Fireplace Model *** Client #: LCXXXXXX: Date of Purchase: 08/02/2018 Due Date: 28/02/2018 Date when I informed the issues to Hamilton Home Comfort Heating & Cooling:Wed. Jan. 30, 2019.Type and Description of the fireplace purchased: *** 36" Direct Vent Gas ELITE Price of fireplace:$3,616.00 Owner indifferent to issues, phone conversation confirms his reasons: Wed. Jan. 30, 2019, "the warranty is expired; the customer is at fault for not informing (him) about the issues on the day of installation and /or shortly after it was installed.Nothing can be done because (his) week is already full; the issues are cosmetic, tag for approval for gas compliance and installation verification are problably in a spot away from the fireplace, warranty is only for repairs if malfunctioning; one week before warranty expires is invalid" Hamilton Heating are friends of the renovation company, I hired at the same time when the fireplace was ordered, and installed (***) both send each other customers.I had a choice to have either company install the fireplace, since according to *** at *** they are certified to install as well.They also mentioned that their friendship ensures each other's work is done properly, and that they've never have issues this way. I chose Hamilton Home Comfort to install it since that's where I bought it. Unlike Hamilton Home Comfort, his friends at ***, have been more than cooperative to come back to my house, and repair, re-do some of their work due to other issues, and including the wall of the fireplace, visit scheduled for Monday, Feb. 4th 2019; *** will be there. It was just 2 weeks ago that I first became privy to the fireplace issues, and 2 weeks ago is when *** was informed of them: they should have shared the info with Hamilton Home, but didn't; but that's ok, I was going to do so anyways: not once has *** implicated their friends, Hamilton Home Comfort of violating codes. TSSA Ombsbudsman, *** cognizant of the responsibility of *** C., to use his leverage to get Hamilton H. to pull their weight! Utilities company scheduled to inspect gas leaks week coming up. The owner claims "there's nothing he can do, since the warranty is not going to cover any damages; and it was expired anyways, issues with the construction work done by his friends were the fault of his friends, does not concern (him)" Issues: installation day (mid Feb. 2018)technicians installing fireplace: odour of gas, hydrocarbon of scents permeates when on: Hamilton H. notified of this, supposedly normal, but still continued Dec. 4 2018: inspector shuts off gas since mid Jan. 2019: inspection: fireplace is not enclosed against wall; gaps up to 3" perimeter of fireplace to wall; dents to metal from inside due to protrusions dimpled outside surface of fireplace, inserted to wall crooked, not aligned to horizontal vertical planes to wall; scratched and dented metal corners stained with dirt, dust of fingerprints and oil? odour of gas: the owner of Hamilton Home made no attempt to offer a home visit to test for a gas leakage, repeated that he "is not available" he mentioned the warranty expiration 3 times in the whole conversation.*** Website states "We are dedicated to building positive relationships with all of our clients and ensure that our valued customers are completely satisfied following a purchase or upon a completed installation." Misrepresentation of Installation Codes: Pg.7 of 53 *** including codes for installing a gas appliance in the province of Ontario, City of Hamilton

Desired Outcome

-apology: Hamilton Fire Dept. for being called on April 3, 2018 for suspect carbon Monoxide emergency from having used the fireplace with the stench of gas, -in writing to the customer for his reproachful tone; his *** remarks; *** attitude to *** inspector not knowing what to look for and where to look for the tags; to his friends at *** for abandoning them without support -have the issues known to the company who is relying upon Hamilton Home to correctly install with ethical mindedness and regulatory standards of safety and compliance to codes in the industry: *** Fireplaces B.C. Canada for*** since we've been inhaling gas, that prior to the installation, our interior air was not combustible, was not carbon-contaminated and was better than before the installation of the fireplace occurred. installation was never checked, and verification that a gas test was done on the day it was installed was not confirmed, nor was attempts made to do so even after notification of this issue was made to Hamilton Home; knowing that what and how his technicians installed the fireplace is contrary to codes and that the fireplace cannot be used because it was installed knowingly to the technicians that the surrounding wall and area was already impaired, therefore not suitable for a proper installation to begin with, but the technicians still went ahead and installed it, *** -for the technicians to contact *** Fireplaces to let them know of their violations -*** -remove the fireplace and refund my full amount plus the amount for having the Utilities inspection -clean up the entire area and remove everything -call the utilities company to tell them what his technicians did not do according to codes -notify the city of Hamilton Health Dept. for the hazard created

Customer initially called us over a year after the fireplace was installed. During that time the house/area was under renovation. Customer's initial complaint was about a gas tag not being located by home inspector and about an issue with the surround. I told the customer that we could send someone to have a look to ensure everything was in working order, however, if there was nothing wrong with the fireplace or something blameworthy of our company I would have to charge for the trip. Not once was I told that there was a gas smell nor anything wrong with the fireplace.

The customer is not even referring to the correct fireplace - she has a *** not a *** Furthermore, I've made attempts to contact the customer via telephone to coordinate a technician to inspect/check the fireplace and situation but she has not answered her phone. We have absolutely no issue rectifying any issue (if there is an issue caused by our technicians). The fireplace was installed over a year ago and we cannot be certain what has happened within that year when there is work being done around the fireplace. Customer never called back after initial complaint in which I offered to send a technician to have a look. As with all of my clients I was not *** nor "reproachful". If the client will allow us to inspect the fireplace we will be happy to remedy any issues that may be found - but we must inspect the fireplace first and foremost. We are 100% amenable to resolving this issue with the client upon further investigation/inspection.
