Both [redacted] and [redacted] have acknowledged that the [redacted] was damaged upon receipt. Whatever markings on the outside of the box were nothing major enough to indicate that the machine had been destroyed. The fact that the Freight carrier offered to reimburse .50 per lb. implies that they were aware that the [redacted] was damaged during delivery. I will remind the seller that the machine was scheduled to be delivered on a Friday. I received a phone call on that day to inform me of rescheduling for Monday.None of the circumstances involving this purchase, (including my acceptance of delivery) change the fact that I stated before. I paid for a Brand New Machine plus shipping and handling to be delivered to my address. This is not what I received. [redacted]

Review: I purchased a New Accura 03801 20 Disc [redacted] from [redacted] of Hamilton Tool & Supply through the Internet on 10/28/14 for a total price of $1850.50. [redacted] $1575.50 plus $275 for Delivery including Lift Gate to my home address. The item was delivered on 11/3/14. Rather than ask the driver to wait while I unpacked it I made the mistake of signing the receipt, shook the drivers hand and sent him on his way. When I removed the cardboard from the pallet on which the [redacted] was bolted, broken pieces started falling on the floor. Further inspection made it obvious the machine was not useable.I went inside and called [redacted] to inform him. He asked me to send pictures of the damage. I asked him to arrange pick up of the item and to credit my Master Card. I also phoned my credit card company to advise them of the situation. They suggested I dispute the charge until what time the merchant responded. I emailed several pictures as agreed on 11/3/14.The following day I emailed to confirm receipt of email. I have included emails where Seller acknowledges the damage after receiving the pictures and agreed the [redacted] was destroyed and that he will start filing a claim. No further attempts to update or advise me of picking up the damaged item were made. In the days that followed I left several messages but received no reply.I emailed [redacted] again on Tuesday 1/14/15 to advise him I would be sending mycomplaint to the Attorney General if I did not hear from him. I have recieved no reply.Desired Settlement: I would like my Master Card credited for the full amount charged. I ordered a New Accura 03801 20 inch Disc Sander. Also to arrange for pick up of the damaged item.Date: November 4, 2014 at 8:03:13 AM GMT+8Subject: FW: Other: [redacted] sent a message about ACCURA 03801 20 INCH DISC [redacted] PRODUCTION GRADE!! Response:

Accura 20” Disc Sander damaged in transit.

When we received pictures of the damaged rnachine. we filed claims with the carrier ([redacted])

for damages of this sander that occurred during transport.

[redacted] has denied our claims, [redacted] claims that when the merchandise was received, the consignee

executed the delivery receipt and acknowledged that the freight was reserved in good condition except

as noted. There was no notation of any loss or damage to the freight orthe outer packaging indicated

anywhere on the delivery receipt

At our last appeal, freight carrier acknowledged no liability for freight damage, but offered to

reimburse .50 per lb or $229.50. We have not yet accepted this offer.

We take a lot of pride in our packaging and this was our first freight claim in over 7 years.

This was a brand new, well packaged machine carefully banded onto a standard pallet to Insure good

handling by the freight company.

Unfortunately something catastrophic happened after it left our dock. The photographs sent show

major marking to the outer packaging that was not noted on the acceptance receipt. This machine must

have been dropped off a forklift or a dock.
