Good afternoon ***, I’ve requested my co-worker *** *** to reach out to Ms *** to schedule an appointment to come into our office and speak with me and come to an agreementHe spoke with her today, but she did not want to make an appointment with me and wanted to call Revdex.com first and see if
that is the procedureWhen she first submitted her application to rent my apartment unit C, it was not ready and she was fully aware of thisWe advised her it will take some time to completeShe kept insisting to move her belongings into unit B as a storage, while unit C is readyIn good faith we allowed her to move her stuffWe then found out she actually moved in to live without permissionShe was aware that unit B was not ready to be moved in to because the previous tenant had just moved outWe have been fixing the unit little by little as she is living therePrior to her moving her stuff in, the unit was painted on the insideWe then took out the carpet to replace it but she wanted tile flooring instead of carpet so we put tile throughout the unitShe has not provide us with a written request on any repairs needed to be done to the unitIt is stated on the rental agreement “Tenant shall immediately notify landlord, in writing, of any problem, malfunction or damage with any item including carbon monoxide devices and smoke alarms on the property”Please advise on what is the next stepWe do not agree on her request for a refundIf she would like to cancel her contract, that will not be a problemThank you for your time. *** *** Transaction Coordinator Realtor BRE# *** * *** *** *** ** *** Office: ###-###-####

I am rejecting this response because:What’s stated according to the H and R Realty staff is not a honest statement. I contact landlord [redacted] on Saturday, February 25 2017, to inquire about unit c which was the apartment available at that time, then he said that  we ( at that time my husband and I) could stop by his office and if we really wanted to reserve the apartment to bring along the security deposit and first month rent both $950 each. He reassured that the apartment was gonna be available to move-in on 03/01/2017 and that they were working on last details on the apartment because they were upgrading it from a 2 bedroom apartment to a 3 bedroom unit. On 03/01/2017 I  called landlord [redacted] and he claimed that there were some minor delays but for sure the apartment was gonna be ready on Saturday March 05 2017, Saturday came and the apartment wasn’t ready, by that day the security deposit and the 1st rent was already paid off and he offered [redacted] ( husband at that time) to move-in on unit B until unit C was finished, which according to him , it was gonna take they to finish within a week, all of the sudden the week past and apartment wasn’t ready, and the delay was because he remodeling on the apartment didn’t have the approval of the city and when the people fron the city found out about it, they shot it down the remodeling, this took them until june or july to finish up the unit C . When landlord [redacted] acknowledged me about unit c being finished I was already settled into unit b and didn’t want o go through a hassle of moving furniture and all the utilities to unit B , so I told him tajt I was going to stay in unit B and he agreed to that and to make all the repairs that needed to be done. [redacted] and [redacted] came on june or July to inspect the unit B and apparently to write down all the issues that require attention in the unit, that day they made me sign the rental agreement and stated that if I signed it it was gonna be a lot faster for them to send his contractor to work on the repairs . I am not aware of the clauses of the rental agreement because [redacted] which is the peron in charge of the complaints never mailed me a copy of the rental agreement as discussed. Every time I call or texted  [redacted] and [redacted] to remind them or to find out when they were gonna send the contractor to work on unit B, they’re answer always was that he was working on other units. The carpet was changed in the bedrooms due to a bedbugs plague and the apartment has never been painted, the handiman came to fix a leaking in the bathtub and to change the trash disposal. All the other issues I bother to let them know, [redacted] always gave me the same lame excuse, “the contractor is working on other units “. I assume I have the right to break the rental agreement at any time due to the conditions of the apartment I’m renting and I have the right to have a refund of the security deposit as well. The whole apartment unit is a mess , no one comes to check on the building and inspect that everything is function properly, the fence of unit A is falling apart and can hurt my child or the other tenants children as well, it’s a dirty apartment building.
