Complaint: ***
I am rejecting this response because: I refused to go to the gym because the owner physically threatened meI had previously sent messages to the owner, which he received, to cancel my membershipI shouldn't be held to coming into the gym when physical threats are madeIf there needed to be a form filled out to stop the charges then the owner should have told me that and sent them to me at the time of my request, not months later
Regards,
*** ***

From looking at his account on my end there looks to be only months where his bill was higherHe continued to get charged the monthly payment because he had refused to come in and fill out proper paper to get his membership canceledI proceeded to email him the proper paperwork for him to
fill out and promptly canceled his membership on our end. Thanks,*** ***

not receive when she signed up. She agreed it was her signature but she did not know that she was signing a contract. Even though she was not out of her contract 8/23/15. I went ahead and cancelled her contract with 2 months (54.02) remaining on her contract.  Explained to her we were just following the terms and condition of her signed agreement. Apologized for the miss communication.  Told her I hope she finds employment very soon.  Member seemed satisfied when leaving the gym.  [redacted] SEE ATTACHED SIGNED MEMBERSHIP AGREEMENT!!!!![redacted] 05/18/2015 10:50 AM [redacted] said she was told she was not in a contract when she sign up and said she was not given a contract. Said she signed something but was told it was for her credit card. She is very upset. Wants to cancel membership because she is out of a job. She is going to the Better Business B. and said she is calling her lawyer if we don't let her out of her contract. She has 4 months left $108.00 . Told her I would have to get approval from [redacted] the new owner asking to waive the remaining part of her contract. Review: I’m a proud US ARMY veteran who is currently deployed as a Civilian Contractor in Saudi Arabia. My wife ([redacted]) had a month to month membership with Gym X. Therefore, there was no contract or minimum amount of months pending on my account (GYM X #[redacted]). We moved from Killeen, TX to San Antonio, TX in December 2013 due to our jobs and had to cancel her membership via email, in person, and telephonically as a result. However, GYM X continues to charges our joint account each month regardless of our efforts to cancel. They’ve acknowledged that they have no record of contract belonging to my wife. We’ve also made several efforts to contact them since then via telephone and email. But, they have failed to respond either by refusing to answer the phone calls or blatantly disregarding our emails. How do we get anything done when they are local [redacted]? Is there a corporate office who is above these franchises and can help? I checked out the internet for reviews regarding this company and apparently these guys are notorious for pulling this sort of business with other customers. They'll tell us everything is OK when we visited the franchise but then charge our joint account for another month.Desired Settlement: My wife ([redacted]) & I would like to request that you make an inquiry into this allegation and GYM X's business practices to validate our complaint or compare them against other customers complaints. Ultimately, we'd like to have our credit charges refunded as soon as possible and the harassment to end.

Review: The business on October 25, 2013 decided to stop letting people who signed up for the X-Pass membership have a free guest. This is the only reason decided to pay for a sign a contract for one year of membership. I was told this was a decision on the management part. In the contract it does state about having a VIP member allowed to come on the membership, this was also the big seeling point for the employee who sold me the mebership as well. Management now states that the VIP buest has to be on the membership and have additional charges for which o me makes them no longer a guest but a meber as well. The management will not let me have a free guest no matter what. There is no compromise willing to let me have.Desired Settlement: I just want out of my contract the end February 28, 2014 with no additional fees so I can take my business elsewhere.

Response:

[redacted] can go ahead and fill out a cancellation request form with our front desk staff so her membership cancels on her expiration date instead of renews automatically.

I am rejecting this response because:

I am already going to do that. I want out now with no additional charges. If I cacel now I will owe them $120. I am not happy with the mangement team and want out now. In my contract it states that me and my VIP guest are held to the same rules. The VIP guest is a guest who does not pay, at least that Is what was sold me. Now the VIP guest has to pay a registration fee and a monthly chargee so they are no longer my guest they are a member because I am now not needed to be there with them. They can go without me. The business should honor my contract as it was presented to me which was for a free guest. instead they will not honor this so to me they should let me out my contract that they sold me in February. Since they are not honoring the contract they sold me they shouls let me out with no additional charges.Trust me no matter what on December 28, 2013 I am turning in my notice I am only waiting until then so I will only owe two months and I can pay it and never come back.

Review: Me and my husband visited GYMX at Killeen location in April and we decided to join the gym, The guy who help us told us that was a 79$ for me and extra 40$ for my spouse for signing up, and around 40$ a month after that. We said ok and we signed the electronic pads they have. Never was mentioned we were signing a one year contract. Now that we want to cancel they told us we have a contract and my balance is around $350. I visited the gym yesterday to ask for a copy of the contract and the printer wasn’t even working( staff is not printing contracts at that location) so I asked to email me the contract. Now the membership agreement states that I have to pay the reminder of the contract if I cancel but the cancellation policy states that I only have to pay the reminder or 150$ whatever is less, that I don’t think is fair since I did not know there was a contract in the first place. I signed the pad twice and I thought it was for the one-time $120 payment and then to set up $40 monthly payments.

The staff at the gym was not clear with contract agreement, if I knew it was a contract I would not sign it. Since Killeen could not help me I wanted to see if corporate could. I called Waco Gym at ###-###-####, I talked to [redacted] and I told him my issue, he first told me that the cancelation fee was $250 (I told him the contract states $150), none of the staff really knows what the cancelation fees in the contract, I told him that I was not comfortable to pay the cancellation fee since I wasn’t told about the contract, he said he can’t be sure if I was told there was a contract also he said that every gym uses computers to do their contracts and I should know that, The staff assume that everybody who comes to gym know they are signing a contract. I ask him ([redacted])if he was my last resource before bringing this issue to a Revdex.com, he said he represented corporate, he is the last resource and couldn’t help me. I also sent an email to '[email protected]' with this information 24 hours ago and no responsed.

The Staff of GYMX does not inform new clients that there is a one year contract involved and I believe that is very unethical. Also they do not have knowledge of the cancellation fee, talked to two different employees and they both gave me different numbers, neither of them were accurate with contract.Desired Settlement: Cancelation of my membership and my spouse with out paying cancellation fee due to not knowing of contract

Review: I started my membership in May and I'm paying for the gym and their tanning services. I noticed that the beds' bulbs were extremely black and red, and told [redacted] [the GM at the time] about a time in my salon a bulb cracked so hard that it cracked the acrylic and caught fire. I explained to him that I was worried about the safety of myself and others and he needs to fix it or shut off the beds until it's fixed. Well, it hasn't been fixed and this is almost 4 months now. I not only sent a letter to corporate, which I never received a response, but I also contacted their Facebook page and the new manager said it will be fixed in another month or two.

I also noticed that they're not following the tanning laws. Section 229.356, says a test kit or other device should measure the concentration of sanitizing solution. One day when I was cleaning my own tanning bed, I realized it smelled like pure cleaner. I asked the man who was working the 6 am shift if they dilute the cleaner with water and he said no, that nobody told them to do that. So, I showed him the back of the directions and showed him how much water should go in the spray bottle, so he then left a note for all of the other employees. Section 229.354, says the operator must ensure that no individual is allowed to use a tanning device more than once every 24 hours; which they definitely aren't following this one. They have a sign in sheet, but the workers don't pay attention to it. The reason I know this, is because [redacted] [who is also on my account] went in to tan Sunday the 24th at 12:40, and Monday we came in and tanned after our workout around 11:30. I've read the tanning law many times when I managed a tanning salon, and I'm pretty sure if someone was to do an inspection here, the tanning would get shut down in a heartbeat. So of course, I tried calling and cancelling without paying a fee, since I'm paying for tanning that's absolutely terrible and [redacted] [the new assistant manager] laughed at me multiple times!! I also plan on contacting the Texas Health and Human Services to report them as well, since they think it's a laughing matter.Desired Settlement: Due to the fact that I have made several requests that have fallen on deaf ears, I will no longer put myself in danger and PAY to do so. I want all ties severed with Gym X and do not intend to pay the cancellation fee due to their negligence. And this also applies to [redacted] since she's under my account and has complained along with me.

Review: My wife and I got assigned to Waco in April 2013. She signed up with GymX on 22 April 2013 due to their 24hr access and the fact they let you bring a guest for free.

1 Nov 2013, they changed their policy to "no free guests." When I asked to terminate our contract since they changed their policy they said there would be a termination fee ($250) and that the free guest policy wasn't in the original contract.

I’m not a lawyer, but I’m pretty sure you can’t change a contract/agreement/policy like that and not allow us the option to get out of it or grandfather us in at pre-existing terms.

We signed up due to the 24/7 guest access. Now they chose not to honor our previous agreement.Desired Settlement: No cost termination of current contract.

Business

Response:

The free guest privilege is not part of the contract. Since we have discontinued free guests, we are allowing family members to join for 1/2 price. This also allows the family member to use the gym whenever they like because they no longer have to come in with the primary member. We understand the change has been inconvenient to a few of our members, but we are finding that the vast majority of our members are appreciating the opportunity to add family for 1/2 price so they can have full membership access and privileges.

Regards,

Review: In February of 2013, I signed a year contract with Gym X. I signed up for the Xpass special in which I paid around $50 upfront then $27 a month. The price was reasonable. A month later I found out I was pregnant and wanted to cancel my gym membership. I called the facility and they informed me that I had signed a year long contract and was not able to cancel it at that time. Frustrating as that were, I agreed and asked that on the year mark in February of 2014, for them to cease and desist any efforts to take money from me and to cancel my account.

I recently discovered that Gym X is still drafting my bank account 14, nearly 15 months later. I called Gym X on 4/22/14 and spoke to a man who told me that the only way out of a contract was to move and that I needed to bring a water bill to show that I had moved. When I asked to speak to a manager he told me no managers were there at all, I'm curious as to why no authority figures were there during business hours. Needless to say I am quite infuriated. Just because you have someones bank account information does not mean you can debit their account whenever you feel like it. I completed my contract as requested and never agreed to re-up for another year. I have asked numerous times to have my contract cancelled with all of my efforts in vain.Desired Settlement: I wish for Gym X to refund me the money they have fraudulently taken. I no longer wish to attend their gym, nor will I recommend any of my friends to attend due to their shady dealings. If this is not handled I will be forced to take this matter into legal standings. I refuse to continue to pay for a service that I have asked to stop and that I haven't used in over a year.

Review: Gym at first had an advertisement that stated enrollment or membership for $1, after receiving complaints Gym X removed the sign but refused to honor what it stated. Gym X also has a full sized billboard in front of the gym that lists memberships for as low as $9.99 a month, and after inquiring about the $9.99 a month, I was told by 3 different employees of Gym X that it was false advertising and that the owners and General Manager where aware of this. I was told to stop complaining and talking to other members about it because they (Gym X) didn't have time for it. Due to the nonchalant and "I really don't care" attitude of Gym X's sales manager and associates, I've canceled my membership...Desired Settlement: This is the second time that Gym X has used something that resembles "bait and switch or false advertisement", the first time was when they canceled the Xpass membership at the old location.. The only desirable outcome would be for Gym X to honor what the billboard says until its taken down or corrected. Really I feel that they should go back and and discount any new members that were told the Bi-weekly rates were all that they had to offer and that they had no idea why the billboard was up....

Review: I have been a member of Gym X for about 4 years. There have always been two memberships that Gym X sales. A Basic membership for $10 per month that does not include any services by access to the gym. The second type of membership includes the ability to bring a guest with you to the club. Typically a couple will select the second type of membership. I entered a contract for the second type of membership. My membership costs about $20 per month. My step-daughter also entered a contract for the second type of membership with plans on sharing the membership with her boyfriend. Most recently the management has decided not to allow a guest to come for free with the second type of membership. The gym policy now is if you want to bring a guest, they must enter a contract with $25 signing fee and $15 per month, the guest membership is associated with the original member's contract. If I knew that this was going to be the case, I would have entered into two $10 per month contracts years ago. And my step daughter would have also opted for the $10 per month membership. I know that there is nothing I can do but cancel my contract and move on to another gym. I am now on a month to month. But my step daughter can not get out of her contract until march. In the mean time, while she typically went to the gym at same time as me and my guest, will no longer be able to bring her guest and will have to go to the gym alone until march.Desired Settlement: Gym X should be required to honor all contracts that they entered into with the premise of bringing a guest with the more expensive membership. I am filing this complain on behalf of everyone that has been treated poorly by this company.

Response:

[redacted] was offered the option to pay the difference between the down payment he already paid for his current membership and the down payment required for the $10/month membership so he and his stepdaughter could continue using the gym for $10/month each and still come to the gym together. [redacted] refused this option. [redacted] was also given a copy of his membership agreement which clearly does not include any obligations on the company's behalf to provide or maintain a free guest policy. We are more than willing to convert both [redacted]'s and his stepdaughter's memberships to our $10/month each memberships with the additional fee to cover this membership's required down payment since the down payment they've already paid was much less.

I am rejecting this response because:

The contract refers to VIP Guests. Although VIP Guests are not a defined term in the contract, it was always understood by Gym X management and Contract Holder that VIP Guest are individuals that accompany Contact Holder on visits to the facility free of charge. The ability to bring a VIP Guest to the facility free of charge was advertised as the main difference in the membership plans between the Xpass and the BasicX membership options.

Actually I had suggested that Gym X convert my XPass membership into two BasicX membership packages. The Gym X membership indicated that they would do this but would require that I pay an additional upfront fee of $150 in order for this to take place. I refused to pay the $150 to convert split the plan into two BasicX packages. I have paid much more than the additional $150 through the years as a member at the club and to pay them for a resolution was not an option I was willing to accept.

Gym X falsely advertised and sold Xpass membership packages with understanding that a guest could accompany member. By taking away this from contracts already entered into is deceitful and wrong. Contracts entered into with this understanding should be honored.

They claim that the contract never said that the free guest not included. I say that is not true and that the only explanation of the VIP Guest referred to in the contract is the free guest as part of that membership.

Review: I signed up in August and I've been having problems ever since. Not only are they not abiding by the Texas 24 hour tan law, they are also not taking care of their tanning beds or equipment at all. Some of their equipment is ripped and the bulbs are not only turning black, but they're turning red. They're also using straight chemicals while cleaning the tanning beds and not diluting it, which is also in the tanning law. When I signed up, I was told since I was under [redacted]'s account that it'd be $25 to cancel... I called today to see how much it would cost and the manager [redacted] told me it would be $113.12. Not only was she extremely condescending, she refused to explain to me why Robert [who signed me up at that time] signed me up on my own account rather than under [redacted]'s. The main reason I even signed up was because I was told that it was only $25 to cancel, and I wanted to see if I even liked the gym before I got on my own account, because they don't let people use a free day pass to see if they like it or not.Desired Settlement: I'm not only refusing to pay this ridiculous cancellation fee, but they are going to refund me the money they take out every month on my credit card.

Response:

I have personally looked into Ms. [redacted]'s complaints regarding our tanning beds. The tanning bed she is referring to was due for the bulbs to be replaced, which they were on 9/22/14. In regards to the tanning bed cleaning solution, we use a tanning solution test kit to test the cleaning solution every time a new bottle is filled with it, which is required by law. Ms. [redacted] has not had any monthly payments draft out of her account. She joined Gym X on 8/19 and paid a $26.52 enrollment fee. Her 9/19 monthly payment was declined due to insufficient funds. Ms. [redacted]'s membership has been cancelled as of today, 10/14/14, with no additional fees due. Thank you
