As stated in the original complaint, parties through their attorneys agreed to a Final Change Order encompassing all previous change orders and outstanding work to be completed in an effort to get the contractor to return to the project and complete the stated scope of work. The contractor did not complete this work even though the homeowner fully met his obligations as specified in the Final Change Order After the deadline passed, the homeowner completed the work by hiring other contractors. The amount being sought represents the amount paid to the other contractors. The house being sold is irrelevant

I have not received a response to my proposed resolution from HMA as requested by today, May 21, 2014.  I have only received a request for more time.  I will be willing to close this complaint when I have a specific and acceptable offer from HMA.

Don called from the business stated that they are working with the [redacted]. He stated that he is waiting for all the final decisions on changes to be made. Once those are made he will start the work.

There were multiple delays due to unsigned charged orders and that he is not allowed under DPOR regulations to move forward with a  project until the charge orders are signed. At this point the work is completed and the home is sold.

Review: [redacted] and I signed a contract that he stated would take aprox 3 weeks to complete. Although I initially knew it would take longer to complete the remodel he was doing, I did not expect it to take 7+ months. It is going on 8 months and the job is still not complete. He insisted I paid him in June for the HVAC unit so he could start getting it installed. It is still not installed and he still has my $9,000. He advised me the "heat was on and Hot!" on October 9th by text message. When I got a $513 electric bill in December I contacted him that something had to be wrong with the Heat Pump. He stated he would have it checked out. That never happened. It is now Jan and I have again received another $535 electric bill, I was able to contact the installer who advised me that the reason it was so high was because the heat was NOT installed. I was operating on emergency heat. [redacted] never advised me of that, even after I made him aware of my electric bill being $511 on Dec 10th. It was also at this time I requested the blower be fixed because it ran non-stop and never seemed to shut off. He advised us he would have it looked at once his HVAC guy was available. We have been demanding he finish the HVAC unit (outside condenser) since November 7th. The reason we were given about the emergency heat was, "you should have known". [redacted] has breached his contract on numerous accounts. The job is still incomplete and as my newest tally he owes me around $10,000 of the nearly 30,000 I have paid him. He fails to pay his sub-contractors, who then show up at MY home looking for payment and him. I have been more than patient with him however it has come to the point where I feel my kindness and patience have been taken for granted. I have all documentation for all communication and will be also seeking the use of the arbitration process as agreed upon in our contract.Desired Settlement: I would like to be paid a full refund for the elevated electric bills due to his failure to complete the job as he stated he had done. Currently that is at $1050 and going up by the minute. I would also like a full refund of $9000 of the HVAC unit that is yet to be fully installed so I can pay someone reliable to complete the job. I would also like a refund of of work he did not complete that was in our contract. That is currently under review.

Review: Contracted with Builder in Feb 2013 for large renovation project. Project slowed and came to a halt in October 2013 after the Builder had been paid approximately 70% of the total and the house wasn't even weather tight. The parties finally agreed to a 'Final Change Order', outlining a specific scope of work and deadline for completion in order to get the project going again. The Builder performed only a small percentage of the work to be done, with workers on site only a few (probably 3) days during the 7 weeks prior to the deadline.Desired Settlement: Builder to reimburse Owner for expenses incurred to complete work which Builder failed to perform. Approximately $66,000, not including legal fees and other administrative costs incurred.
