Thank you for the opportunity to respond to the complaint belowThe organization understands from Project Manager, [redacted] you have decided to cancel your contract with our companyWe do not have a cancellation notice from you in hand which means technically you are currently in breach of contract.After having in depth discussions with your Project Managers [redacted] and [redacted] ; this is our understanding on what took place in regards to your project:After signing the contract on 4/your ***eline changed; went from no hurry (Fannie Mae guidelines prevented you from moving from your current home until August 15th) to hurry up and get the job finished because you needed to move into to the new home right away.The payment schedule spelled out in the contract was as stated:1/Down1/Start (You did not pay this portion until approximately weeks after start)1/Completion1/x is industry standard and is typically weeks before start date from contract signingIssues that took place consisted of delays on the City of Webster Groves during the permit review phase, the early move in which slowed down production, changes to the scope; addition of electrical work, plumbing, and water heater that were not in original contract.The only "project ripped down" was a hallway opening which we raised at your request at no chargeWe had a trailer scheduled for trash, but you or your husband ordered a bagster on your ownThere was no place for a dumpster.Furthermore, you wouldn't allow us to complete the job and according to conversation between Project Manager, [redacted] and the subcontracting crews, you are using our subcontractors to complete your job, to us, that looks like collusion with the subs.Please understand, respectfully, as a company we vigorously defend our personal reputationTherefore posting of of untrue statements, in any form about Gundaker Construction and Restoration Group will subject you to a suit for libel/slander which our attorney will seek the maximum monetary damages as well as equitable relief in the form of an injunctionPlease let me know how you would like to realistically handle the situation because your desired settlement posted on the Revdex.com will not be grantedIf you requested a meeting with ownership, members of this company were not awareOur priority is customer service, so we are able and willing to meet you half way to find a fair settlement for both parties and or finish the project Sincerely,Gundaker Construction and Restoration Group

Dear [redacted] and Revdex.com of EMissouri, I believe my email response to Ms [redacted] explained everything in detailWe took this job on for Ms [redacted] as a courtesy to a family friend and were not making anything to begin withMs [redacted] ignored multiple attempts, phone calls, etc to rectify any issue and we were willing to go above and beyond for her (which we did to begin with) like we do for every customerThe Gundaker name has been serving StLouis since and is known for top tier customer service and treating people rightThis is why my company, Gundaker Construction averages over jobs per year and has never had a complaint on any online portal until Ms [redacted] complaint to the Revdex.comThe reason I have stopped going out of my way for Ms [redacted] is her complaint was and malicious in nature and she tried to harm the reputation of Gundaker Construction and the Gundaker nameI feel this has a become a much bigger issue than her faded siding which is obviously out of our controlI am looking for Ms [redacted] to pay her final balance at her earliest convenience and I am looking for the Revdex.com to remove this complaint because it's untrue and harmful to our reputation Sincerely, [redacted]

RE: [redacted] : # [redacted] Thank you for allowing us to respondThis is very disappointing since we pride ourselves on top tier customer service and have never had a complaint, not only on the Revdex.com but any online information portalPlease consider this Gundaker Construction's rebuttal to the above referenced complaint as well as the letter received stating that “Our Company indicated to the homeowner that the only way we would resolve the issue is if she had her complaint removed”.Ms [redacted] came to our organization in August of after she had a falling out and subsequently filed a Revdex.com complaint with another contractor regarding a roof replacement which resulted in damage to her sidingShe also had a huge concern as to the craftsmanship of the roof installationI, [redacted] , inspected the install of the roof as well as met with the other contractor on several occasions to resolve a couple of install issues on the roof at no cost to Ms [redacted] , merely as a gesture to assist her in finding a resolution to her issue.We, Gundaker Construction then entered into a contract to replace the damaged siding as well as one overhead door on her homeThe scope of work on the siding was to replace the right elevation on her home and utilize approximately pieces of the old siding that was still in good condition and replace some damaged pieces on the left elevation and rear elevation at the open deckDuring the replacement of the siding on the left and rear elevations, it was determined that due to the fade factor the siding was not going to match at allThis was unforeseen and impossible to expect however, in the interest in good customer relations, Gundaker Construction replaced the left elevation of siding at no cost to Ms [redacted] (no cost for material or labor).She, Ms [redacted] , stated that we could use the siding from the left elevation to replace the pieces on the rear as the sun did not hit those areas as much and the fade factor would be substantially lessOnce all this work was completed, she decided that she in fact still did not like the matchIt was at this point that communication broke downOver a period of months, calls were not returned by Ms [redacted] to Gundaker Construction, in fact it was only when we sent her a balance due invoice did she open the line of communication with usWe went as far as stopping by her home, hoping that she would be there so we could follow up and discuss the situation.At this point, ownership was involved in the communication with Ms [redacted] and all efforts to satisfy her were in vainWe offered to replace the rear open deck area siding at no cost once again to Ms [redacted] to which she acceptedIt was after our resolution was offered to Ms [redacted] that Gundaker Construction was notified of the Revdex.com complaintWe informed Ms [redacted] that she needed to have the complaint removed, as we had reached a resolution to the situation and her complaint was in fact inaccurate, malicious, and manipulative, and false, in nature.The complaint remaining on our profile is in my opinion a gross miscarriage of the Revdex.com system as well as an inaccurate depiction of our organizationThe Revdex.com is to protect consumers, not to be used as a resource for Ms [redacted] to strong arm contractors she works with into getting free work done on her homeIn our research, we have multiple sources that say Ms [redacted] is a serial complainer, and unable to be made happyYou can go as far as finding articles online about her complaining to the City of Wildwood about kids playing in the street! I am reaching out to you this morning per your suggestion to assist in mediation with this contractor.  Please read the chain of emails below.  You will see in the highlighted area I have attempted a settlement with Mr. [redacted].  His response is detailed as well.  He sent the invoice again indicating he wasn’t will to address the pending issues to bring the [redacted]er to a close.  His demand is payment or he will put a lien on my home.   Mr. [redacted] may be entitled to state the facts in his long dissertation but using creative and alternative facts as detailed below he is not.  Rather than give you an equally long version of the events as I seem them, minus the personal attacks he detailed, I prefer to move to settlement.  I have attached for you the offer he provided for me that I accepted via text.  As you will read through the exchange of texts I did exactly what he asked of me, including his request to remove the Revdex.com claim. I performed that task promptly and copied Mr. [redacted] on the email the same day he asked for it and I sent it to [redacted] Revdex.com cus[redacted]er service representative. As you know now through our discussion, I reached out to you as a senior ranking member of the Revdex.com, Director of Operations for 10 years with the organization to understand why the contractor was upset.  I learned through your explanation that checking the box on the form that the claim was withdrawn at the request of the contractor as a means of settling the dispute au[redacted]atically put it on his record for 36 months. I advised you that Mr. [redacted] did not tell me that would be a ramification.  I implored you to remove it and you detailed it was Revdex.com policy. I think you would agree I was persistent with you in my request without success. You stated it is the Revdex.com’s policy and no one could remove it at any level within the organization that I sought to reverse this decision.  I did not know this would occur, I am certain Mr. [redacted] wasn’t aware either of this policy or he would have instructed me not to check that box. I made several calls to him yesterday which he would not take.  In addition I sent follow up text messages asking to bring the situation to a close.  He responded that he could not speak to me and I have yet to hear from him.   My offer is as follows:Sub-contractor for Gundaker needs to return to secure the siding that is loose from the contracted work.  I can meet them on site and show them.  Once completed Gundaker transfers the warranty to the subcontractor so that I may work with them in the future for any warranty [redacted]ers.  Provide the warranty for the garage door and the lien waiver.  I in return will provide a cashier’s check in the amount of $1595.10 at the time of the exchange at my home. You will see this is an additional compromise on my part from the original settlement he offered in the text. (see attachment)  His offer was to include two boxes of siding AND the labor to complete the remaining unfinished work.  To put the [redacted]er to rest promptly I will compromise on that ask.  This will be a significant expense to me, but I will absorb it.  This is my only offer.  My attorney advised it would not be prudent to settle the remaining balance if contracted work has issues and he felt confident knowing the Revdex.com’s corporate mission and philosophy that would not be your recommendation either.  I am sure one hour on site will resolve the pending [redacted]er. If Mr. [redacted]’s doesn’t accept this offer he can move forward with the lien.  To confirm I can then add to the Revdex.com complaint that a lien was put on my home for $1595.10 and the Revdex.com will detail Mr. [redacted] through the Revdex.com’s efforts was unwilling to bring the [redacted]er to a close amicably. All of the detail will be public record, correct?  By the same token, if he agrees, I am willing to state on the Revdex.com file the claim was resolved to my complete satisfaction.  Therefore negating any negative impact it may have on consumers performing due diligence when researching Gundaker Construction.   I appreciate your efforts in advance to assist in doing what the Revdex.com does best. This is why my company, Gundaker Construction averages over 300 jobs per year and has never had a complaint on any online portal until Ms. [redacted] complaint to the Revdex.com. The reason I have stopped going out of my way for Ms. [redacted] is her complaint was false and malicious in nature and she tried to harm the reputation of Gundaker Construction and the Gundaker name. I feel this has a become a much bigger issue than her faded siding which is obviously out of our control. I am looking for Ms. [redacted] to pay her final balance at her earliest convenience and I am looking for the Revdex.com to remove this complaint because it's untrue and harmful to our reputation.  Sincerely, [redacted]

to the above referenced complaint as well as the letter received stating that “Our Company indicated to the homeowner that the only way we would resolve the issue is if she had her complaint removed”.Ms. [redacted] came to our organization in August of 2016 after she had a falling out and subsequently filed a Revdex.com complaint with another contractor regarding a roof replacement which resulted in damage to her siding. She also had a huge concern as to the craftsmanship of the roof installation. I, [redacted], inspected the install of the roof as well as met with the other contractor on several occasions to resolve a couple of install issues on the roof at no cost to Ms. [redacted], merely as a gesture to assist her in finding a resolution to her issue.We, Gundaker Construction then entered into a contract to replace the damaged siding as well as one overhead door on her home. The scope of work on the siding was to replace the right elevation on her home and utilize approximately 15 pieces of the old siding that was still in good condition and replace some damaged pieces on the left elevation and rear elevation at the open deck. During the replacement of the siding on the left and rear elevations, it was determined that due to the fade factor the siding was not going to match at all. This was unforeseen and impossible to expect however, in the interest in good customer relations, Gundaker Construction replaced the left elevation of siding at no cost to Ms. [redacted] (no cost for material or labor).She, Ms. [redacted], stated that we could use the siding from the left elevation to replace the pieces on the rear as the sun did not hit those areas as much and the fade factor would be substantially less. Once all this work was completed, she decided that she in fact still did not like the match. It was at this point that communication broke down. Over a period of 3 months, calls were not returned by Ms. [redacted] to Gundaker Construction, in fact it was only when we sent her a balance due invoice did she open the line of communication with us. We went as far as stopping by her home, hoping that she would be there so we could follow up and discuss the situation.At this point, ownership was involved in the communication with Ms. [redacted] and all efforts to satisfy her were in vain. We offered to replace the rear open deck area siding at no cost once again to Ms. [redacted] to which she accepted. It was after our resolution was offered to Ms. [redacted] that Gundaker Construction was notified of the Revdex.com complaint. We informed Ms. [redacted] that she needed to have the complaint removed, as we had reached a resolution to the situation and her complaint was in fact inaccurate, malicious, and manipulative, and false, in nature.The complaint remaining on our profile is in my opinion a gross miscarriage of the Revdex.com system as well as an inaccurate depiction of our organization. The Revdex.com is to protect consumers, not to be used as a resource for Ms. [redacted] to strong arm contractors she works with into getting free work done on her home. In our research, we have multiple sources that say Ms. [redacted] is a serial complainer, and unable to be made happy. You can go as far as finding articles online about her complaining to the City of Wildwood about kids playing in the street!  She can not be made happy, and everything bothers her! Had we not addressed this situation we would not be disputing the complaint. In this situation however, Ms. [redacted] is getting 3 times the amount of work she contracted to have completed AT NO COST TO HER. Who protects the contractor from these types of situations? Clearly the information the Revdex.com has received is jaded and self-serving to MS. [redacted]. Ownership has decided that due to Ms. [redacted] using the Revdex.com to strong arm them to do additional free work, and the Revdex.com posting the inaccurate, malicious, and manipulative, and false,  complaint about Gundaker Construction, Gundaker will not push to find a resolution, and be placing a lien on her home for non-payment and filing a lawsuit in St. Louis County Court because this is defamation.Sincerely,[redacted]Quality Control Manager[redacted]Owner/Director of Operations[redacted]
