Complaint[redacted] was given a deposit to complete restorations. He failed to honor 3 appointments following payment,then refused to refund after terminatA pipe burst at my hthern November 2014. I hired [redacted] as a contractor to stop the leak. He contracted a plumber who was unsuccessful in his attempts to locate the leak, but created damages to 3 faucets, 2 walls, a floor and dug 2 separate large holes in my yard to find the leak. Another company located the leak and Mr. [redacted]'s plumber stopped the leak in December 2014. After waiting for [redacted] construction to produce an estimate for repairs due to water damages, We received a payment from my insurance company in February 2015. My mortgage company required additional documentation in order to endorse the insurance check for payment which included a current insurance bond from [redacted] construction due to the policy provided was expired. Mr. [redacted] renewed his policy within two weeks, then endorsed the insurance check which had been signed by the mortgage company while promising me that he would begin my job immediately after I provided him with a deposit to pay for materials. He also suggested many other improvements to my home that he volunteered to do at cost out of appreciation for my business. I asked if we could get those additional items in writing, he agreed so qe scheduled an appointment to do so after the Easter holiday. Once the insurance check cleared, I paid Mr. [redacted]. He cashed my check immediately, then began breaking appointments and avoiding my pho calls. I finally reached him after calling from my daughter's phone. I scheduled an appointment to repair the holes in my lawn and begin other work the following Monday. I advised Mr. [redacted] that another cancellation would result in a termination of our agreement. He promised that there would be no more problems, that he would be at my home Monday morning during lawn restorations and he would phone me that afternoon with a schedule for the remaining repairs. Monday was a no call no show on Mr [redacted]'s behalf so I terminated our agreement in writing. His response was to accuse me of forging his name and depositing the insurance check to HIS account! He also accused me of demanding the additional work he suggested, stating he was afraid that I wouldn't pay him if he didn't do the extra work. I replied fine, just take the $4200.00 you charged me to find and stop the leak (even though Mr.[redacted] stated that the figure included restoring the lawn, faucets, and walls damaged while trying to locate the leak). I only asked for the remaining $4800.00 of the $9000.00 he didn't use on materials. He refused. He hasn't answered any of my calls since. It has been over 7 months since we signed our agreement on December 8th, which states that he would finish the job in a timely manner.Desired SettlementRepair my lawn, walls and faucets, then refund me $5000.00 due to interest and increased utility bills caused by leaky faucets.
