Review: The Contractor/Owner has failed to compelte the renovations in a timely manner and within the time frame specified in the agreement. We are now 5 weeks past the end date of March 8, 2013, and about 10% completed, and that is being generous. The Contractor states that he is unable to complete the work due to his illness. The Contractor has not furnished any documentation from his doctor verifying the illness and inability to work. On April 10th the Contractor terminated the agreement by text message. Contractor claims that he is entitled to the entire amount the he was prepaid, due to the terms of the agreement. The agreement clearly states that the Contractor is only entitled to the monies if the home owner cancels the agreement with written notice by fax or mail, which we did not do. The Contractor is in breach of other parts of the agreement, including failing to "complete the work within a reasonable timeframe", and failure to "clean up the premises and remove from the premises all waste material and debris" from the work outlined in the agreement. The Contractor also misrepresented himself and the company at our initial meeting, implying that he had employees and subcontractors. This is also stated in the agreement. The Contractor worked the premises by himself, and also states this in a text message on April 10th. Had we been aware of the truth, we most likely would not have agreed to work with this Contractor. When the Contractor terminated the agreement on April 10th, we asked for him to deliver to us a dollar amount for the work to be completed and to have the balance refunded to us. This was again requested on April 14th via text message, email and voicemail. Due to the delays by the Contractor, we have/will also incur about $12,000 in additional housing costs.Desired Settlement: We have paid the contractor to date $20,119.98 on a $26,826.64 total job. We estimate that based on the amount of work completed, about 10%, we are due back $17,437.32.
