Hammond Home Investors (“HHI”) is sorry to hear that one of our customers is less than satisfied with their purchase The owner of [redacted] purchased the residence pursuant to a contract with HHI which contains the standard “as is, where is” and “without warranty” terms approved by the Colorado Real Estate Commission which are standard with the sale of nearly all real estate in ColoradoThe contract controls the relationship between HHI and the owner The owner was represented by a licensed Colorado Real Estate Professional throughout the purchase and sale process and had the opportunity to seek and obtain legal advice During the course of the purchase and sale process, the owner was afforded the opportunity to have the home inspected by an inspector of their choosing The owner chose to have the home inspected and the result of the inspection was the identification of certain conditions which were deemed objectionable by the owner at that time The identified items were corrected by HHI at its expense prior to closing on the sale of the home All of the items were corrected to the satisfaction of the owner and no promises or warranties were provided by HHI to the owner.Although the home did not have any warranty from HHI, certain transferable third-party warranties were provided for the roof and the egress window installation which the owner has identified in her complaint After the sale of the home, and after notice by the owner of issues, HHI worked with the homeowner and the third-party providers to assist with the warranty claims for the roof and window Repairs were performed by the third-party contractors who provided the warranties, again to the satisfaction of the owner at that time.The claims asserted now by the homeowner are disputed and are not covered by any warranty from HHI The owner has made a claim for multiple items which have been addressed both prior to and after sale as appropriate given the contract terms HHI disputes that it has failed to act accordingly and disputes that any money is owed to the owner HHI will continue to respond to the concerns and issues raised by the owner pursuant to the contract terms outside of the Revdex.com process

I am rejecting this response because: the seller assumed liability when they admitted to the faulty grading and improper roof pitching and attempted to repair  these faults of the home, and even committed to repair the wall cracks, after August when we knew the house was no longer moving.  The Hammonds as sellers acknowledging fault.  They are clearly implicit  as they know that the parties they hired to do this work did not do the work correctly. Unfortunately, their attempts to repair were still not done properly, resulting in more risk to the home's foundation. We waited til August as they and their structural engineer suggested to ensure the home was no longer moving.
As the buyer we could not have discovered this defect in a standard home inspection and our discovery with three separate structural engineers all implied that the root cause of the flooding and foundation damage was caused by the installation of the basement bedroom and the improper grading caused by the installation of the egress window and the failure to pitch the roof and repair the gutters, all items that were not discoverable in the home inspection, the Hammonds had responsibility as sellers to ensure their contractors did proper work.  As a result the buyer has incurred monetary damages to repair not only the grading but to replace the gutters, replace the damage carpeting and waterproof the basement, repair wall cracks, repair the foundation crack. As buyer it is why we requested a roof certification and a structural certification of this home, and the Hammonds should go back to their contractors to hold them responsible for these damages on our behalf.  We purchased in good faith, and feel these certifications should have protected us from personal liability we ask that the Hammonds, investigate liability with their vendors, mediate with us as our contract states, to solve the issues with this home equitably.
