Review: I had my car towed to H R automotive on January 7, 2013. I was told that I had a blown head in my engine and that the entire cost for repair would be about $1248. I bargained with the owner [redacted], that if I would pay $400 dollars up front for the cost of parts in exchange for my car being fixed in one week and the owner would provide me a payment plan to pay off the balance of the labor so that I could have my car in order to go to work. I made the payment of $400 on January 15, 2013 and have a receipt reflecting such. Relying on this date of completion, I, made arrangements to get to and from work from January 15, 2013 to January 22 2013. I called on January 22, 2013 and was told that my car would be fixed by January 29, 2013. I lost my job because I was unable to make it to work after January 22, 2013. I called January 29, 2013 to again check the status of my car and was that it would be two more Weeks before my car could be repaired because my engine block needed to be placed on a machine. I called again February 4, 2013 to check the status of my car and was told that it would be fixed around February 7, 2013. I called and was told my car would be fixed by February 14, 2013. I called on that date and was told that my car would be fixed by February 20, 2013. I called and was told my car would be fixed the next day. I was told that my car would be fixed by February 22, 2013. I went to the shop that day and noticed that my car has flat tires and a hub cap was missing. This lets me know that the car had not been moved under the work bay to have been worked on in write sometime. I was told by the owner "If you had the money to pay for the car I would have it fixed by Monday (February 25, 2013)." Given that time was expressly made of the essence and my car is still not finished the owners actions constitute both a breach of contract and fraud in the inducement. He took my $400 consideration for the promise to pay knowing all along he had no intentions of ever honoring it.Desired Settlement: I would like either my car back along with the $400 dollars I paid in exchange for the promise to pay that was never honored. This will allow me to take my car somewhere else to be fixed. Because of his shady tactics I do not trust this shop to fix my car properly. Or I request that the car be fixed and I not have to pay the balance for the labor. If neither of these requests are honored I will be forced to pursue all of my legal rights including breach of the contract as well as fraud.
