOR $21,300 PER DOCUMENTS I HAVE PROVIDED AND THAT INCLUDED THE DRIVEWAY PER THE SCOPE OUTLINED AND VERRIFIED IN THE EMAILS. THIS BID THEN DROPPED TO $15,981 PER THE DOCUMENTS WITH THE ADDITION OF $500 ADD FOR TREES TOTALLING $16,481.  AGAIN ALL DOCUMENTED WITH MY COORESPONDENCE WITH DAVID M[redacted] THAT WAS PROVIDED TO CURT G[redacted] UPON HIS REQ[redacted] ON 11/16/2016 As for my bill to [redacted].... It is very much legitimate. This would have been the bid had we been clear on the scope of work and the false promise of an onsite general contractor! not to mention no home owner on the job!!! AGAIN PER COORESPONDENCE G[redacted] BROTHERS WAS NOTIFIED A WEEK PRIOR TO BEGINNING WORK THAT NO ONE WOULD BE ON SITE FOR THE FIRST WEEK AND THEY CHOSE TO PROCEED. DOCUMENTATION ALSO WAS PROVIDED THAT THE GC WOULD NOT BE ONISGHT BUT AVAILABLE FOR ANY QUESTIONS, THERE ARE PAGES OF COMMUNICATION BETWEEN DAVID M[redacted] AND GC (EARL S[redacted]) GOING BACK AND FORTH WITH COMMUNICAITON.  I have proof in the Inspectors report that the plans were incomplete and he would not tolerate nor approve the walls without the full stamped set next time we poured. this frustration was not only our burden but the Cities as well. [redacted] can point fingers and claim lies all day long but the proof is in the voice of the inspector who inspected our great work!!!  YES AS DOCUMENTED IN PREVIOUS MESSAGES THE COUNTY BUILDING DEPT ACCIDENTLY TOSSED FIVE PAGES OF THE STAMPED PLANS THIS WAS DOCUMENTED IN COMMUNICAITON BETWEEN G[redacted] BROTHERS, MYSELF AND EARL S[redacted] (GC) AS SOON AS WE WERE NOTIFIED.  UPON GETTING ASKED IF PAGES WERE MISSING FROM THE STAMPED SET I IMMEDIATELY EMAILED G[redacted] BROTHERS AN ADDITIONAL COPY TO HAVE THERE ON THE SITE LETTING THEM KNOW THERE WAS A STAPLES ½ MILE AWAY IF THEY NEEDED PRINTING.  FULL STAMPED SET WAS ON SITE TWO BUSINESS DAY LATER UPON MY ARRIVAL BACK AND PRIOR TO FOUNDATION BEING POURED [redacted] is now trying to back charge us for the additional work that he has to pay someone else to complete the job. Funny! he is also trying to blame the cold weather on us as he said "we pulled off his job and left him hanging" the truth of the matter is it snowed the day we took our equipment off his property....  IN MY DOCUMENTED COMMUNICATION WITH DAVID M[redacted] THEY CHOSE TO LEAVE THE JOB SITE EVEN AFTER I OFFERED AN INCREASED PRICE OF $20,000 FOR THEM TO COMPLETE THE FULL SCOPE OF WORK.  DAVID M[redacted] AND CURT G[redacted] WERE BOTH GIVEN NOTIFICATOIN AND AMPEL TIME TO AGREE TO COMPELTE THE WORK AS AGREED AND WERE ALSO NOTIFIED THAT I WOULD DEDUCT THE COST TO COMPLETE FROM THEIR INITIAL BID PRICE.  THEY LEFT THE JOB AND NO COMMUNICATOIN FROM THEM FOR OVER A MONTH TIME UNTIL THE END OF 2016 I have sent [redacted] a settlement to resolve this matter. And it states that [redacted] pays all the material and labor costs and writes Revdex.com and other sites he has written bad reviews to take out revenge on us stating were were "dishonest and played him" we would walk from all profits. He is now claiming that our labor costs are inflated and inaccurate!!! wow we just can't do anything right with this guy! I will say all those costs are backed up by our payroll and suppliers. This is ridiculous but does show that [redacted] had no intentions of paying us from the beginning. Our attorneys did find that [redacted] is has 65% ownership and Brittany ( Tenants in common) has 34% ownership. and does show his character as far as trust goes! go figure..... The bottom line is [redacted] does not plan to pay us even after we try to settle with him. I reject all of his statements he has made and hope he will come to his senses and settle.  YES THE SETTLEMENT INVOICE WAS RECEIVED AND IT IS FOR AN AMOUNT OVER THE BID COST OF THE JOB WHEN LESS THAN 50% OF THE SCOPE WAS COMPLETE AND THERE WERE MANY ERRORS IN G[redacted] BROTHERS WORK THAT HAVE LED TO INCREASED COSTS
