My [redacted] and I have been in correspondence via phone and email for nearly weeksHis original appointment for his dermal lens makeover was for mid Janof this yearHis story of the day of the procedure differs from ours in that he decided to not move forward last minute (the day of the procedure) with the procedureHe then months later, decides he wants a full refundTime and money have been paid for his decision to opt out i.esales tax paid to the state of MN for the dermal lens, commission paid out to the Advisor who presented the procedure to him and the cost of the dermal lens itself which can not be returnedThe attached signed contract clearly states that there are no refundsHe is even way past the MN law that gives him a right to withdrawal up to daysEven though he has absolutely no legal grounds for any refund whatsoever, I was willing to give him $as a refund which he refusedSince this has dragged out for as long as it has with out resolve, I old him in a email on SatApril 29th that Iam lowering my offer to $since I've spent way to many hours dealing with his unreasonable requestI gave him until today- Monday May 1st to accept the or I am pulling the offer off the table all togetherNow he has filed a complaint with the Revdex.com and it's taken me more time to respond to this matterMy offer is now down to $until 5:00pm Monday May 1stIf this is not resolved by then, I am with drawing the offer completely and will not give any amount of refundMy response to [redacted] about becoming short and demeaning, in my opinion is due to the fact that I am not willing to give him his requested full refundThe fact that there is still an offer on the table shows that I am open to resolving the matterI hope to hear from Mr [redacted] so that the matter can be brought to resolve and feel he has had ample time to accept my offerBest regards, Vern ***

Taylor and the associate looked at my scalp. It was red raw and I had ingrown hairs on my scalp where the product was placed on my head. They were aware of the irritation and the lifting issues. You can either have them call me or outline how the credit will work. Thanks

Time and money have been paid for his decision to opt out i.e. sales tax paid to the state of MN for the dermal lens, commission paid out to the Advisor who presented the procedure to him and the cost of the dermal lens itself which can not be returned. Even though he has absolutely no legal grounds for any refund whatsoever, I was willing to give him $600.00 as a refund which he refused. Since this has dragged out for as long as it has with out resolve, I old him in a email on Sat. April 29th that Iam lowering my offer to $500.00 since I've spent way to many hours dealing with his unreasonable request. I gave him until today- Monday May 1st to accept the 500.00 or I am pulling the offer off the table all together. Now he has filed a complaint with the Revdex.com and it's taken me more time to respond to this matter. My offer is now down to $400.00 until 5:00pm Monday May 1st. If this is not resolved by then, I am with drawing the offer completely and will not give any amount of refund. I am rejecting this response because:
Mr[redacted] has misrepresented some of the details
surrounding his reasons for not refunding my payment to his company, Hair
Restoration Institute (HRI)
The first is regarding Minnesota sales taxIf a
business pays their required sales tax remittance to the state on a monthly
basis, then their payment for a given month is deducted by the sales taxes
refunded to consumers for that monthIn other words, even though HRI has paid
sales taxes from my purchase to the state, they should be able to deduct that
amount from future payments to the stateSimilarly, Mr[redacted] could deduct the
commission paid to the mentioned advisor from a future commission payment
I have also surveyed the websites of a few
companies that sell dermal lenses or similar products, and they all have at
least a 30-day return period for unused productsSince my dermal lens was
never used, it seems very odd to me that the product cannot be returned
Thirdly in regards to the contract, it does
include a line that states, "The client understands there are no
refunds." My understanding of this line when I signed the contract was
that I would not be eligible for a refundonce
the dermal lens was attachedI have met with a couple contract law
attorneys for brief consultations to discuss this specific lineThey all agree
that this situation is ambiguous and is not as clear cut as Mr[redacted] says
Additionally, the contract does not mention the 3-day window to withdraw from
the contract that Mr[redacted] mentionsI do not think the average person would be
aware this time window
And lastly, the reason why I wrote in my initial
complaint, "[Mr[redacted]] became short and even a little demeaning," was
because in one of our correspondences Mr[redacted] wrote, "You have no idea
whats involved on cost and time to a clients receiving in your case the dermal
lensWithout getting into the details, which you would not understand nor even
care for that matter, ..." I don't appreciate Mr[redacted] assuming what I am
capable of understanding nor what I care about
