At time of lease in 12/12 the lessee signed a lease contract to fill the tank twice a year. No gas has ever been purchased after the first...

initial purchase. We could have charged a fee for non-use for 3 years but chose not to. After 3 years of non-use we picked up the tank. The non-use fees would have totaled $532.80 plus pump out fees of $60. If complainant wishes to pay these fees we could reimburse the gas costs minus delivery fees & taxes.

(The consumer indicated he/she DID NOT accept the response from the business.)
We were not given a contract and there was no contract signed nor one given to us as well as no copy of the receipt we did sign for the tank and agreement to pay rental yearly. We feel this company is fraudulent and never gave us the three day written warning that was written in their "contract" that we received by mail after the fact. They will rip others off too with their deceitful business. I have copies of the contract and no where on it is there a place for our signature. We did not get any papers when we received the tank, we signed for the tank and agreement to pay yearly rental. That is all we agreed to. Since we have no original papers we had no idea what was happening until after they took the almost full tank of propane. Like stated before they were told what the tank and propane was for. They said nothing about filling twice a year at that time. The generac was installed so my elderly father would not have to try and start the gas generator if the power went off for his oxygen machine which he depended on. The tank was taken and the open pipe left sticking straight up in the air and it was raining. They had no regard for the expensive equipment that the pipe was attached to. As stated before they broke their own contract by not giving us three day written warning. My father could have died without power to his machine had the electricity went out as usually happens a lot in the country. I will not bow down to their threats as they threatened us when we called about it. The woman said "If you chose to peruse this we will sue you for un-purchased propane"

I never mentioned the word "sue" in any of our conversations. I sent a copy of both sides of the contract he signed. No we did not give him 3 days...thought 3 years was plenty of time. They did sign the front of the contract. It was 2 sided. Pump out fees, restocking fees and nonuse fees would be subtracted to any Propane that we would be able to recover. This is a standard for the industry. They do not appreciate how leniet we were for them.
