Thank you for contacting us regarding a customer’s concern with a business transaction. The ID of [redacted] was assigned to this matter.  The member above joined on 9/17/2015.  The member agreed to a 12 month contract, in return for a waived join fee (normally $150) and free dues for...

September and October.  If the member decides to terminate before the contract is up, they will incur a $150 early termination fee.  This would have put the member under contract through October 31, 2016.   **(Please see “Sept Spec Cont attachment”)** In the complaint, the member stated that she tried to suspend her membership due to health reasons, but was told she could not be accommodated due to the contract.  That is not our policy.  We do allow medical freezes (if the account is under contract or not), but we do require a doctor’s note for a medical freeze.  The membership freeze policy is clearly stated on the contract **(please see attachment [redacted] contract 3 pgs- on page II of III of the contract item #10 MEMBERSHIP FREEZE)**, which the member initialed.  We were never sent a doctor’s note for the member, as a result her account was never placed on freeze. We offer specials to existing members throughout the year.  In January 2016, we offered a “Contract Extension” where if members would like a free month (no dues charged for 1 month) they could extend their existing contract for 12 months in return for the free dues.   At this point, the member was still under contract and decided to take advantage of the special, and signed a contract extension that stated: “I understand that by signing this 12 month contract extension to HealthWorks Wellness and Fitness Center I am obligated to pay monthly dues for the entire 12 months (in addition to any current obligation I may have.)  At the end of my 12 month contract extension I will remain on a month to month commitment, my membership will not automatically end.  If I choose to cancel my membership at that time I will still be required to give a 30 days notice prior to the first day of the month.  However, if I terminate prior to the end of the 12 months, I will owe a $150 early termination fee.    I also understand that by agreeing to stay for an additional 12 months, I will receive free dues for the month of February.  My contract will start on March 1, 2016 and will run through March 1, 2017.   **(please see attachment [redacted] contract ext)** As a result, 12 additional months were added to her contract, and she received a free month of dues.  This was an optional special- and certainly not required.  The member was charged monthly dues, with no issue until December 2016.  In December of 2016, her monthly dues bounced, and as a result she was charged a $25 fee.   In the contract it states the following: **(please see [redacted] contract 3 pgs—page III of III  number 4 MEMBER OBLIGATION)** Member Obligation: Failure to use the facilities will not relieve the Member of the obligation to pay the monthly dues during the month term, or monthly renewal of the contract.  If for any reason, my bank or credit card does not honor any membership draft, I understand that I am responsible for said payment, plus a penalty free payable to the center (currently $25).
