***,There are no excuses here We discussed this when you were struggling with the broken gas line and other items that ran you over budget We will address the items that relate to the work on the invoiceonly We did discuss that it would be more cost effective to replace the evap cooler but you were adamant about getting refrigerated air Your panel had the space for the needed for the HVAC unit but we did not see that the wire from the transformer to your house did not facilitate a outlet, only In 10+ years of contracting I have never had a house that did not have this most basic service line from the transformer We will need access to house to look at the counties concerns Please provide a schedule where we can access the propertyKeep in mind that when the county inspects it, it will fail because the service upgrade is required to move forward If possible please talk to your daughter about this I had also explained to her about the line when we talked about the gas line repair At the time you were so far over budget that she said we would deal with that later and you agreed.Regards, ***

Habitation has so many excuses.  Are they going to repair what theCounty Inspector asked them to do.  I know that ignorance is no excusebut at no point in time did I ever under stand that I would be chargedanother $2,000 dollars to connect my air conditioner for it to work.This all should have been explained to me when I paid the $5,800 forthe new equipment.  This should have been taken first hand from thebeginning from the $25,000 dollars that was awarded to this companyfor repairs and remodel to the house that I purchased in November of2014.  I understand that this company does nothing for free, they havenot looked out for my better interests and the work done was not forfree.  However are they going to correct the items that the CountyInspector has asked for or will this be ignored too??[redacted]

We did do a remodel for [redacted].  There is no 220 line from the PNM transformer to the house.  In order to install it, PNM and the county would require us to upgrade her service.  An electrical service upgrade is not on the estimate pr invoice for [redacted].  We cannot perform...

the service upgrade at no charge but have offered her a discount rate.  It appears that [redacted] feels that by filing a complaint she can force us to give her something for nothing.  We cannot.  We have accommodated her in every way possible even allowing her to pay her remaining balance in a payment plan.  I have attached the email that explained this to her twice and her subsequent response.Regards,[redacted]###-###-####

Because I have had to repeat the same information several times I felt it would be helpful to ad my responses at each paragraph.  I strongly encourage [redacted] to save this version to that when the question comes up again she can re read this response as a reference.  My responses are in blue.  Thanks,  [redacted]June 23, 2015Revdex.comRebuttal Last and FinalRevdex.com,Reference# [redacted]The Habitation Contractor was recommended by the Real Estate agent that helped me purchase the house at 10012 4th street.  The items that I asked for in the beginning of the remodel were mainly to have the rolling floor more level and for everything to be brought up to code.   I did ask for refrigerated air conditioning mainly because of the maintenance required for the swamp cooler.  Knowing the condition of the house was not acceptable I did assume that the swamp cooler on the roof probably was not worth saving.  Nothing had been taken care of and all appliances had either been taken or stolen I never got the history of appliances.   I decided to purchase the heating and air conditioner and the Contractor did not explain to me or put in writing the necessity of having a complete electrical upgrade.  This would not have been a problem as the bank had already loaned me $25,000 for remodel and repairs.  Before the remodel was complete there was another surprise because the gas line was not functional and had to be replaced. At the time of the estimate we noted that your panel was large enough to accept the air conditioner.  We DID NOT SEE that you do not have a wire for 220 from the transformer to the house.  Replacing this wire REQUIRES a service by PNM upgrade which is not included on the estimate or invoice.  It would be like having someone repair your transmission and not see that the rear differential was bad until later.  Although the two are connected and depend on each other, the mechanic is not obligated in any way to replace the rear differential for free as that was not in the scope of work originally presented.By then the funds had been used and the contractor did agree to let me make payments for six months on the $2,300 hundred dollar balance.  This money that I owe has nothing to do with the original complaint.  True, but I did not have to offer you a payment plan at all.  In addition, it was supposed to be paid in full within 6 months and it has not been.  I have not sent you to collection or pestered you.  I was trying to help you and this should be acknowledged.I still just do not understand why the charge for the complete upgrade was not figured in with theinstallation of the heating and air.  I really believe that if I had called a heating and air conditioncompany out of the telephone book they would have explained to me the additional cost of an electrical upgrade and given me more choices.  Again, at the time of the estimate you did not need a panel upgrade but there is NO wire for 220 from the transformer to the panel.  This is highly unusual and in 13 years of contracting I have not had a property that did not have this wire present to the house.  If you are still unsure then please read the response to the first paragraph again.On many occasions I drove to the house on my lunch hour and never ever saw [redacted] working orsupervising the workers.  We argued several times on the telephone concerning small items that I did not like and [redacted] refused to change out or would agree to make a change always at a higher cost.  It was never about what I wanted done or changed.  The invoice carefully documents EXACTLY the work to be performed and [redacted] filled out the finish list determining the finishes we would use.  It is true that [redacted] frequently asked for items not on the invoice or that were more expensive than her allowance and she did provide an incorrect item number for her tub/shower trim kit which resulted in her getting the wrong color.  All items were done according to the invoice and finish schedule provided to us by [redacted].I was not happy with the cover that was put on the water facet outside the front door.  This cover is similar to backer board. The frame was not done properly under the front door.  The house was left filthy when the workers finished and there was dirt and wood left in the bathtub.  I do not think this is how most contractors leave the work site.  The trim around the tile floor that they installed was never replaced.  They installed only two overhead lights in the entire house one in the living room and one in the entrance.  When the remodel was over I hoped to never speak to or see [redacted] ever again, but unfortunately the weather turned hot and we needed to run the air conditioner.  [redacted] did mention a problem with the air conditioner in March 2015 long after the final closing of the house and after final checks were dispersed.   The front hose bib was moved per the invoice and [redacted] did approve it at the time.  The front door is properly installed but [redacted] does have subfloor issues that prevented a perfect fit.  [redacted]'s invoice does not include baseboard.  I offered to install baseboard at our standard rate of 3.00 per lineal foot for paint grade and she declined.  We installed the lighting per the invoice and finish schedule.  After the project was over I went over the invoice and balance due twice with [redacted].  She has never approached me to go over the project in person or review the invoice again.All these things I would have chalked up to as having a bad experience.   I was resigned that over time I would have been able to fix some of the things.  However this upgrade is a huge expense and is not in my opinion just an honest mistake.   This was a secret expense that was not disclosed to me when the original proposal was drawn up.  This is not a 'secret' expense. It is however necessary to add the 220 wire to [redacted]'s home.  That intern will REQUIRE a service upgrade per PNM.  I am willing to this at cost in the next 90 days.  After that I will notify the county that she has refused the service upgrade and she will have to pay someone else to do it.Thank you,[redacted]
