I am rejecting this response because: Firstly, per the contract, Contractor says he is licensed and insured According to the CSLB, contractor has stated that he is a sole proprietor and has no employees and therefore does not have Workers Compensation InsuranceWe do not have a scanner to attach any document from CSLB, but would be happy to send any documentation necessary by regular mailSecondly, contractor only worked hours the first days of what was to be a day job with two peopleThe first day was the only full day of work (hours), the other days were half days and Wednesday contractor did not show up at allContractor only had help for part of one day (hours) that weekWe were, however, billed for the wife and son (employees) at $an hour each for hours of cleeven though contractor told us there would not be any charge for thatFurther, whenever I looked to see what was being done, son was staring at his phoneThe contract was for a flat fee and yet we were going to be charged weekly of what we thought would be progress payments (progress payments should outline what will be done each week and the amount owed at the end of that week) and contractor wanted prepayment on Thursday (without knowing the time or workers to bill for) so they could pay workers on Friday In addition, checks were to be made out to the husband and wife individually, not in the name of the businessContractor, et alwas very unprofessional even cooking and eating their lunch in our kitchen without asking.Upon reading the page diatribe of August 1, it should be clear that contractor is extremely unprofessional and trying to bury the real issues and we will not even dignify that email with a responseMy husband and I are seniors and we were bullied and harassed by the contractor and his family from the first day and have refused to answer them, including blocking their continuous phone callsWe don't believe that there was ever any intention to complete this job in days and that the scope of the job was above what contractor was capable of.A complaint has been filed with the CSLB

CSLB, but would be happy to send any documentation necessary by regular mail.My Response: I am Licensed and Insured Insurance does not mean I have to provide Worker's Compensation Insurance I have General Liability Insurance I do not have any employees However, it is my right to hire Laborers, per job, provided that they do not earn more than the legal amount That is the Law I have provided to *** and *** *** a Contract, of which they signed, and have had at least Meetings with them, before and during the work

My Response: The Contract, attached states quite clearly how payments will be made and that any assistance will be billed at $20.00/hour for Debris Clean-up; in fact, the Clients wanted me to save all of their Shake Shingles from the Square Foot Rip-Off for neighbors to come over and take for firewood kindling Then, when I told them that was absolutely impossible because of the nails, the time, the mess, etc., they expected me to get a Giant Shredder and place it into the Ton Roll-Off and start Shredding Shingles to make more room for all of themMy Response: Anyone on-site during the week of July - 28th should have been compensated a "Fair Wage" Because *** and *** *** failed to pay for Labor that week, withheld all monies owed per Signed Contract, no one has been paid *** told me on July 24th, the start of the Work, that I would have to hold all checks she wrote to me because they didn't have any money I told her that was not alright, and if I was to progress with the work that week, that she would need to pay me at the end of the week We mutually agreed to Friday afternoon, with hours billed through Friday at noon She left the Work Site early, so that she wouldn't have to pay me, and gave her husband *** a check for Materials Reimbursement made out to a Company name "Hamil Construction", which is not the legal name of my Company The only time anyone was on a phone was during their Scheduled Lunch Break, which was minand then they were able to take their phones out of their vehicles.

My Response: I did not ask for any compensation before hours worked; however, by CSLB Law, I could have asked for monies before work was started The Contract states clearly what the Scope and Sequence of Work will be and any additional assistance will be paid This is not a Flat Fee Contract The Contract is Attached to this ResponsePer ***s: "In

My Response: My name is in my Business; therefore, the checks are made out to me or my wife, as her name is also on my account That is Legal per Tax Law I have also consulted with CSLB regarding this, during my Licensing, my Tax Professional, and CSLB again this week

My Response: At the point I discovered the massive Rat Infestations around the house, the dead Rats, the Rat Fesces, I decided that there was no longer anywhere to sit around the perimeter to safely eat I tried to discuss this with them, even sending them an email that the Rat Infestations was overwhelming and the Debris accumulation of approxTons of Debris around the house, the Tree Limbs that were supposed to be cleared, etcwas making it impossible to safely work or progress, etc They didn't wish to discuss this; in fact, they told me to give them a daily update at the end of each dayTherefore, I didn't realize that it was not appropriate for the hired help to come inside to the kitchen They had been perfectly fine with offering especially since I reiterated before the Work was started that I would need bathroom accomodations and a place to eat during the Work Lunch breakI believe that is the Law The Work Place must be Safe to Work in, and one must have bathroom accomodations, water, shade, etcto take an occassional break
***s' Response to my (2) Letters filed per CSLB Law in Response to their Non-Payment for (1) Full Week of Labor, which substantiates that they received my Letters: "Upon reading the page diatribe of August 1, it should be clear

contractor was capable ofMy Response: They verbally harassed me and the Laborers on the Work-Site *** verbally threatened one of them At that point, the Laborers were afraid to return to the Work-Site without additional support *** tried to force me to hire someone off the street, who showed up at the Work-Site at ***'s request
*** and *** also tried to force me to use their Materials, already at the Work-Site from a Handyman that they hired to do the entire Job The Materials were sub-standard and would have violated the James Hardie-Board Shingle Siding Warranty They argued with me and yelled at me about this during that week When I pointed out also that the Drip-Cap on their Roof had to be replaced, *** was adamant that it would not be because he didn't want to spend any additional money over the Initial Inspection to ensure that the Work was completed correctly Sometimes an Initial Inspection doesn't reveal everything; in fact, it was impossible to see that the Drip-Cap that was stories from the ground was destroyed until the Shake Shingles were removed
*** and *** insisted after (2) days of Shake Shingle removal that I only work in (1) section of the house at a time This was totally contrary to my intentions to speed up the entire process To me, it would have been more time-effective to remove all of the Shingles, then the Siding Paper, then the nails, then the Drip-Cap Nails, etc., then do all of the Caulking, which wasn't in the Contract, but *** decided he wanted that done as wellI am a Licensed General Contractor Everything I tried to do on this Job was undermined by them and stopped by them
*** and *** *** called a "WORK STOPPAGE" I did not They never intended to pay me anything They never intended to pay the other guy, the Handyman, anything either He was so scared of them that he left over $of Scaffolding at their home He has never been back
*** and *** *** compensated some teenage children with Pizza to paint $16,worth of Hardie Board Scalloped Shingle Sidlng, instead of letting me add that to my Estimated Labor Proposal That is Illegal That is a Violation of Child Labor Laws
They don't want to compensate the Laborers I brought on-site either for the cleand removal of the shingles because they think these people should be working for free as well That is why they don't want to pay anything They are also upset that we came inside of their home to use the restroom, use their microwave, and sit at their kitchen counter I have never been treated so disrespectfullyPer the Invoice I have provided to them, I should be legally paid Per Contract, I can also bill them for all of the Meetings and the Purchasing of the Materials on their Behalf I did not do that I have Invoiced them for Labor only and broken it down into hoursYes, *** and *** *** are Seniors However, *** has a (4) Year Degree in Math & Science and a (2) Year ParaLegal Certification *** *** is a Mechanical Engineer, recently retired They both have plenty of knowledge in their fields and are not being taken advantage of

My Response: Yes, I know this I have been in contact with the CSLB also I am very proud of my years of Education, my Licensing, my Professional Experience, my Clients, my Work
My Resolution for this:
I am requesting that you sign an Abandonment of Contract, Releasing me from the Contract, and pay me in full for the Labor per the Invoice dated July 28, Otherwise, we are still under Contract, as you have called a "Work Stoppage" That means that even the correspondence that I have made in order to collect the debt you legally owe to me, the letters I have sent, any any other Legal Actions I have to take including this correspondence, that per Contract, I can also request Compensation You are demanding that I now pay for another Contractor to complete the Work That is not appropriate, as you are the ones who called the Work Stoppage It has been your intention from the start to not pay for this work, and this is your way out of it

*** and ***, Attached you will find the IN YOUR BEST INTEREST LETTER to DEMAND PAYMENT for All Labor Invoiced immediately I have sent this to the Contractors State Licensing Board as well Since *** spends all day at the Computer on the Internet, I know you will get
this asap.I have made sure to send it in (2) Formats, both Excel and PDF for your convenience Hamil Home Remodeling expects to hear from you immediately in response to the Letter attached, with the EXPECTATIONS OF PAYMENT IN FULL FOR ALL LABOR INVOICED to date in person on August 3rd, at 4:at Union Bank in Tehachapi The Contract and Letter spells it out Have a nice day.DO NOT CONTACT me via any other method than Email Craig Hamil, General Contractor, #[email protected]

I am rejecting this response because: Firstly, per the contract, Contractor says he is licensed and insured.  According to the CSLB, contractor has stated that he is a sole proprietor and has no employees and therefore does not have Workers Compensation Insurance. We do not have a scanner to attach any document from CSLB, but would be happy to send any documentation necessary by regular mail. Secondly, contractor only worked 23.25 hours the first 5 days of what was to be a 13 day job with two people. The first day was the only full day of work (7.25 hours), the other 3 days were half days and Wednesday contractor did not show up at all. Contractor only had help for part of one day (7.25 hours) that week. We were, however, billed for the wife and son (employees) at $20 an hour each for 24.5 hours of clean-up even though contractor told us there would not be any charge for that. Further, whenever I looked to see what was being done, son was staring at his phone. The contract was for a flat fee and yet we were going to be charged weekly of what we thought would be progress payments (progress payments should outline what will be done each week and the amount owed at the end of that week) and contractor wanted prepayment on Thursday (without knowing the time or workers to bill for) so they could pay workers on Friday.  In addition, checks were to be made out to the husband and wife individually, not in the name of the business. Contractor, et al. was very unprofessional even cooking and eating their lunch in our kitchen without asking.Upon reading the 9 page diatribe of August 1, it should be clear that contractor is extremely unprofessional and trying to bury the real issues and we will not even dignify that email with a response. My husband and I are seniors and we were bullied and harassed by the contractor and his family from the first day and have refused to answer them, including blocking their continuous phone calls. We don't believe that there was ever any intention to complete this job in 13 days and that the scope of the job was above what contractor was capable of.A complaint has been filed with the CSLB.
