I have reviewed the response made by the business in reference to complaint ID ***, and have determined that this does not resolve my complaint. For your reference, details of the offer I reviewed appear below.As I stated in the original complaint the estimate was divided into two parts regarding a beech tree in my yard: 1) "Limb growing over house with large crack and rotten spot, pruned back to reduce stress on weak part of trunk" ($650.00). I stated in the complaint that this was NOT the issue thus I'm unclear why Independent Tree spent much of their rebuttal citing work which I stated in the complaint was done to satisfaction. As Mr *** is satisfied with this portion, this charge should be of no issue
The complaint identifies the second part of the estimate. More specifically,
2) "Deadwood 1" and larger pruned out of Beech tree canopy" ($75.00). THIS is the problem as there are still dead branches in the tree yet that was not addressed in the rebuttal Please note the rebuttal was in response to this part of the complaintThe ISA certified arborists on site performing the work left limbs that had some green (signs of life) at the time as indicated in the email. The tree had substantial wounds and damage to it that is going to continue to cause die back of branches. As can be seen in the photos, this tree looks nicely cleaned out of deadwood, with very little remaining on 10/3/2016, weeks after performing the work
Also: A) Although the rebuttal states that Independent Tree put down dirt and seed to repair the ruts they caused to my lawn...NO dirt and NO seed were ever put down and the ruts remain; Dirt & seed were put down on 8/25, as stated in our response this rut is “on an incline and was likely washed out”. We are willing waive the $charge for the 2nd part of this work scope, as that would more than cover any expense to repair/re-seed this in
B) Although Independent Tree states they left messages for me in order to discuss the issues I identified I NEVER received any phone messages on this matter; We are sorry that Mr *** did not receive any of our messages, but our records do indicate these multiple attempts
C) Although Independent Tree asserts they told me a bucket truck would be driven into my yard I can find no mention of this in any of the e-mails. However, even if they had provided that information I am unclear if that is a justification for leaving ruts in my yard; and D) The rebuttal states that my online payment didn't go through. I am unclear about this issue as I made no payment as the complaints I made to Independent Tree on 8/21/were never fully addressed and I have been waiting for them to either correct these issues or make a financial adjustment. Finally, yes, I remain unclear why Independent Tree was trimming my neighbor's tree. I reside in a duplex and Independent Tree and has a history of providing work to those residents. It is through those neighbors that I learned of this company. And regarding the fertilization...that was suggested for the fall and my e-mail response was that I would talk to Independent Tree in the fall about that optionWe did go back & make additional cuts and repairs as indicated in emails & phone calls, Mr *** was made aware that we would be on his property. Quickbooks indicated a pending online payment on the account shortly after & having heard nothing more from Mr *** since we went back, we laid the matter to rest. As is clear in the pictures of the trees right next to each other, we remain unclear how the 2nd tree that received additional pruning is not on Mr***s property, however regardless of this the additional work does directly benefit Mr***s property given these branches hung over his property

1) Yes, I am in agreement with the fee of $for estimate # With the 8% sales tax the total is $ I will write a check for that amount 2) Although I requested that Independent Tree remove all deadwood I see their response of "this tree looks nicely cleaned out of deadwood, with very little remaining...." I requested that all deadwood be removed and there is definitely deadwood remaining I am in agreement of deducting the fee of $for work that was not completed 3) Although Independent Tree insists that they put down dirt and seed on 8/25/that was never done The response that it was "likely washed out" is ridiculous as no repair was ever done and the damage to both the tree lawn and my yard remains I have explored the option of filing a small claims case in *** *** Municipal Court; however, at this time I would like to be done with all business and all communication with this company 4) I continue to hold that despite Independent Tree insisting that they left multiple phone messages attempting to rectify my concerns...I received none

I was able to get to [redacted]'s property with one of our certified arborists to take some photographs.  I also gathered up some more information from our office...

& sales rep.
Please see our response below:
8/17 Our crew was on [redacted]'s property to do his tree work at
3361 Lansmere Rd
[redacted] Hts, OH 44122
There were 2 ISA certified arborists on the crew.
In an email dated July 18, Alan (the sales rep & an ISA certified arborist) indicated that since this tree is struggling, "I would like to leave as much green as possible to maximize photosynthesis capacity."  He also stressed that "This would have to be decided by the arborist performing the work."  Alan also recommended that the tree should be fertilized , which Mr. [redacted] declined.  As you can see in the pictures, this tree has some substantial wounds.  We were hired to mitigate the hazards, which we did.  The certified arborist that was performing the work made an educated call when deciding what to prune out & what to leave to help the tree in photosynthesis.  The tree as indicated in Alan's email could "use a extra hand" and would benefit from fertilizer, especially with the summer drought, this tree has continued to have some die back since we performed the work on 8/17 & when I took the photographs on 10/3 and will likely continue to. 
This work was performed to ANSI standards by 2 experienced certified arborists on a 3man crew with a bucket truck to satisfaction of the work bid.
8/21 we received an email complaint from [redacted], which I will forward.  We tried to call him back & left messages, but received no response.
8/22 We sent someone out ([redacted], ISA certified Arborist) to as the complaints addressed in [redacted]'s email.  [redacted] took photographs and concluded the issues were minor and we could send someone out to address this the next day.  *See attached photographs of the sidewalk marks & "ruts" [redacted] took this day.  [redacted] pruned out the small broken branch and as you can see from the picture attached you can't even tell where it was.

8/23 We sent an email to [redacted] with no response.  We called to make sure we can send a guy out to address this & received no response.
8/24 We sent another email to let him know we could be there the next day and make sure that would be okay (quoted below)

We had one of our arborists at your property yesterday to as what needs to be done & take some photographs.  While he was there he did prune out the small broken branch on the tree lawn.
We are planning to be in [redacted] tomorrow & should be able to have a guy from that crew come over to scrub out the small skid marks on the sidewalk & seed in grass.
In regards to the dead wood on the Beech, that tree was pruned & the climber additionally took out some dead on the neighboring tree that he could reach, however our guy will come out with a pole pruner to do some additional pruning.

As you can see from the attached photographs these trees are right next to each other, almost to the point of being a double trunk tree & appears to be on the same property.  That extra dead wood was pruned out as a courtesy and will benefit [redacted]'s property.

8/25  We sent a guy back to scrub out the tread marks/mud. We had received rain the 13th, 14th & 15th.  I have attached photographs of the concrete both before we cleaned it up on 8/22 & on 10/3 when I took the photographs.  This employee did prune out a couple additional limbs while he was there to appease [redacted]. He also brought top soil and grass seed and repaired the rut.
We let [redacted] know we were on his property and what we did to fix his complaints, we again were unable to reach him & received no response.
After 8/25 our bookkeeper let us know that there was a pending payment online on [redacted]'s invoice.  We assumed at that point that he must have been satisfied.
9/30, Friday after reviewing our monthly statements, we realized that [redacted]'s payment never did go through & appeared to be revoked.  Our book keeper called [redacted] and left a message that the online payment that was pending did not go through & if he could please remit payment at his earliest convenience.  We still did not receive any response from [redacted].
10/3 Following our bill inquiry call on 9/30 the first thing we heard from [redacted] in over a month was this Revdex.com complaint.
10/3 I went To [redacted]'s to look at his property again & take pictures following this complaint.  I was informed that his yard had a lot of pre-existing issues prior to our work.  While there I was unable to decipher what damage [redacted] was referring to & called [redacted] who had looked at the damage on 8/22.  [redacted] was able to meet me on site.  He pointed out the "rut" which is attached here as 10_3_16 rut A & B.  There are additional photographs of [redacted]'s yard unrelated to our work (attached in separate email) 
This damage is on a slight incline and was likely washed out; we are happy to go back a re-seed and straw this rut in.  We are not however responsible for any of the other damage that is pre-existing on [redacted]'s yard. 
In addition this job was bid to drive the bucket truck right up to the tree, which [redacted] was aware.

Attached here is also a photo of the concrete after we cleaned it

[redacted] received the work that he was quoted for.  He additionally received extra pruning in the Beech tree directly next to this tree which benefits him.  Given the size of the work tree, a 26" DBH Beech, and the man hours on the job, [redacted] already received a more than fair price for work completed to our industry ANSI standards.  We do not believe that Mr [redacted]'s requests to further discount his job and hold us responsible for damages to his lawn that are unrelated to our work are reasonable.  Contrary to Mr. [redacted]'s statements in his filed complaint, he has not directly been in communication with us & in fact we have failed to get a response from him on any of our many correspondences and have not been able to talk directly to him at all since before this work was scheduled.
