townhouse until he could see it in person. Without commitment to renting the townhouse, I continued to look for applicants. (This first applicant did pay the security deposit after being approved to hold the townhouse until he could see it in person). The complainant submitted his application on Nov. 12th. I received his wive's application on the evening of Nov. 13th. I also received 2 more applications on Nov. 13th for a couple I showed the apartment to the previous week. After I received the applications, I sent a "request for approval" email to each applicant to give us permission to run a background check. When approval is received from an applicant, those requests are automatically processed by TransUnion and paid for by the application fee that is collected when the applicant submits their application. After approval is given by the applicant I can not stop the background check. The first applicant decided against renting the townhouse on Nov. 14th. I deferred his application and issued a refund for his deposit. At 1:00p.m. on Nov. 14th I sent an email to the complainant that stated that we would "continue to process your applications. I received the approval for the background check from your wife and am still waiting on yours so I can continue." I did not state that the apartment was theirs as I was still processing all the information. At this time I was also processing all applications that I had received to find the best applicant for our apartment. Going off of the information that was on the application that was provided by the applicant, I offered the rental to the applicant who best fit our qualifications. I sent an email to the complainant that said, "Thank you for applying for one of our apartments. Unfortunately, at this time we have decided to rent to another applicant..." I let the complainant know that we would keep his applications on file and "consider your application for future openings..." I do apologize for the misunderstanding that took place.
