This seems to imply that Hale Landscaping dug a ditch The ditch in question was dug by some other party prior to Hale Landscaping being asked to do the work and was existing when we went to the property to provide and estimate for the job
As I indicated to Mr***, we would be happy to do the work he is requesting However, our client has specifically asked us to do nothing They do not want us touching the rock, which technically, they own
As I mentioned above, we did not dig the trench Furthermore, we did not put the rock on the ***'s property We stopped at the property line as best we could and our client finished up
The following text I have cut and pasted from emails our customer sent us:

Interesting that he was at work - and claimed you did the work - when he couldn't see that it was us that did the work

As previously mentioned - *** did not do any rock work on their side of the fence - we did that - and;
#- it would be virtually impossible to do anything from their side because of the large trees, and
#- we are requesting that you do nothing until we have a plan of action from our atty
*** and Joel did nothing on their property and did nothing wrong
We'll keep you posted - but again request that you do nothing at this point
Honestly, I would very much like to get this resolved The amount of time I have spent on the phone and writing emails is probably more than it would take to remove the rock I just don't see how we can proceed without angering one party or the other This is why I suggested to Mr*** to contact our client and come to some sort of agreement We really would need to access the rock from our client's property, it is not realistic to do it from the ***'s sideThere is hedge in the way, plus the fence We cannot access our client's property without their permission Even if we could access the rock from the ***'s property, the rock belongs to our client so we can't remove it and we can't very well throw it onto their property I really don't know what to do

Complaint: [redacted]I am rejecting this response because:
Much of what the [redacted] said is untrue.  
First I talked to [redacted] on two occasions so I know these are not true:  
*)  "[redacted] did not do any rock work on their side of the fence - we did that"
*)  "[redacted] and Joel did nothing on their property and did nothing wrong."
Second, these are not true as well, 
*)  "it would be virtually impossible to do anything from their side because of the large trees”.   
*)  "We really would need to access the rock from our client's property, it is not realistic to do it from the [redacted]'s side."
The [redacted]' fence has been put back up blocking access to the rocks/landscaping fabric on my side of the fence from their side.  It's much easier to access it through the trees on my side.  The trees in question are some of the privacy trees with easiest branches to work around.  You can easily push them back without damaging the trees to access the rocks/ground beyond them.  I have done that myself to dig into the ground in this location to locate a break in the invisible fence line before.
 
Third about this problem:

I am sure you can locate some buckets or other containers to put the [redacted]' rocks in and return them.  If you can’t I can provide a few.
 
I am also tired dealing with this.   If you called me to talk through it, I am sure it will be faster then going back and forth through email.Sincerely,[redacted]

Thank you for giving me the opportunity to respond to this complaint.  As I mentioned earlier, this is the different posting than the one I previously viewed.  Can you tell me if this replaced the first one or is in additional post.  I can't seem to find the original...

post and our customer would like to read it.
We had planned on removing the rock as requested.  The access to the rock is from our customer's property and they have asked us to not do anything.  We can't get to the rock without trespassing, so at this point we will not be able to comply with the request.  Our customer and the neighbor may be heading to litigation and they want us to be clear of any collateral damage.
I don't plan on responding to the complaint.  I am fearful of escalating the situation.  Our customer plans on dealing with the neighbor and said they posted a rebuttal to the complaint.  I don't know where they posted, since the complaint isn't showing yet.

You can access the rocks that are on my property from my side so you don't need the neighbors permission to fix the problem.  I have not requested that you remove any rocks from the neighbors property.
