we took this project on without knowing, that these people have had a history with contractors and that the people I have talked said that they know them and would not work for them
the project started out as hang some cabinets that were
previously hung and maybe install a dishwasherAs we progressed in the project things kept changing at the customers request ( with no written change order or up charge.)
1) the cabinet layout changed at least three times as well as the outlet placementthese homeowners were very unorganized to say the least
2) then she decided to move the refrigerator into the wallthis space also changed multiple times, as she kept changing her cabinet and her cabinet layout almost daily
3) we laid out the design and I went over exact dimensions with her ( I did not make her sign it, although I should have) I explained to her that the refrigerator was going to fit tight into the wallshe said do it
4) she then added tile, but instead of giving us tile she gave us mostly little tiny pieces to put in
5) she then added painting and grouting etcetc., all the time I am trying to get her to make decisions and try to get the project finished because her procrastination and her in ability to make decisions was wreaking havoc on my schedule
when we were almost done we put the fridge in it was tightI said I would fix it at no charge to her, because the customer is always right, but that it was her decisions that put it in the awkward space she flipped her lid
there was already a small dent on the front of the fridge before we started ( I should have taken a picture) it is a very inexpensive fridge maybe two hundred dollars at the most, and is at least ten years oldit isn't even stainless steel its that cheap gray looking front
finally I had had enough, she would berate my crew behind their backs and her husband would sit and tell them story after story and waste their timeI finally told them I had had enough and I couldn't work for them anymore, they were impossible to work for, I told them it was nothing personal but I couldn't do it anymorewe agreed on a sum which was almost half off of what my original invoice was for time and materials, for their inconvenience etcI just wanted to be done with them they are impossible to work for, the invoice went from 1,down to 800.00, before we started and also during the project
they talked me down on my hourly ratequestioned every hour we billedon top of that they have a lot of money and were bragging about it to a couple of my guys, how they get these huge annuity checks
long story short I feel that the dollar discount I gave them on the project is well more than enough to take care of getting the drywall shaved down and even get a new fridge even though we didn't hurt their old one) and probably fill it with booze like there's isI feel I have done more than enough to compensate these people who are slandering me and my crew and treating me poorly
I squeezed these guys into a booked schedule which they were aware of, because they basically begged me for help, and then they proceeded to take advantage of mewhat I would like from the is a written apology and the old fridge when they get a new one, I definitely paid for it, and I definitely don't deserve this from themThe job was way under billed and then they got a huge discount on top of it and they still slander me

This response is simply not truePutting aside his immature personal attacks and claims, these are true facts:
I have cancelled checks paid to him on 5/and 6/totalling $2,NOT just the $mutually agreed-upon second payment, to which he referred
I have the Warners'-Stellian receipt for our SS refrigeratorNOT "at least years old" as he falsely claimsIt is freezer-on-the-bottom; certainly not cheap as he falsely claims
At the outset, we discussed options for cabinet & appliance placementAt that time I suggested a wall breakout for the fridge, which he declinedAs work began and I did not like the placement, he said they could do the breakout
I DID NOT MEASURE THE WALLWE AGREED that a fridge door needs clearance to open properlyThe fridge and cabinets were on site: no unknownsHE MEASUREDHE gave his employees the specificationsI MADE NO SIZE CHANGES to that space from the time he measured for the breakout,to the time he abandoned the wrongly-done spaceAgain, his claim that we ever changed this space is completely falseAs the space began to materialize, I REPEATEDLY EXPRESSED CONCERN to his employees that it did not seem large enoughThey insisted it was correct
I did NOT "add tile" as he claimsI never "added painting and grouting, etc" as he claimsHis employee told me he would need tile for the floorI have plenty left over from the adjoining tile floor and set out stacks of whole tiles and a stack of cut pieces and grout powder, more than enough for the roughly 2' x 4' spaceI did not select the pieces, nor was I present when it was laid
We had table saw, paint and construction materials and tools cluttering this unfinished space and our patio when we had house guests May for our daughter's weddingbefore we realized the fridge was stuck and the extent of the damage to it
We are left with a wall that needs to be redone, and a SS fridge with dented door and scratches on the sideWhen he took this job he told us it would be completed by the 3rd week of May, but before starting he would be on vacation for weeksAt the beginning of June, he abandoned the unfinished and messed up project, before we realized the fridge was stuck and the extent of damage to it

WE NOW HAVE TO HIRE A CONTRACTOR TO REDO THE TOO-SMALL BREAKOUT SPACE HE LEFT, AND REPLACE OUR DENTED FRIDGE
We need to pay a contractor to shave back the breakout wall so it's large enough (as he should have done it), then finish the newly-exposed wall, then re-tile and install baseboard in the new space
Restitution from his contacting business is a fair and reasonable expectationWe must hire a contractor to make the space right and buy a replacement SS refrigeratorThis will cost us far more, but as a goodwill gesture, we will accept $restitution and consider our dealings with this business concluded
