Security Deposit not returned to me despite 41 days since vacating premises.I rented an apartment at [redacted] MA XXXXX and my lease ended on May 31, 2015. I vacated the premises and left a clean house, as per the lease agreement.Despite informing Hampton Properties of my address to which to send my security deposit check via email on June 18 and then on phone on June 22, they still mailed it to an address that I had explicitly asked them not to use.When I asked that this be rectified, they assured me that they had mailed me a check to the correct address yet 10 days after this date, I am yet to receive my security deposit as stipulated by the lease agreement.MA law requires security deposits be returned in 31 days and Hampton Properties has violated this.Desired SettlementI want my security deposit back in its entirety ($410).Business Response Tenant has vacated the apartment on 5/31/15, he had provided us with an address to send his security deposit to as requested.A week before security deposits were sent out he called to change his address and was asked to email it, which he did. The security deposit was mistakenly sent to the 1st address given by a temporary employee working for the company (Ck [redacted] sent on June 30th). The mail box that the check was sent to is still a valid address for the tenant so therefore was never returned to us. [redacted] made us aware of the mistake and a check (ck# [redacted] was sent to his temporary address in ** on July 14th. Deductions in the security deposit were made for paint/wall damage, cleaning and a balance of unpaid rent. We took pictures and kept them on file. Neither of the other roommates have disputed these charges. As of today, the check has still not been deposited and the tenant has not contacted us regarding the matter. As always we would be happy to answer any questions the tenant may have regarding deductions and have apologized for the error. We ask that when he returns to Worcester in September that he discard the check that we have cancelled that has been in his mailbox since the end of June.
