On 01/04/20, Habitat for Humanity of Collin County ReStore appears to have accepted an unauthorized donation of my property originally consigned to Home Consignment Center located at *** Drive, Suite *** McKinney, TX XXXXX, Tel. (XXX) XXX-XXXX E-Mail: ***@hccenter.com

The attached donation receipt appears to have been filled out by a Home Consignment Center employee (B. Pratt'). That same employee appears to have signed the "Donor signature" line and initialed the "Accepted by" line as well. At no time did I authorize Home Consignment Center to donate any items consigned to them for sale, as shown on the attached consignment agreement number XX-XXXXXX. Items XX-XXXXXX-E (Vase) and XX-XXXXXX-M (Plate), valued at $125.00 and $50.00 respectively (according to the donation receipt) were unlawfully donated to Habitat for Humanity of Collin County ReStore, by Home Consignment Center.

After contacting staff and the Habitat for Humanity of Collin County CEO, Celeste H. *** about the donated items, I was informed that the items could not be located in the store, and was advised to discuss the matter with Home Consignment Center.

Desired Outcome

Refund As these items no longer appear to be in the possession of Habitat for Humanity of Collin County, I request that I be reimbursed for their estimated value of $175.00.

Habitat for Humanity of Collin County ReStore Response • Feb 19, 2020

Habitat for Humanity accepts donations across the DFW area. We have a standing pick-up at Home Consignment store. Mr. reached out to Habitat for Humanity about the items, and was advise we received the items, however they had sold. We were not aware that Home Consignment did not have authorization per Mr., however up on contacting Home Consignment I was informed that he had in fact signed an agreement with Home Consignment that if the items did not sell within a certain time they would then contact owner. If the owner did not pick up items within a certain time they would donate the items. which was stated in the contract Mr. signed. Home Consignment Store Manager Brenda advised me to have Mr. to contact Home Consignment's legal team in which they had also advise him to do so. I have only been able to speak to Mr. via email and I have advised him of the response I received from Home Consignment. Habitat For Humanity does not accept unauthorized donations. Mr. has a signed agreement with Home Consignment which gave them authorization to donate items.

Home Consignment Center violated its consignment agreement when it donated 2 items consigned to them for sale.

On September 27, 2019 I entered into consignment agreement number 19-108006 (see attachment) with Home Consignment Center (HCC), to sell a total of 15 items.

Line Number 7 of HCC's Policy states the following: "IF Home Consignment Center determines after 45 days that an item is not likely to sell, the consignor agrees to reduce price, donate or PICK-UP item AS SUGGESTED."

On November 10, 2019, (day 44 of contract) HCC was informed that I would pick up any unsold items which HCC no longer wishes to sell. HCC and I communicated via e-mail on 11/15/19, 11/19/19, and 12/02/19. At no time PRIOR to January 3, 2020, did HCC inform me that there were any items that were not likely to sell. Not until HCC makes the determination that an item is not likely to sell, am I obligated to take any action.

Upon receiving notification regarding item XX-XXXXXX-G on January 3rd, I promptly informed Brenda *** of HCC that I would be picking up the item. Since she did not mention items XX-XXXXXX-E and XX-XXXXXX-M, I assumed that these items sold in December. Had Ms. mentioned that items XX-XXXXXX-E and XX-XXXXXX-M were unsold, and that HCC was no longer interested in selling them, they would also have been picked up on January 4th. HCC violated its policy by donating the items without my permission, as they failed to notify me of their determination that the items were not likely to sell.

I request that Habitat for Humanity of Collin County ReStore provide proof/documentation that the two "donated" items were sold, as claimed in the response.

I would also like to reiterate that I DID NOT sign the attached donation receipt and NEVER authorized donating my items consigned to Home Consignment Center. The "Donor signature" on the donation receipt is NOT mine.
