First and foremost, our company sells diesel conversion services, not enginesThis customer (young kid) originally contacted our company asking about our conversion services; not purchasing an engine (we state all over our website that we do not sell engines)After putting together pricing for a conversion for him, he declined citing money constraintsHowever, over the course of several weeks, we exchanged dozens more emails and calls from him all the while, our tech support department tried to answer every conceivable question/concern he had with the processA few weeks later, we happened to come across a few used engines at auction and in purely an effort to help this kid out, we offered to sell him a used engine and transmission that he could use on his conversion projectHowever, we were 100% crystal clear from day one that we are not providing technical support, installation help, or any support of any kind Once he paid for his engine, we promptly packaged everything up and had it ready to ship out to the customerHowever, when we called him for payment on the freight shipping, he said he didn't have the money to ship his engine because he had spent everything he had on it and he didn't have any room to store it at the momentSo, he asked us to hold onto the engine for a week or twoWell, this charade literally went on for over MONTHS (not a typo)! We bugged him almost every week by sending him emails pleading with him to get this engine out of our shopWe even sent him emails stating that we would not be responsible should anything happen to it as we lack the room inside our facilities to store it any longerAfter months of his engine being stored here and him doing nothing about it, we had a theft in the storage rack behind our facility and his transmission was stolenWe notified him and filed a police reportOnce he found out his transmission was stolen, we notified him in writing that he officially get the engine out of here or he would be forfeiting it as we did not want the responsibility any longerOn July 8th, (nearly months after he purchased the engine) he finally sent us a check for the freight shipping and we shipped his stuff outHe called us a week later saying that some plastic covers and a water pipe was apparently damaged in shipping and wanted help in getting an insurance claim startedThe problem was, he had signed for it already so there was absolutely nothing we could do as the document he signed from the freight company contains a waiver which states that the engine showed up ok and holds harmless the freight companyBut despite all this, and again in an effort to help the kid out, we at our own expense to the tune of $250+, purchased and shipped to him the parts he claimed were damagedWell, unfortunately it didn't end thereHe began sending us emails asking technical questions, installation questions, and miscquestions on his project saying that if we didn't help him he was going to post a negative review of our company onlineAt this point, we had had enough of thisThis kids complaints are completely false, unethical, misleading, and he has used this very complaint at the Revdex.com as an attempt to extort our company and tarnish our nameWe have since contacted the authorities in his state and are working with detectives there regarding prosecuting him for online extortion and will be pursuing this to the extent of the lawTell us why here

This will be our final response to this matter and we consider this issue closedThe date of original sale was over a year ago so we had to go through our records to find all this stuff but anyone following along wont be disappointedWe have asked the customer to provide actual written proof (not conjecture) to back up a SINGLE claim and have received NOTHING from themWe, however, have attached all written invoices to this responseThe first is the original invoice dated January 14, The second is the invoice for the shipping dated June 27, (or approx months later for those following along)If the engine didn't sit here for months, what did we ship in July? We also attached the shipping bill of lading dated July 27th, (yes it took almost a month to actually get paid for the shipping as he claimed the check was lost in the mail and we got the emails to prove it)Finally, several back to back emails supporting % EVERYTHING we have stated in our previous response to this issueIf this documentation doesn't prove unequivocally that this customer's story is completely untrue, nothing willThe real tragedy, is that the Revdex.com will not deem this complaint invalid and not allow it to post up and tarnish our good name with this nonsenseThere is no resolution to this matter as this customer is irrational, dishonest, manipulative, and the documentation that we have provided prove it beyond a shadow of a doubt

Be advise that Diesel Toys, LLC, and its agent Todd H***, have been named defendant in a civil lawsuit in Bexar Court, Cause #: *** for violation under the Texas DTPA and committing fraudAt this time, Todd H*** so claimed that he was filing for bankruptcy but his advertisement on his Facebook page is heavily soliciting for new businessMr H*** held my vehicle since June of which he was paid in full $27k, but began to fraudulently add on addition unauthorized workThrough Dec till January he attempted to extort additional $3.5k to $8k before I had retained legal counselAs of today, my vehicle was extracted from Mr H*** via professional recovery service and is now being inspected by my underwriter and Toyota DealershipI have pictures that would alarm you to the condition he has left my vehicle in and I am convince he is doing this to othersThis is not work of a Master ASE technician
As of today his rating on creditsafe.com is a D for international trade and it appears he cannot manage the business’ capital properly to complete his projectsIn addition, as according to yelp.com, he claims that he and his staff are master ASE techniciansAs per his silence in not providing the court a response, he has admitted that this is false, which is now clearly a deceptive act by advertisingI also accuse of him stripping parts off of my vehicle to full fill other projects in order to keep the lowest profile of his deceptive trade

I am rejecting this response because:Most of this is simply not true. I could argue back and forth about all these things that were supposedly said, and how they convinced me to buy this engine from them in the first place. But that is just a he said/she said situation, so I will just stick to the facts that are documented.I don't even know where to start, but why did they say I am just a kid? I am not sure what that was supposed to mean, but for the record, I am a 36 year old adult male with a career and a family. I don't know why this would all be ok if I was a "young kid".In an email from diesel toys, they say they got my check for $10,000 on January 13. The first mention that they wanted the engine out of their shop anytime soon was in an email dated March 3rd. I sent all my information to have everything shipped to me in an email dated march 29th. This is all documented in email records. They had previously told me the engine could sit there as long as I needed as long as they got payed. (it was absolutely not "7 months" like they stated.) it was in fact exactly 26 days. They didn't ship it for some time after, because I paid them extra to install a new timing belt and water pump. They told me they were waiting on the parts to complete that. The engine was delivered damaged. I assumed from shipping. I asked diesel toys for photos of the engine to show the shipping company, so they would cover what they damaged during shipping. Diesel toys sent me photos of a different engine than what was shipped to me, (This is all documented through photos and email) and they got angry when I asked them about it.  They said I was wrongfully accusing them of something. They still have not admitted this. When I asked them how much the engine was insured for with the shipping company, I was told repeatedly that they paid for extra insurance but I confirmed with the shipping company that no insurance of any kind had been purchased. The response from diesel toys said that my "complaints are false". What is false?I payed them $10,000 for a complete engine, manual transmission, and transfer case. I received an (almost) complete engine, without a transmission or transfer case. This is a documented fact as well as the other notes made above. I have paid to diesel toys a total of $10,595 and it seems they have no intention of returning any of that to me. That is fine, but until they can get me a manual transmission and transfer case that mate to this engine, it is useless. Or if they can find me a bellhousing and clutch kit that would allow me to use this engine with my current transmission and refund me for the transmission and transfer case that I never received. This is a lot of money to anybody. I was willing to pay it for the best engine money could buy, but I can't afford to have a useless chunk of metal because it didn't come with all the parts I paid for. I would not have bought this engine at any price had I known that it would be without a transmission or transfer case.I have no desire to "tarnish" the good name of any company. I contacted the Revdex.com because, well, read the above. I can't see how anybody could think that I'm not getting screwed over here at this point. But like I said, I don't want to hurt any company, especially if they are honest. I just want what I paid for. I even offered to take a loss on this so I could just move on with my life. I have not spoken with anybody else other than the Revdex.com about this matter and have never posted anything online anywhere about anything to do with diesel toys.They said I am attempting to extort their company? How is that? Remember how I paid them over ten thousand dollars? I held up my end of the bargain. They already got paid. How is that extorting them? It seems more of the other way around to me.Did they really say that they hired a detective to try to prosecute me for internet extortion???? That is insane. I don't even know what to say to that. I would love to talk to a detective about this. The facts are very clear. They got their money, I didn't get my product. I could not be further from an internet thief. I work as a carpenter. My life is very open and honest and transparent. To be honest this is so frustrating at this point. I don't know what else to say. I don't understand why companies or people at them, try to screw over an honest working person, just for a little money. What is to be gained by that?  I am trying to not get personal about any of this and I do apologize, but I think any third party reading this information would have to agree that this is pretty insane, and that my reaction is at least understandable.
