Review: On January 1, 2015, I went to the G. Wilikers Toy Emporium in Old Sacramento with my daughter and her son. We had just been in Stage Nine, which is owned by the same company, Stage Nine Entertainment. In Stage Nine, there were numerous signs promoting a sale in both stores. According to the signs, everything in both stores was 50% off. There were no dates listed on the signs.

In G. WIlikers, there was only one sign promoting the 50% off sale. It was at least 2 ½ feet by 3 feet, and it was on a toy display towards the back of the store. My daughter chose numerous items to purchase. When she brought them up to cashier and noted the 50% off sale, the cashier told her that the sale ended on December 31, 2014, the day before. My daughter questioned this as the sale had previously run through January 1, 2015, for at least the last two years. The cashier said that the sale must have been extended in those years and insisted that this year the sale ended the day before.

My daughter told the cashier that there was still a sign up for the sale. The cashier informed her that he had taken down all of the signs. When my daughter pointed to the sign that was prominently displayed, the cashier informed her that he must have missed a sign. My daughter asked the cashier to honor the sign, but the cashier refused. My daughter did not go forward with her purchase.

Unfortunately, my grandson picked out a small toy train, and I had told him that I would purchase it for him before I learned that the sale supposedly ended the day before. I made the purchase, and my daughter and I exited with my grandson and the train. When we passed Stage Nine, we looked at the signs within the store and displayed on the store’s windows and doors. It clearly said that all items in both Stage Nine and G. Wilikers Toy Emporium were 50% off. There was no indication that the sale would end on December 31, 2014.

My daughter and I returned to G. Wilikers Toy Emporium, and my daughter demanded that the cashier honor the advertised sale and refund part of my purchase. The cashier refused. My daughter stated that this was a form of bait and switch as the signs encourage customers to enter the store expecting to receive 50% off of any purchase. My daughter asked if his decision to not honor the advertised price was some arbitrary, discriminatory decision on his part. The cashier turned away. He attempted to make a phone call; however, he did not get ahold of the person he was calling. My daughter asked for the manager’s contact information, and we left the store.

My daughter immediately called the Store Manager. She never received a return call. During my daughter’s exchange with the cashier, my sister and niece entered the store. My daughter asked my niece to go to stage nine and take a photo of the sale signs. As my niece was taking the photo, she asked a Stage Nine associate about the sale. The sales associate said that only Stage Nine decided to continue the sale. When my niece pointed out that the sign did not indicate that, the sales associate explained that the signs were misleading, but it would cost a lot of money to re-print them.

Attached for reference is the receipt showing that I paid full price for the train, despite the fact that G.Wilikers was advertising a 50% off everything sale. Also attached is a copy of the phot showing the sale signs displayed at Stage nine.Desired Settlement: 50% off of charged price

Response:

G. Williker's Toy Emporium was instructed at the end of the Day of 12/31/2014, that our sale was over in G. Williker's and to take down all of the signs. I guess one was missed. Stage nine our sister store was to continue the sale on 1/1/2015. The problem was that there were left in Stage nine signs that stated that the sale was in both stores. I feel the staff was trying to follow instructions that the sale was off in G. Williker's. We are sorry it escalated to this point, we are willing to offer a Gift Certificate for G. Williker's or extend a 50% off for what they would like to get. If they contact [redacted] at G. Williker's this can be taken care of.
