Review: After months of a declining relationship with the gym, I had a public altercation with one of the owners on June 8th after which we never returned to the gym. I assumed we would not be welcomed back nor did we really want to return, but we sent an e-mail regardless on June 27th asking what was required to cancel our memberships (we had already fulfilled the one year contract). No reply was sent. I then called on July 10th after my membership fee was again charged. I was then told by the owner's mother I would have to submit something in writing. I immediately e-mailed asking that either the payment for July could be re-funded or I would continue using my gym membership and asked that my membership not be renewed for the following month. Once again, no response was received via e-mail; instead, they now requested me to call the owner because there were concerns prior to my return. I agreed to call, but asked for confirmation that my request was received. None was sent. Since no written response was received for the June 27th, July 10th, or July 11th e-mails, I no longer wish to have verbal communications. I do not believe they expected me to return nor did I have intentions to return; however, they were more than happy to charge my account and had no concerns from June 8th all the way until July 10th when they thought I might actually use the membership they continue to charge. I am tired of the games and refusal to respond in writing.Desired Settlement: I would prefer to have my membership immediately cancelled and re-funded. I would like a quick resolution so that both parties can just move forward. At this time I'm not using my membership because I'm afraid doing so would give Hammer Training and Fitness reason enough to not refund the July membership fee.

Our side of the story is as follows:

Prior to June 8, 2013, the member was using the gym on a very regular basis as can be seen by the attached report of her visits. She was eligible to cancel her membership any time after June 30, 2012. She never expressed any dissatisfaction with the gym to either owner or any of the employees until after her credit card had been charged on July 1, 2013 and she was attempting to get a refund.

The altercation the member mentioned occurred at a mixed martial arts event at the [redacted] Resort in [redacted], PA on June 8, 2013 where she was publicly intoxicated and physically attacked both owners. After the altercation, the member never returned to the gym, by her own decision. She never reached out to anyone at the gym to cancel her membership or discuss the altercation until July 10, 2013. The membership agreement, which she received a copy of, explicitly states that she needs to cancel her membership by providing written notice in person or return receipt requested within 14 days of the desired termination date. A copy of the agreement is attached. Her credit card was charged automatically by our system because she did not cancel her membership by June 17, 2013.

The only communication we received prior to July 1, 2013 was from the member’s boyfriend, who sent an email on June 27, 2013 asking what he needed to do to cancel his agreement, which was responded to in writing via email. Both parties had separate agreements and required separate cancellation notices.

We did respond to all communications we received from the members regarding the cancellation of their memberships in writing via email but may not have responded as quickly as the member had wanted due to a backlog of work and emails.

When the member called on July 10, 2013 asking for her money to be refunded, she was told that we would not refund her money, because she did not cancel within the 14 days prior to July 1, 2013. She was unhappy about this and said that she would return to the gym to use the gym for the remainder of July. No one ever told her that she could not use the gym. The managing director sent an email to the member on July 11, 2013 requesting that the member call the owner and the owner also called the member on July 11, 2013 and left the member a message explaining that the owner had no issue with the member returning to use the gym, but the owner would like to talk to the member about a six year old Karate student who was upset after witnessing the altercation on June 8. The owner asked to speak to the member instead of communicating with her in writing because verbal communication is more personal and the owner was concerned that the tone of a written conversation could be misconstrued and the member was already upset about the credit card charge. The owner only wanted to explain how the Karate student felt after the altercation and to ask the adult member to apologize to the child so that the child would not be upset seeing the member back at the gym. Instead of calling the owner to discuss the altercation, the member filed a complaint with the Revdex.com and then sent us an email telling us that she did so.

Since a few other members complained about this member’s attitude, she physically attacked the owners, and she was unwilling to verbally discuss the altercation, we decided that we did not want to expend any additional time or energy dealing with the situation, so we refunded her money on July 15, 2013 and cancelled her membership. Proof of refund is attached.

Should you require any additional information, we have multiple witnesses who can attest to what we have stated regarding the altercation and the member’s attitude.
